ITEM BACKGROUND: Habitat for Humanity of Key West and Lower Florida Keys (Habitat) is requesting a reservation of sixteen (16) affordable housing allocations pursuant to Monroe County Code Section 138- 24(b)(2). Habitat is proposing to develop the site on Cudjoe Key (located on US 1 and La Fitte Drive at approximate mile marker 22.5) with sixteen (16) affordable employee housing units. Planning Commission Resolution No. P45 -09 approved a minor conditional use permit for sixteen (16) deed restricted employee housing units on September 2, 2009. The Senior Director of Planning and Environmental Resources approved the first extension request to the minor conditional use on October 18, 2013. The extension required permits to be issued by June 31, 2015. On April 20, 2016, the project received the three year extension pursuant to Florida House Bill 7019 which required permits to be issued by June 31, 2018. On April 6, 2016, Habitat for Humanity submitted a request for time extensions based on Executive Orders 417 -235, 17 -287, & 17 -330 Time Extension and F.S. 252.363. On April 11, 2018, Executive Orders 417 -235, 17 -287, & 17 -330 Time Extensions and F.S. 252 were granted. The new expiration date for permits to be issued by is June 25, 2019. The Planning Commission resolution states all required certificates of occupancy shall be procured within two (2) years, six (6) months of the date of the issuance of the initial building permit, or the conditional use approval shall become null and void with no further action required by the county. Habitat has also requested an extension to its 99 -year Occupancy and Ground Lease Agreement with Monroe County, which currently requires construction to commence by May 17, 2018. The lease extension is also scheduled for BOCC consideration at the May 16, 2018 regular meeting. PREVIOUS RELEVANT BOCC ACTION: May 16, 2007 — BOCC adopted Resolution 184 -2007, reserving sixty -nine (69) affordable ROGO allocations for four unspecified County projects. February 20, 2008 — BOCC adopted Resolution 047 -2008, reserving ten (10) more affordable ROGO allocations for four unspecified County projects for one year. March 18, 2009 — BOCC adopted Resolution 083 -2009, extending the reservation of ten (10) affordable ROGO allocations made in Resolution 047 -2008 until August 20, 2010. July 15, 2009 - BOCC adopted Resolution 209 -2009, clarifying that one of the unspecified County projects for which reservations were made was Lot 8, Block 8, Cutthroat Harbor Estates, Cudjoe Key; and continuing the reservation of 16 affordable housing allocations for the Habitat project for one (1) year. November 17, 2015 — BOCC approved 99 -year Occupancy and Ground Lease Agreement between Monroe County and Habitat for Humanity of Key West and Lower Keys, Inc. CONTRACT /AGREEMENT CHANGES: n/a STAFF RECOMMENDATION: Approval of a reservation of 16 affordable ROGO allocations until June 25, 2019.
