A public hearing to consider approval of resolution renouncing and disclaiming any right of the County and the
public in and to a portion of the right-of-way of North Drive that is adjacent to Lot 18, Block 2 and Lot 22,
Block 3, Stillwright Point Plat No. 2, Key Largo and to a previously vacated section of North Drive.
ITEM BACKGROUND:
Monroe County has requested abandonment of a portion of the right-of-way of No Drive, as
described above; in order to aggregate to the adjacent parcels. The portion of a platted right-of-way for
No Drive was never constructed including the northeastern segment northeast of the primary section
of North Drive. Portions of the eastern segment of North Drive were abandoned in 1971 and 2004 as
memorialized by Resolutions No. 17-1971 and 197-2004 respectfully.

January 16, 2013 — BOCC approved Resolution NO. 016-2013 setting the time and place for the Public Hearing.

WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires t
renounce and disclaim y right of the County and the public in and to the hereinafter streets,
alley -ways, roads or highways; and
WHEREAS, due notice has been published and a public hearing has been held i
accordance with Chapter 336, Florida Statutes; and
WHEREAS, at said public hearing the Board considered the argument of all parties
present wishing to speak can the matter, and considered the renouncing and disclaiming of any
right of the County and public in and to the hereinafter described streets, alley -ways, roads, or

It was mistakenly thought that the 1971 abandonment went to the centerline on the south side of
the road, but it did not encompass this strip.The subsequent road abandonment in 2004 went only
to the centerline on the north side and did not encompass the Strip which was not included in the
1971 abandonment. It should be noted that the portion of a platted right-of-way for North Drive
was never constructed including the northeastern segment northeast of the primary section of
No Drive.
This petition has been reviewed by County staff and written recommendations of no objection
were received from Monroe County Engineering Services, Fire Marshal, Code Compliance, and
the Monroe County Sheriffs Office.

6 Monroe County Code Compliance Department, and Comeast have provided letters or written
7 statements of no objection.

9 Monroe County Code Section 19-1 - Abandonment of rights -of -way states:

11 (a) No dedicated and accepted right-of-way in the county shall be abandoned where:
12 (1) the right-of-way terminates on a body of open water', or
13 The platted, undeveloped right-of-way does not terminate on a body of
14 open water.
15 (2) the right-of-way provides access tote public to land on open water'. or
16 The platted, undeveloped right -of -right does not provide access to the
17 public to land on open water.
18 (3) the abandonment would preclude a way for the public to maintain access tothe water.
19 The abandonment would not preclude a way for the public to maintain
20 access to water.

22 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an
23 agreement to do so by all affected property owners. For purposes of this subsection, an
24 affected property owner is the owner of property which, if the right-of-way is abandoned,
25 will:
26 (1) Have access that is currently used by that property owner eliminated;
27 The requested abandonment is for a platted, undeveloped right-of-way
28 that is not being used for access by the property owner. Aerial
29 photography shows the property has been accessed by an entrance
30 southeast of the proposed abandonment.
31 (2) Have the only platted access eliminated;

34 (4) Have the paved area adjacent tothat property increased for tum-around purposes; or
35 There are no paved areas adjacent to the adjoin properties and there
36 are no proposed plans for a turn -around.

47 structures.
