RECORDED IN PLAT BOOK 5, PAGE 82 OF THE PUBLIC
RECORDS OF MONROE COUNTY, FLORIDA.
WHEREAS, an application was filed by Amedeo & Lynn D'Ascanio to abandon a
portion of the right-of-way of Nautilus Street and Corsair Road of "Plantation Island", Duck
Key, adjacent to Lot 14, Block 5 according to the plat thereof, recorded in Plat Book 5, Page 82
of the public records of Monroe County, Florida
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter right of
way; and
WHEREAS, due notice has been published and a public hearing has been held in
accordance with Chapter 336, Florida Statutes; and
WHEREAS, at said public hearing, the Board considered the argument of all parties
present wishing to speak on the matter, and considered the renouncing and disclaiming of any
right of the County and the public in and to the hereinafter described right of way as delineated
on the hereafter described map or plan; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that it hereby renounces and
disclaim any right of the County and public in and to the following described streets, alley -ways,
roads, or highways as delineated on the hereinafter described map or plat, to -wit:
Description: (For Road Abandonment Section "A ")
A portion of Nautilus Street and Corsair Road of "Plantation Island", Duck Key, adjacent to Lot
14, Block 5 according to the plat thereof, recorded in Plat Book 5, Page 82 of the public records
of Monroe County, Florida and being more particularly described as follows:.
Commencing at the northeast corner of said lot 14, block 5, (a radial line from said point
bears north 82°1526" east to the center point); thence north 82°1526 east, 30.59 feet to

73°26'47" east to the center point); thence northeast along said curve concave to the

Beginning at the northeast corner of said lot 14, block 5, (a radial line from said point
bears north 82°1526" east to the center point); thence north 82°1526" east„ along said
radial line, 30.59 feet to a point on a curve concave to the east (a radial line from said
point bears north 73°2647" east to the center point); thence northeast along said curve,
having a radius of 75.00 feet, a central angle of 60'23'13", an arc distance of 79.05 feet
to a point on the southerly line of said lots 13 and 14 (said line also being the northerly
right of way line of Corsair Road); thence south 43°50'00" west along said line, 49.97

27 The petitioners, Amedeo and Lynn D'Ascanio, request an abandonment of a portion of Nautilus
28 Street and Corsair Road of "Plantation Island", Duck Key, adjacent to Lot 14, Block 5 according

32 The petitioners have made the request in order to allow for greater use of their property and
33 eliminate unused right of way. The petition requests the abandonment of an oddly shaped excess
34 of approximately 2,349.04 square feet of platted right-of-way at the corner of Nautilus Street and
35 Corsair Road. The right of way would be divided with the adjacent property owner. The
36 petitioner would receive 1,174.52 square feet while the adjacent property would receive
37 approximately 1,174.52 square feet. The right of way of Nautilus Street and Corsair Road would
38 remain 50 feet.

The petitioner owns one of the affected properties (RE No. 0038354M00000). Lore Grob owns
the second affected property (RE No. 00303580-000000). The petitioners have submitted a road
abandonment petition in order to allow for greater use of their property and eliminate unused
right of way.
The petitioners are the owners of property (RE No. 00383540-000000) therefore letter of no
objection is required. The owner of the second affected property (RE No. 00303580-000000)
Lore Grob provided a written letter of no objection. The right of way will be apportioned to both
owners as described in the legal description provided and graphically below.

12 Monroe County Code Section 19-1 - Abandonment of Rights -of -Way states:

14 (b) No dedicated and accepted right-of-way in the county shall be abandoned where:
15 (1) the right-of-way terminates on a body of open water; or
16 s The platted, undeveloped right-of-way does not terminate on a
17 body of open water.
18 (2) the right-of-way provides access to the public to land on open water; or
19 • The platted, undeveloped right -of -right does not provide access to
20 the public to land on open water.
21 (3) the abandonment would preclude a way for the public to maintain access to
22 the water.
23 • The abandonment would not preclude a way for the public to
24 maintain access to water.

26 (c) In all other cases of abandonment, no right-of-way shall be abandoned unless there is
27 an agreement to do so by all affected property owners. For purposes of this
28 subsection, an affected property owner is the owner of property which, if the right-of-
29 way is abandoned, will:
30 (1) Have access that is currently used by that property owner eliminated;
31 • The requested abandonment is for a platted, undeveloped right-
32 of -way not used as part of the existing roadway. The adjacent
33 properties will continue to be accessed by using Nautilus Street
34 and Corsair Road.
35 (2) Have the only platted access eliminated;
36 • As noted above, the properties will continue to be accessed by
37 using Nautilus Street and Corsair Road.
38 (3) Have the paved area adjacent to that property increased for turn -around
39 purposes; or
40 • There is not a requirement for a turnaround or proposed plans
41 for a turn -around given the location of the right of way
42 abandonment.
43 (4) Be increased in size.
44 • The affected property will be increased in size, however there is
45 no objection.

I (d) All right of way abandonments shall comply with the County Code and Standard
2 Engineering requirements for road, turn -around and fire -rescue access. If required
3 for safety purposes, as determined by either Fire Marshal or County Engineer, a
4 dedicated turn -around area shall be shown on the submitted survey and shall be
5 agreed to in writing and constructed with payment by the property owner(s)
6 requesting abandonment.
7 * There is not a requirement for a turnaround or proposed plans
8 for a turn -around given the location of the right of way
9 abandonment

11 dated October 19, 2015 or from Monroe County Fire Marshal,

14 (e) A right of way may be abandoned only at the terminal portion of the road and in its
15 full width unless one of the following applies;
16 1. An adjacent lot owner has on the platted right-of-way or within a setback a
17 substantial structure which predates the Special Session Law 59-1578
18 pertaining to maps, plats and right-of-way. The term "substantial structure"
19 specifically does not include wood or metal fences, sheds or tiki huts or other
20 items not listed which are accessory structures; or
21 2. The abandonment is requested by a County department or governmental agency
22 for a public use; for purposes of this subsection public use is a public facility
23 and/or public/private utility; or
24 3. The right of way area is unusual in size or shape and after abandonment the
25 remaining right of way width will be the same on both sides of the
26 abandonment as shown in Example 1.

28 * The petitioner has requested an abandonment of a partial section
29 of right of way that forms an unusual shape at the corner of
30 Nautilus Street and Corsair Drive. After the abandonment of the
31 excess right- of- way the right-of-way of Nautilus Street and
32 Corsair Road will remain 50 feet on either side, therefore the
33 requirement of E.3 is met.

35 The requested abandonment of a portion of the right-of-way of Nautilus Street and Corsair Road
36 of "Plantation Island", Duck Key, adjacent to Lot 14, Block 5 according to the plat thereof,

Monroe County Code Section 19-1 - Abandonment of rights -of -way states:
(a) No dedicated and accepted right-of-way in the county shall be abandoned where:
(1) the right-of-way terminates on a body of open water; or
(2) the right-of-way provides access to the public to land on open water; or
(3) the abandonment would preclude a way for the public to maintain access to the water.
(b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an agreement to
do so by all affected property owners. For purposes of this subsection, an affected property owner is
the owner of property which, if the right -of --way is abandoned, will:
(1) Have access that is currently used by that property owner eliminated;
(2) Have the only platted access eliminated;
(3) Have the paved area adjacent to that property increased for turn -around purposes; or
(4) Be increased in size.
(c ) A road may be abandoned only at the terminal portion of the road and in its full width unless the
abandonment will comply with the County Code requirements for road, turn -around, and fire -rescue
access and one of the following circumstances exists:
(1) An adjacent lot owner has on the platted right of way or within a setback a substantial
structure which predates the Special Session Law 59-1578 pertaining to maps, plats and right
of way. The term "substantial structure" specifically does not include wood or metal fences,
sheds or tiki huts or other items not listed which are accessory structures.

purpose.

(d) The board of county commissioners considers these a restriction on the rights of individuals who
desire to abandon properties in accordance with F.S. § 336.09.
All of the following must be submitted in order to have a complete application submittal:

Complete road abandonment application (unaltered and unbound);
® Correct fee (check or money order to Monroe County Planning & Environmental Resources);
Legal description of the portion of the roadway to be abandoned in metes and bounds;
✓ Proof of ownership of the petitioner's property(s) (i.e. Warranty Deed);
Current Property Record Card(s) from the Monroe County Property Appraiser for the petitioner's
property;
✓ Location map (i.e. copy of strip map, aerial photograph);
aPhotograph(s) of the roadway to be abandoned;
® Signed and Sealed Survey of roadway to be abandoned and all adjoining properties, prepared by a
Florida registered surveyor — 12 sets (At a minimum, survey should include a legal description of the
roadway; elevations; location and dimensions of all existing structures, paved areas and utility structures;
roadways and easements; and all bodies of water on the site and adjacent to the site. The portion of the
roadway to be abandoned should be marked with diagonal lines and the petitioner's property should be
clearly delineated);
Letters of "No Objection" from all utility companies (Florida Keys Aqueduct Authority (FKAA);
Florida Keys Electric Cooperative (FKEC) or Keys Energy Services; telephone utility, gas utility, cable
utility, wastewater treatment authority, etc.);
aLetters of "No Objection" from all affected property owners (an affected property owner is a) one who
would have a means of access to his or her property closed off as a result of the abandonment even though
he or she may not actually use the right-of-way prior to abandonment or b) one whose property abuts the
portion of the roadway to be abandoned);
IF A CUL-DE-SAC OR "T-TYPE" TURNAROUND IS REQUIRED to be constructed, it will be the
responsibility of the Petitioner, if the road to be abandoned will result in an existing rock or paved road
being shortened. See Monroe County Code §9.5-296(p). Your petition should specifically state your
agreement to construct either the cul-de-sac or "T-type" turnaround per County Standard Specifications and
Details. (Should you need additional information regarding this matter, please contact the Monroe County
Engineering Department directly by phoning (305) 292-4427).
If applicable, the following must be submitted in order to have a complete application submittal:
Notarized Agent Authorization Letter (note: authorization is needed from all owner(s) of the subject
property)
If deemed necessary to complete a full review of the application, the Planning & Environmental Resources
Department reserves the right to request additional information.
Petitioners agree to be responsible for and pay for all costs of advertising and recording fees incurred relative to
this request for the abandonment. The filing of a petition does not entitle one to abandonment.
Petitioners fin-ther agree to grant any easement necessary for the furnishing of utilities, including without
limitation, electric power, water, sewer, telephone, gas, cable and other electric communication services to the

same extent as is common within this area as to height, width and degree, upon request for such service or by the
BOCC through its authorized agents. If easements are so required, copies of the executed documents will be
provided to the County before the petition is presented to the BOCC.
Petitioners certify that the road to be abandoned does not end at open water or that, if it does, the road is not a
dedicated and accepted right-of-way (including by operation of law due to construction or maintenance by the
County).
We hereby petition the Honorable Board of County Commissioners to renounce and disclaim any right of
the County and the public in and to the above -referenced street, alleyway, road or right-of-way as further
depicted and described in the attachments.

Sheriff Ramsay, I received the packet in regards to requesting a public right of
way abandonment. I made contact with the representing party Anthony D'Ascanio.
I confirmed with D'Ascanio while reviewing the site map on the exact location of
said property. I asked if there were any residents that this abandonment would
affect. I was advised it does not.
I surveyed the location to find by granting this abandonment would not hinder
emergency services (police or fire) from accessing the listed property or the two
adjacent properties. There is a fire hydrant approx. 60 yards away for fire
suppression.
There are no businesses or public access ie beaches, boat ramps etc on this
street. "There is no other purpose on this street for visitors or deliveries that would
conflict with public use. The owner of the property is keeping it neat and clean.
Sheriff Ramsay I do not foresee any conflicts with approving this request.

I've reviewed the above -referenced road abandonment petition, and while Engineering has no
objection to the abandonment I have the following comments:
1) With regard to north arrow shown on survey, shouldn't Point of Beginning be the
northeast corner of Lot 14?
2) Typically the boundary between abandonment parcels for the two adjacent properties
would be an extension of the side lot line between lots 14 and 13 as shown in red on the
attached survey rather than what is proposed.
3) The no objection letter from FKEC only referenced the abandonment of the portion of the
right of way adjacent to Lot 14.
