Lauderdale, Florida 33316, its successors and assigns, hereinafter referred to as "Consultant ", WITNESSETH: WHEREAS, on October 21, 2015, the parties entered into an Agreement for Professional Services for the Design through Construction Administration of a new Public Library in Marathon, Florida ( "Agreement "); and WHEREAS, a First Amendment to the Agreement was entered into the 19` day of December, 2016, to include additional services for a solar feasibility study as required by Resolution of the Climate Change Advisory Committee, and to revise Public Records compliance language in accordance with Chapter 119 of the Florida Statutes; and WHEREAS, a Second Amendment to the Agreement was entered into the 20 day of April, 2017, to include additional services for re- design of library areas to include a floorplan revision that has been requested by staff; and WHEREAS, a Third Amendment to the Agreement was entered into the 29` day of June, 2017, to include alternate plans for separate roof top solar systems; and WHEREAS, staff requested additional revisions to the first and second floor plan design to accommodate a more open floor plan providing the ability to reconfigure the layout of the library space, reposition the children's library to the second floor, reposition the adult section to the first floor, enclose the covered terraces, update the building elevations, and provide a 6" raised access floor on both floors of the facility including the adult education area; and 1 NOW THEREFORE, in consideration of the mutual promises, covenants, and agreement stated herein, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, the County and Consultant agree as follows: 1. In accordance with the Agreement of October 21, 2015, Article III, paragraph 3.2, Consultant shall provide additional services for the reconfiguration of the layout of the library space to include Architectural, Structural Engineering, Mechanical /Electrical /Plumbing Engineering, Fire Protection Engineering, Civil Engineering, and Landscape Architectural consulting services required to generate the revised construction documents for building permit and bidding purposes. . 2. In accordance with the Agreement of October 21, 2015, Article VII, paragraph 7.1.1, the County shall pay the Consultant monthly in current funds for a percent complete of each phase of the Consultant's performance of this Agreement of a total not to exceed One Hundred Thirty Six Thousand One Dollar and 25/100 ($136,001.25) as follows: • Schematic Design through Design Development 35% $47,600.44 • Construction Documents 40% 54,400.50 • Bidding and Negotiation 5% 6,800.06 • Construction Administration 20% 27.200.25 Total 100% $136,001.25 3.
