AGENDA ITEM WORDING: Approval of Resolution adopting the tentative Duck Key Security
District non ad valorem special assessment rates for Fiscal Year 2018 -2019.
ITEM BACKGROUND: The Duck Key Security District Advisory Board voted on May 1st to
increase the special assessments for unimproved and improved lots by 10 %. Ordinance 005 -1992
establishing the Duck Key Security District allows a ten percent (10 %) increase over the previous
year. The initial special assessment was set at $200.00 per improved lot and $20.00 per unimproved
lot and was increased by 10% for the first time for FY 17, raising the assessment to $220.00 per
improved lot and $22 per unimproved lot. The rates were again increased by 10% (it is slightly less
for round number purposes) for FY 18, raising the assessment to $242 per improved lot and $24 per
unimproved lot. The Resolution for FY 19 adopts a tentative rate of $266 per improved lot and $26
per unimproved lot.
PREVIOUS RELEVANT BOCC ACTION: The BOCC established the Duck Key Security
District in 1992 and adopted Ordinance No. 005 -1992.
The BOCC enacted Ordinance No. 012 -1994 June 16', 1994.
The BOCC enacted Ordinance No. 001 -2009 January 28, 2009.
The BOCC enacted Ordinance No. 016 -2014 September 17, 2014.
The Board approved Resolution No. 119 -2016 adopting the tentative rate of $220 per improved lot
and $22 per unimproved lot for FY 2016 -2017 on May 24 2016 and Resolution No. 168 -2016
adopting the final rate at a Public Hearing held at its September 12 2016 meeting.
The Board approved Resolution No. 122-2017 adopting the tentative rate of $242 per improved lot
and $24 per unimproved lot for FY 2017 -2018 on May 10 2017 and Resolution No. 228 -2017
adopting the final rate at a Public Hearing held at its September 27, 2017 meeting.

SECURITY DISTRICT NON AD
VALOREM SPECIAL ASSESSMENT
RATES FOR FISCAL YEAR 2018 -2019
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA as follows:
The Board hereby adopts the following tentative non ad valorem special assessment rates for the
Duck Key Security District for fiscal year 2018/2019:
1. $266.00 per improved lot;
2. $26.00 per unimproved lot.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida,
at a meeting of said Board held on the 16 day of May 2018.

STANDING REPORTS
MCSO: Capt. Hiller reported that no incidents were reported on Duck Key. He said
he had not been able to work out how the payments of the off -duty patrols would be
made and that he would speak with Sylvia Hernandez about it. Capt. Hiller would
like to find a way where the officer does not have to wait 2 to 3 weeks for his check.
KEYS SECURITY: Simon Leird reported that his guards are now working either 8:00
PM to 4:00 AM or 9:00 PM to 5:00 AM. The change in schedule came about after a
neighbor complained of hearing noises in her backyard after 3:00 AM when the
guards left the area.
HAWKS CAY RESORT: Yunior Rodriguez, Manager of Hawks Cay, reported that
Hawks Cay will not replace the missing channel markers until they do their marina
reconstruction. They still do not have the permits from the Army Corps of
Engineering for the marina reconstruction. He announced the boat ramp was now
open and residents were welcome to use it. Sylvia Hernandez reminded him that
the Coast Guard gave them one year for repairs or they would cancel their permit
for their private aid to navigation (channel markers). Yunior Rodriguez said he had
different information.
DKPOA: Ron Oestreicher, treasurer of DKPOA, reported two buoys that had been
recently replaced in Tom's Harbor were missing. They had survived the hurricane,
but went missing around the time that the lobster traps were being picked up. He
also reported that the canal - dredging project was close to obtaining the final permit
from the County, but that they still did not have the funds necessary for the project.

OLD BUSINESS
Cameras Update: Sylvia Hernandez reported that the Truman Bridge cameras are
scheduled to be replaced on May 9th, and the training would be scheduled shortly
after everything was working correctly. The training session may have to be limited
to 10 participants.
Sylvia Hernandez discussed the schedule for off -duty police hoping that she and
Capt. Hiller were able to work out the payment arrangement.
MOTION: To spend up to $5,000 on off -duty patrols for holidays and mini - lobster
season. First by Phil Kircher; seconded by Van Waddill.
MOTION CARRIED (unanimous).
Radar Signs Update: Phil Kircher reported that he had spoken to Judith Clark from
the County's Engineering Department. The 4 radar signs had been ordered around
April 19th and were expected any day. He will coordinate with the County to find
the best position for the radars. He suggested two on Bimini Drive, one on West
Seaview and one on East Seaview.
Update on Disaster Recovery Committee - Phil Kircher presented a proposal made
by the sub - committee on Emergency Recovery for a shelter /storage area. Sylvia
Hernandez and Van Waddill objected to the purchase of the Tornado Shelter for
emergency supplies on the basis that we were part of the County and the County
had an Emergency Plan.
Rick Sherman said he had asked Key Colony Beach to share their Disaster Recovery
Plan with him and he would share his findings with the Board. Laurie Oestreicher
said she was very interested to explore what else the Security Board can do to
prepare our community for an emergency. Mona Barnes, resident of Duck Key,
shared some insights on the successful clean -up process at Key Colony.
MOTION: To abandon the proposal to purchase a Tornado Shelter to house
emergency equipment and supplies. First by Phil Kircher and seconded by Sylvia
Hernandez.
MOTION CARRIED (unanimous).
Sylvia Hernandez explained that even though in 2016 we had agreed to raise the
assessment by 10% per year until we got to the $300.00 per household/ $30 per lot
allowed by the Ordinance, we had to vote on it every year.
MOTION: To increase the tax assessment for the Duck Key Security Tax District by
10 %. First by Rick Sherman; seconded by Sylvia Hernandez.
MOTION CARRIED (unanimous).
NEW BUSINESS
MOTION: To ask BOCC to reappoint Richard Sherman for a 3 year term of the Duck
Key Security Advisory Board. First by Laurie Oestreicher; seconded by Phil Kircher

Stormy Hayes, resident of Duck Key, complained of speeding boats throwing large
wakes and playing loud music
Sylvia Hernandez reported on the meeting with the County on March 27th regarding
the Ordinance making all Duck Key canals a "Slow Speed / Minimum Wake" zone.
She reported that Mayor Rice suggested that the signage be paid for the Security
Board in order to increase our chances of BOCC approval. Phil Kircher and Rick
Sherman found the $4,000 estimate per sign too expensive. Rick Sherman
suggested that we ask the County to consider alternative areas for the signs, such as
bridges or the break water, to avoid the charges and additional permitting of poles
in the water whenever possible.
Motion: To offer to pay half of the cost of "Slow Speed" signage, not to exceed
$8,000. First by Rick Sherman; seconded by Van Waddill.
MOTION CARRIED (unanimous).
Sylvia Hernandez reported on the April 4th meeting with the County to discuss the
issues of lots with dead wood and brush that pose a fire threat. Cynthia McPherson
from Code Compliance said her office was busy dealing with unsafe structures, so
The County asked DKPOA to send a letter to the lot owners. After the meeting,
DKPOA asked DKSAB to co- author the letter. The Fire Department provided a letter
to accompany our letter. Forty -six lots were identified as potential fire hazards.
Phil Kircher asked if the County had cleaned up the lots they owned, and Sylvia
Hernandez replied that it was her understanding that they were in the process of
doing it.
MOTION: To co- author the letter with DKPOA asking owners of the 46 lots
identified as fire hazards to clean up their lots. First by Rick Sherman; seconded by
Laurie Oestreicher.
