AGENDA ITEM WORDING: Approval of a contract for purchase of a lot described as the West
70 feet of Lot 14, Conch Key Subdivision (PB 2 -130) with parcel number 00385780- 000400 for
affordable housing.
ITEM BACKGROUND: This acquisition is proposed as an affordable housing site. At the request
of County staff, the Monroe County Land Authority (MCLA) negotiated the proposed agreement on
the Board's behalf pursuant to an interlocal agreement between MCLA and the County.
The subject property consists of a 4,900 square foot lot on South Conch Avenue on Conch Key. The
property is designated Tier 3 — Infill Area, is zoned Commercial Fishing Special District 16, has a
habitat designation of Developed Land, and has a flood zone designation of AE 10. The Southeast
Florida Regional Climate Change Compact 50 -year sea level rise projection is 9 to 24 inches by the
year 2060. In the event of a 12 -inch increase in sea level, estimates provided by the South Florida
Water Management District indicate approximately one -third of this property will have a 25.1% to
74.9% probability of being inundated.
Included with the contract is a 2006 letter issued by the Planning Department indicating there are
three ROGO exempt dwelling units associated with the property. The property owners have agreed
to sell the property for the price of $165,000.00. The estimated closing costs for this transaction will
be approximately $1,785.50. Including closings costs, this purchase would enable the County to
acquire the equivalent of 3 market rate ROGO allocations at a price of just under $55,600.00 per
allocation plus a potential site for affordable housing. Some or all of those market rate allocations
could all be used at that location or transferred for use elsewhere in the future, should County
regulations permit such transfers at the time of transfer. Note, there is a current moratorium
prohibiting the transfer of allocations which is scheduled to sunset later this year.
Potential options for developing the property include issuing a Request for Proposals and selecting a
developer or transferring title to the Monroe County Housing Authority for development by that
agency.
PREVIOUS RELEVANT BOCC ACTION: The Board budgeted funds for land acquisition,
including the purchase of affordable housing sites.

AGREEMENT FOR THE PURCHASE OF LANDS

hereinafter style the Seller(s), for themselves, their heirs, executors, administrators, successors and
assigns, and MONROE COUNTY, FLORIDA (hereinafter, "COUNTY").

The West 70 feet of Lot 14, Conch Key Subdivision (PB 2-130), more particularly
described in Exhibit A. The rights being conveyed in this transaction include the rights
to three residential dwelling units exempt from the Rate of Growth Ordinanc,
referenced in the August 7, 2006 letter shown as Exhibit B.

2. The Seller(s) agree that they have full right, power and authority to convey, and that they wi[
convey to the COUNTY the fee simple title together with legal and practical access thereto clear,
free and unencumbered, except subject to the following easements or reservations:
Existing easements for canals, ditches, flumes, pipelines, railroads, public highways and roads,
telephone, telegraph, power transmission lines and public utilities.
The COUNTY, at the COUNTY'S exXem%,a-AaVA
to examine same, may have the real property surveyed and certified by a registered Florida
surveyor. If the survey discloses encroachments on the real property or that improvements
located thereon encroach on setback lines, easements, lands of others, or violate any restrictions,
contract covenants, or applicable governmental regulations, the same shall constitute a title
defect.
7. It is mutually agreed that an abstract, title insurance policy or other evidence of title to the property

the COUNTY at its expense. The Seller(s) expressly agree herein to furnish to the COUNTY any
documents in Seller(s)'s possession establishing evidence of title including, but not limited to,
abstracts, title commitments, title policies and opinions of title.
8. It shall be the obligation of y>2+ + « y to pay all taxes and assessments outstanding as liens at
the date title vests of record in the COUNTY, whether or not such taxes and assessments are then
due and payable.
9 It is mutually understood and agreed that notice of acceptance of this Agreement shall be given to
the Seller(s) by mail addressed to the Seller(s) at the following address:

and shall be effective upon date of mailing and shall be binding upon all of the Seller(s) without
sending a separate notice to each, except as such obligation may be affected by the provisions of
paragraph 6 hereof.
