AGENDA ITEM WORDING: Approval of a resolution of the Monroe County Board of County
Commissioners adopting Monroe County "Elevation Certificate Review Policy" dated October 1, 2015
as required pursuant to Monroe County Code Section 122-2(c).
ITEM BACKGROUND: Chapter 122 of the Monroe County Code "Floodplain Management"
includes rules for interpreting flood hazard issues. The building official shall be guided by the current
edition of FEMA's 44 CFR, and FEMA's interpretive letters, policy statements and technical bulletins
as adopted from time to time by the board of county commissioners. FEMA's Technical Bulletins
("bulletins") provide guidance concerning the building performance standards of the National Flood
Insurance Program (NFIP), which are contained in Title 44 of the U.S. Code of Federal Regulations.
The bulletins are intended for use primarily by State and local officials responsible for interpreting and
enforcing NFIP regulations and by members of the development community, such as design
professionals and builders. New bulletins, as well as updates to existing bulletins, are issued
periodically as needed. The bulletins do not create regulations; rather they provide specific guidance
for complying with the minimum requirements of existing NFIP regulations. Adopting these
documents as well as internal County policies would serve to allow the County to not only remain in
the NFIP as stated in Section 122-1(b), but also to move forward with the intent of becoming eligible
to enter FEMA's Community Rating System (CRS). The proposed resolution would adopt Monroe
County "Elevation Certificate Review Policy" dated October 1, 2015 as required pursuant to Monroe
County Code Section 122-2(c).
PREVIOUS RELEVANT BOCC ACTION:
January 18, 1994 — BOCC approved Ordinance No. 002-1994 adding the language "as adopted by
resolution from time to time by the Board of County Commissioners" to the rules for interpreting flood
hazard issues.
July 15, 2015 -- BOCC rejected proposed ordinance amending Section 122-2(c) and directed staff to
continue proposing resolutions for adoption of both new and amended documents to be used by the
building official for guidance on floodplain management.

COUNTY COMMISSIONERS ADOPTING MONROE COUNTY
"ELEVATION CERTIFICATE REVIEW POLICY" DATED
OCTOBER 11, 2015 AS REQUIRED PURSUANT TO MONROE
COUNTY CODE SECTION 122-2(C)
WHEREAS, Monroe County is currently a participating community in the National
Flood Insurance Program (NFIP) and is working on internal County policies to improve upon its
interpretation of NFIP regulations; and
WHEREAS, Monroe County desires to become eligible to enter FEMA's Community
Rating System (CRS); and
WHEREAS, Monroe County Code Section 122-2(c), in part, requires that in interpreting
other provisions of this chapter, the building official shall be guided by the current edition of
FEMA's 44 CFR, and FEMA's interpretive letters, policy statements and technical bulletins as
adopted by resolution from time to time by the board of county commissioners;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1. Pursuant to Monroe County Code Section 122-2(c), the Board hereby adopts
Monroe County "Elevation Certificate Review Policy" dated October 1, 2015, a copy of which is
attached hereto.
Section 2. The Clerk of the Board is hereby directed to forward one (1) certified copy of
this Resolution to the Building Department.

"Within 21 calendar days of establishment of the lowest floor elevation, or upon placement of the
lowest horizontal structural members of the lowest floor, whichever is applicable, it shall be the
duty of the permit holder to submit to the building official a certification of the elevation of the
lowest floor within A zones or the lowest portion of the lowest horizontal structural members of
the lowest floor within V zones, whichever is applicable, as built in relation to mean sea level.
Such certification shall be prepared by or under the direct supervision of a registered land
surveyor or professional engineer and certified by the same. When floodproofing is used for a
building within A zones, the certification shall be prepared by or under the direct supervision of a
professional engineer or architect and certified by same. Any work done within the 21-day period
and prior to submission of the certification shall be at the permit holder's risk. The building
official shall review the floor elevation survey data submitted. Deficiencies detected by such
review shall be corrected by the permit holder immediately and prior to further progressive work
being permitted to proceed. Failure to submit the survey or failure to make the corrections
required hereby shall be causes to issue a stop -work order for the project."
In addition to the required elevation certificate above, a Finished Construction elevation
certificate must be submitted and approved by the Building Department prior to the issuance of a
Certificate of Occupancy or closing a permit.

Elevation Certificates must be fully completed and signed by a licensed land surveyor. In the
instances where an Architect or Engineer prepares the certificate, the survey from which the
elevations were derived must be submitted as an attachment to the Elevation Certificate.

1612.5 Flood hazard documentation. The following documentation shall be prepared and
sealed by a registered design professional and submitted to the building official:
l . For construction in flood hazard areas other than coastal high hazard areas:
1.2. The elevation of the lowest floor, including basement, as required by the foundation
inspection and the final inspection in Section 110.3.
1.2. For fully enclosed areas below the design flood elevation where provisions to allow or the
automatic entry and exit of floodwaters do not meet the minimum requirements in
Section 2.6.2.1 of ASCE 24, construction documents shall include a statement that the
design will provide for equalization of hydrostatic flood forces in accordance with
Section 2.6.2.2 of ASCE 24,
1.3. For dry floodproofed nonresidential buildings, construction documents shall include a
statement that the dry floodproofing is designed in accordance with ASCE 24.
2. For construction in coastal high hazard areas:
2.1. The elevation of the bottom of the lowest horizontal structural member as required by the
foundation inspection and the final inspection in Section 110.3.
2.2. Construction documents shall include a statement that the building is designed in
accordance with ASCE 24, including that the pile or column foundation and building or
structure to be attached thereto is designed to be anchored to resist flotation, collapse and
lateral movement due to the effects of wind and flood loads acting simultaneously on all
building components, and other load requirements of Chapter 16.
2.3. For breakaway walls designed to have a resistance of more than 20 psf (0.96 kN/m—)
determined using allowable stress design, construction documents shall include a
statement that the breakaway wall is designed in accordance with ASCE 24.

Guidelines to assist in completing an Elevation Certificate.
The following outline suppliments the NFIP's 'Instructions for Completing the Elevation
Certificate' and includes additional Monroe County Building Department's elevation certificate
submital requirements.
Additional documentation may be required as determined by the Building Official.
SECTION A —PROPERTY INFORMATION
A2 & A3 Complete street address and property description. Please include the Real Estate (RE)
number in the property description.
A5 Use the point at the center of the front of the building as the coordinate location.
When using decimal degrees the Lat. is a positive number and the Long. is negative.
When using Degrees, Minutes, Seconds Lat. includes an `N' and Long. includes a
`W'.
A6 Provide color photographs that show each side of the structure clearly enough that one
can infer the diagram number of the structure. If the structure has flood vents, include
a close up photograph of a typical vent. All photographs must be labeled and include
the date taken. Photographs must be provided for both `Building Under Construction'
and `Finished Construction' certificates.
A7 Building diagram 1B should be used for raised slab or backfilled stemwall
construction.
A8.a,b,c Enclosure and crawl space information for buildings that are building diagram
number 6, 7, 8, or 9. If there is no crawlspace or enclosure, enter "NIA".
A9.a,b,c Attached garage information. If there is no attached garage, enter "NIA" in all three
spaces. If there is an attached garage and there are no openings, the correct entry is
"zero," even if the garage is above the BFE.
A8 &A9.a Enter the actual area of the opening of the flood vents, even if engineered vents are
used.
A8 &A9.d If the square footage of the crawlspace, enclosure or garage is larger than the square
inches of net area of the openings AND "(d) Engineered flood openings" is checked
``yes," you must attach a certification by a registered design professional or a copy of
the ICC Evaluation Service report for the make and model engineered flood vent
installed. Remember to check the attachments box in Section D and in the Comments
section please include the make, model number and the square feet of venting that the
engineered vents are certified to provide.
SECTION B—FLOOD INSURANCE RATE MAP (FIRM) INFORMATION
B 1 Community number: 125129
B2 Monroe County, unincorporated area.
B4 Map AND panel number.
B5 Panel number suffix is currently'K.'
B6 & B7 FIRM index and panel effective/revised date is currently 2-18-2005.
B8 If the building is located in both flood zones, AE and VE, list both zones.
B9 If the building crosses multiple base flood elevations, list them all. Use whole
numbers (no decimals) if source of the elevation data was the FIRM.

B 11 The elevation datum used for the base flood elevation in B9 is currently NGVD29.
B 12 Whether or not the building is located in a Coastal Barrier Resources System area or
Otherwise Protected Area, as well as the designation date is found on the FIRM.
SECTION C—BUILDING ELEVATION INFORMATION (when a survey is required)
C 1 Basis for building elevations: "Finished Construction" elevation can only be checked
is the building is completely finished, all machinery and equipment is installed and
final grading is complete.
C2 Elevations: The benchmark utilized and vertical datum entries must be completed.
Provide the PID or other information to accurately identify the official benchmark
used.
C2.a)-h): None of these should be blank. Either provide elevations, rounded to the
nearest tenth or enter "NIA" in the fields that do not apply. Every certificate will have
an elevation in a), f), and g). For items f) and g) enter the elevation of the ground,
patio slab or sidewalk immediately next to the building. If there is an attached garage
(A9), an elevation must be entered for item C2.d), otherwise the entry is "NIA."
If there is an elevator on the property the bottom of the pit is most often C2.a).
SECTION D—CERTIFICATION BY A REGISTERED DESIGN PROFESSIONAL
Note: Section D starts at the bottom of page and ends at the top of page 2 of the Elevation
Certificate.

"Comments": If C2.e) is completed then the machinery/equipment type and its
general location on or in the structure must be indicated.
If the latitude and longitude in Section A on page 1 was provided by a licensed land
surveyor indicate the method used to obtain the latitude and longitude.
Include elevation of the bottom of the electric meter box/disconnect.
Conclusion
Monroe County, following the National Flood Insurance Program requirements, has the
responsibility to determine if the Finished Construction Elevation Certificate is completed
according to the National Flood Insurance Program Elevation Certificate Instructions on a
form prescribed by FEMA and the Monroe County Land Development Code Section 122-
3(c). This policy will become effective October 1, 2015.
