The petitioners have made the request in order to legally and properly maintain the wooded parcel. The petition requests the entire 50' x 100' portion of a platted right-of-way for 2°d Street be vacated and divided equally to the adjacent property owners as the street itself was never constructed. Currently, 22 Monroe County owns the second affected property (RE No. 00303780-000000). The petitioners 23 have submitted a road abandonment petition in order to gain private control over the property to 24 maintain it properly. The applicant has noted the parcel is not maintained adequately and 25 contains overgrown vegetation that is used as a dumping site for unwanted items. County records 26 indicate this area is exotics. Staff confirmed almost 100% of the right of way is vegetated with 27 Talipariti tiliaceum var. pernambucense, otherwise known as sea hibiscus. The area is right of 28 way and does not have a Tier designation. The adjacent parcels are designated at Tier 1. The 29 portion of a platted right-of-way for 2nd Street was never constructed at any point in the 30 subdivision. For purposes of this 29 subsection, an affected property owner is the owner of property which, if the right-of- 30 way is abandoned, will: 31 (1) Have access that is currently used by that property owner eliminated; 32 • The requested abandonment is for a platted, undeveloped right- 33 of -way that is not being used for access by the property owners. 34 The adjacent properties will continue to be accessed by using 35 Avenue D. 36 (2) Have the only platted access eliminated; 37 • As noted above, the properties will continue to be accessed by 38 Avenue D. 39 (3) Have the paved area adjacent to that property increased for turn -around 40 purposes; or 41 • There is not a requirement for a turnaround or proposed plans 42 for a turn -around given the location of the right of way 43 abandonment. 44 (4) Be increased in size. 45 • The affected property will be increased in size, but there is no 46 objection. Kelley Road Abandonment Petition File # 2014-118 Page 4 of 5 2 (c) A road may be abandoned only at the terminal portion of the road and in its full width 3 unless the abandonment will comply with the County Code requirements for road, 4 turn -around, and fire -rescue access and one of the following circumstances exists: 5 (1) An adjacent lot owner has on the platted right of way or within a setback a 6 substantial structure which predates the Special Session Law 59-1578 7 pertaining to maps, plats and right of way.
