For purposes of this 28 subsection, an affected property owner is the owner of property which, if the right-of- 29 way is abandoned, will: 30 (1) Have access that is currently used by that property owner eliminated; 31 • The requested abandonment is for a platted, undeveloped right- 32 of -way not used as part of the existing roadway. The adjacent 33 properties will continue to be accessed by using Nautilus Street 34 and Corsair Road. 35 (2) Have the only platted access eliminated; 36 • As noted above, the properties will continue to be accessed by 37 using Nautilus Street and Corsair Road. 38 (3) Have the paved area adjacent to that property increased for turn -around 39 purposes; or 40 • There is not a requirement for a turnaround or proposed plans 41 for a turn -around given the location of the right of way 42 abandonment. 43 (4) Be increased in size. 44 • The affected property will be increased in size, however there is 45 no objection. 46 Amedeo and Lynn D'Ascanio Road Abandonment Petition File # 2015-094 Page 4 of 5 I (d) All right of way abandonments shall comply with the County Code and Standard 2 Engineering requirements for road, turn -around and fire -rescue access. If required 3 for safety purposes, as determined by either Fire Marshal or County Engineer, a 4 dedicated turn -around area shall be shown on the submitted survey and shall be 5 agreed to in writing and constructed with payment by the property owner(s) 6 requesting abandonment. 7 * There is not a requirement for a turnaround or proposed plans 8 for a turn -around given the location of the right of way 9 abandonment 10 a No objections were given from Engineering Services, letter 11 dated October 19, 2015 or from Monroe County Fire Marshal, 12 email dated October 5, 2015. 13 14 (e) A right of way may be abandoned only at the terminal portion of the road and in its 15 full width unless one of the following applies; 16 1. An adjacent lot owner has on the platted right-of-way or within a setback a 17 substantial structure which predates the Special Session Law 59-1578 18 pertaining to maps, plats and right-of-way. The term "substantial structure" 19 specifically does not include wood or metal fences, sheds or tiki huts or other 20 items not listed which are accessory structures; or 21 2. The abandonment is requested by a County department or governmental agency 22 for a public use; for purposes of this subsection public use is a public facility 23 and/or public/private utility; or 24 3. The right of way area is unusual in size or shape and after abandonment the 25 remaining right of way width will be the same on both sides of the 26 abandonment as shown in Example 1. 27 28 * The petitioner has requested an abandonment of a partial section 29 of right of way that forms an unusual shape at the corner of 30 Nautilus Street and Corsair Drive.
