( "Consultant "), in order to amend the Agreement, as First Amended on May 20, 2015, as Second Amended on October 21, 2015, and as Third Amended on May 17, 2017, and as Fourth Amended on January 17, 2018, as follows: WITNESSETH WHEREAS, on February 18, 2015, the parties entered into an Agreement for professional services to design and permit the Plantation Key Judicial Courthouse and Detention Facility ( "Project "); and WHEREAS, on May 20, 2015, the parties agreed to a First Amendment to the Agreement increasing Consultant's scope of work to undergo a site plan review and approval process, which is a requirement for the Village of Islamorada; and WHEREAS, on October 21, 2015, the parties agreed to a Second Amendment to the Agreement to provide a schedule of values for compensation that includes the Schematic Design, Design Development, Construction Documents, Bidding and Permitting, and Construction Administration phases; and I . WHEREAS, on May 17, 2017, the parties agreed to a Third Amendment to the Agreement to provide sub - consultant services for Civil Engineering, Landscape and Irrigation design, Voice /Data/AV and Security, Acoustics, Sustainable Design and Cost Estimating and include public records language revisions in compliance with section 119.071 Florida Statues; and WHEREAS, on January 17, 2018, the parties agreed to a Fourth Amendment to the Agreement to provide sub - consultant services for the Interior Design and Building Commissioning and Training Services as identified in Attachment C of the Agreement dated February 18, 2015, and with the Florida Department of Management Services Design Professional Guidelines; and WHEREAS, the Director, Division of Historical Resources and State Historic Preservation Officer has notified the County that the initial assessment of the existing Spottswood building "Old Monroe County Sheriff Office" located at the site of the proposed Plantation Key Judicial Courthouse and Detention Facility is eligible for listing in the National Register of Historic Places; and Fifth Amendment to Agreement between CSA and Monroe County for P.K. Judicial Courthouse WHEREAS, the Consultant requires the assistance of an Architectural Historian to provide further analysis of the historic significance of the existing Spottswood building located at the site of the proposed Plantation Key Judicial Courthouse and Detention Facility; and NOW THEREFORE IN CONSIDERATION of the mutual promises obtained herein, the parties hereby agree that the original Agreement shall be amended as follows: 1. In accordance with Article III, Exhibit C, of the Agreement, Consultant shall engage the services of sub - consultants to provide architectural historian services for the existing Spottswood building as follows: A. Investigation L Research the State archives to determine if someone has added or attempted to add this project to the State's master site file for historic structures. ii. Travel to the site and perform an assessment of the structure to determine the historic nature of the building and document the surrounding area. The report of the building would follow the 2010 Guide to Historic Structures Form, Version 4.0, format, as required by the Bureau of Historic Resources. iii. Assemble documents of our findings inclusive of written and photographic documentation to be assembled as appendices for the written report. B. Reporting i. Consolidate findings in a report documenting what was discovered in the research and an opinion of the building's historic significance, if any C. Deliverables i. Deliverables include printing and reproduction of reports which will be assembled and bound either, as a spiral bound document or 3 -ring binder. Three (3) printed copies and one (1) CD containing the completed report in a PDF format will be provided. 2. Pursuant to section 7.3 of the Agreement, the County shall pay the Consultant monthly in current funds for a percent complete of the sub - consultant's performance of the additional services stated herein, a lump sum of Nine Thousand Six Hundred Fifty -Eight Dollars and 00 /100 ($9,658.00). The remaining terms of the Agreement and as Amended, not inconsistent herewith, shall remain in full force and effect. Page 2 of 3 Fifth Amendment to Agreement between CSA and Monroe County for P.K.
