AGENDA ITEM WORDING: Approval of a resolution of the Monroe County Board of County
Commissioners adopting Monroe County "Floodproofing Non -Residential Structures Permitting and
Inspection Requirements Policy" dated October 1, 2015 as required pursuant to Monroe County Code
Section 122-2(c).
ITEM BACKGROUND: Chapter 122 of the Monroe County Code "Floodplain Management"
includes rules for interpreting flood hazard issues. The building official shall be guided by the current
edition of FEMA's 44 CFR, and FEMA's interpretive letters, policy statements and technical bulletins
as adopted from time to time by the board of county commissioners. FEMA's Technical Bulletins
("bulletins") provide guidance concerning the building performance standards of the National Flood
Insurance Program (NFIP), which are contained in Title 44 of the U.S. Code of Federal Regulations.
The bulletins are intended for use primarily by State and local officials responsible for interpreting and
enforcing NFIP regulations and by members of the development community, such as design
professionals and builders. New bulletins, as well as updates to existing bulletins, are issued
periodically as needed. The bulletins do not create regulations; rather they provide specific guidance
for complying with the minimum requirements of existing NFIP regulations. Adopting these
documents as well as internal County policies would serve to allow the County to not only remain in
the NFIP as stated in Section 122-1(b), but also to move forward with the intent of becoming eligible
to enter FEMA's Community Rating System (CRS). The proposed resolution would adopt Monroe
County "Floodproofing Non -Residential Structures Permitting and Inspection Requirements Policy"
dated October 1, 2015 as required pursuant to Monroe County Code Section 122-2(c).
PREVIOUS RELEVANT BOCC ACTION:
January 18, 1994 — BOCC approved Ordinance No. 002-1994 adding the language "as adopted by
resolution from time to time by the Board of County Commissioners" to the rules for interpreting flood
hazard issues.
July 15, 2015 BOCC rejected proposed ordinance amending Section 122-2(c) and directed staff to
continue proposing resolutions for adoption of both new and amended documents to be used by the
building official for guidance on floodplain management.

COUNTY COMMISSIONERS ADOPTING MONROE COUNTY
"FLOODPROOFING NON-RESIDENTIAL STRUCTURES:
PERMITTING AND INSPECTION REQUIREMENTS POLICY"

WHEREAS, Monroe County is currently a participating community in the National
Flood Insurance Program (NFIP) and is working on internal County policies to improve upon its
interpretation of NFIP regulations; and
WHEREAS, Monroe County desires to become eligible to enter FEMA's Community
Rating System (CRS); and
WHEREAS, Monroe County Code Section 122-2(c), in part, requires that in interpreting
other provisions of this chapter, the building official shall be guided by the current edition of
FEMA's 44 CFR, and FEMA's interpretive letters, policy statements and technical bulletins as
adopted by resolution from time to time by the board of county commissioners;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1. Pursuant to Monroe County Code Section 122-2(c), the Board hereby adopts
Monroe County "Floodproofing Non -Residential Structures: Permitting and Inspection
Requirements Policy" dated October 1, 2015, A copy of which is attached hereto.
Section 2. The Clerk of the Board is hereby directed to forward one (1) certified copy of
this Resolution to the Building Department.

Monroe County Land Development Code, Chapter 122 — Floodplain Management
Section 122-2 (c)
In interpreting other provisions of this chapter, the building official shall be guided by the current
edition of FEMA's 44 CFR, and FEMA's interpretive letters, policy statements and technical bulletins
as adopted by resolution from time to time by the board of county commissioners.
Section 122-3(e)
Within 21 calendar days of establishment of the lowest floor elevation, or upon placement of the lowest
horizontal structural members of the lowest floor, whichever is applicable, it shall be the duty of the
permit holder to submit to the building official a certification of the elevation of the lowest floor within
A zones or the lowest portion of the lowest horizontal structural members of the lowest floor within V
zones, whichever is applicable, as built in relation to mean sea level. Such certification shall be
prepared by or under the direct supervision of a registered land surveyor or professional engineer and
certified by the same. When floodproofing is used for a building within A zones, the certification shall
be prepared by or under the direct supervision of a professional engineer or architect and certified by
same. Any work done within the 21-day period and prior to submission of the certification shall be at
the permit holder's risk. The building official shall review the floor elevation survey data submitted.
Deficiencies detected by such review shall be corrected by the permit holder immediately and prior to

further progressive work being permitted to proceed. Failure to submit the survey or failure to make the
corrections required hereby shall be causes to issue a stop -work order for the project.
Section 1224(b)(2)(a)
New construction and substantial improvements of any commercial, industrial or other nonresidential
structures within zone AE on the community's flood insurance rate map (FIRM) shall have the lowest
floor (including basement) elevated to or above the base flood level or, together with attendant utility
and sanitary facilities, be designed so that below the base flood level the structure is watertight with
walls substantially impermeable to the passage of water and with structural components having the
capability of resisting hydrostatic and hydrodynamic loads and effects of buoyancy. Elevating above
base flood elevation may decrease the cost of flood insurance. Where a nonresidential structure is
intended to be made watertight below the base flood level, a registered professional engineer or
architect shall develop and/or review structural design specifications and plans for the construction and
shall certify that the design and methods of construction are in accordance with accepted standards of
practice for meeting the applicable provisions contained herein. A record of such floodproofing
certification which shall include the specific elevation (in relation to mean sea level) to which such
structures are floodproofed shall be provided to the building department. Wet floodproofing is not
acceptable. New construction or cumulative substantial improvements of any commercial, industrial or
other nonresidential structures within zones V1-30, VE or V shall have the bottom of the Iowest
horizontal structural member of the lowest floor, elevated to or above the base flood elevation.
2014 Florida Building Code
1612.5 Flood hazard documentation. The following documentation shall be prepared and sealed by a
registered design professional and shall be submitted to the building official:
1. For construction in flood hazard areas not subject to high -velocity wave action:
1.1 The elevation of the lowest floor, including basement, as required by the
foundation inspection and the final inspection in Section 11.0.3.
1.2. For fully enclosed areas below the design flood elevation where provisions to allow
for the automatic entry and exit of floodwaters do not meet the minimum requirements
in Section 2.6.2.1, ASCE 24, construction documents shall include a statement that the
design will provide for equalization of hydrostatic flood forces in accordance with
Section 2.6.2.2 of ASCE 24.
1.3. For dry floodproofed nonresidential buildings, construction documents shall
include a statement that the dry floodproofing is designed in accordance with
ASCE 24.

Dry floodproofing of residential buildings and residential and residential portions of mixed -use buildings shall
not be permitted.
6.1 Scope
This section addresses design and construction requirements for floodproofing new construction and
substantial improvements in flood hazard areas.
Design of floodproofing measures shall take into consideration and account for the flood loads and
combination of loads in Section 1.6, and for nature of flood -related hazards; frequency, depth, and
duration of flooding; rate of floodwater rise and fall; floodwater temperature; soil characteristics;
flood -borne contaminants and debris: flood warning time; access to and from floodproofed areas;
structure occupancy and use; and functional dependence.
6.2.1 Dry Floodproofing Limitations;
Dry floodproofing of nonresidential structures and nonresidential areas of mixed -use structures shall
not be allowed unless such structures are located outside of High Risk Flood Hazard Areas, Coastal
High Hazard Areas, and Coastal A Zones. Dry floodproofing of residential structures or residential
areas of mixed -use structures shall not be permitted.
Dry floodproofing shall be limited to the following:
1. Where flood velocities adjacent to the structure are less than or equal to 5 ft/sec during the
design flood; and
2. If human intervention is proposed, where conformance with the limitations of Section 6.2.3
is provided.
6.2.2 Dry Floodproofing Requirements:
Dry floodproofed areas of structures shall
1. Be designed and constructed so that any area below the applicable elevation specified in
Table 6-1, together with attendant utilities and sanitary facilities, is flood resistant with
walls that are substantially impermeable to the passage of water. Walls, floors, and flood
shields shall be designed and constructed to resist hydrostatic, hydrodynamic, and other
flood -related loads, including the effects of buoyancy resulting from flooding to the
elevation listed in Table 6-1;
2. Have any soil or fill adjacent to the structure compacted and protected against erosion and
scour in accordance with Section 2.4; and
3. Have at least one door satisfying building code requirements for an exit door or primary
means of escape, above the applicable elevation specified in Table 6-1, and capable of
providing human ingress and egress during the design flood.

6.2.3 Limits on Human fntervention:
Dry floodproofing measures that require human intervention to activate or implement prior to or during
a flood shall be permitted only when all of the following conditions are satisfied:
1. The flood warning time (alerting potential flood victims of pending flood situation) shall be a
minimum of 12 hours, unless the community operates a flood warning system and implements
an emergency plan to ensure safe evacuation of flood hazard areas, in which case human
intervention is allowed only if the community can provide a minimum flood warning time equal
to or longer than the cumulative
a. time to notify person(s) responsible for installation of floodproofng measures, plus
b. time for responsible persons to travel to structure to be floodproofed, plus
c. time to install, activate, or implement tloodproofing measures, plus
d. time to evacuate all occupants from the flood hazard area;
2. All removable shields or covers for openings such as windows, doors, and other openings in
walls shall be designed to resist flood loads specified in Section 1.6; and
3. Where removable shields are to be used, a flood emergency plan shall be approved by the
authority having jurisdiction and shall specify, at a minimum, the following information:
storage location(s) of the shields; the method of installation; conditions activating installation;
maintenance of shields and attachment devices; periodic practice of installing shields; testing
sump pumps and other drainage measures; and inspecting necessary material and equipment to
activate or implement tloodproofing. The flood emergency plan shall be permanently posted in
at least two conspicuous locations within the structure.

Provide that where a non-residential structure is intended to be made watertight below the base flood
level, (i) a registered professional engineer or architect shall develop and/or review structural design,
specifications, and plans for the construction, and shall certify that the design and methods of
construction are in accordance with accepted standards of practice for meeting the applicable
provisions of paragraph (c)(3)(11) or (c)(8)(ii) of this section, and (ii) a record of such certificates which
includes the specific elevation (in relation to mean sea level) to which such structures are floodproofed
shall be maintained with the official designated by the community under §59.22(a)(9)

Conclusion
Monroe County, following National Flood Insurance Program requirements, has the responsibility to
determine if documents submitted as part of a plan to floodproof a non-residential structure meet the
standards pursuant to Monroe County Land Development Code, Chapter 122 - Floodplain
Management, the Florida Building Code, and FEMA 44 CFR, and together with guidance provide in
FEMA TB 3-93 and FEMA P-936, will implement the following checklist on October 1, 2015 to do so.
