Maloney, President Project:Customs Terminal Security Enhancements — Phase II and III Contract Amendment Number #2 Dear Mr. Degraw, This letter is Amendment Number 2 to the Agreement ("Agreement") between Design Professional and Client for the performance of services in connection with Project. The purpose of this letter is to request additional funds associated with the request from the Client for services associated with the enhanced construction administration, private inspection, material testing, and CBP requested modifications. This Amendment is effective as of the date of this letter. All other terms and conditions of the Agreement not previously amended or specifically modified by this Amendment remain in effect. Design Professional and Client modify the Agreement as follows: Inspections • Inspection services will be performed in accordance to section 110 of the Florida Building Code 5th Edition (2014) Building (FBC), and will follow all plan specifications by the Design Professional. Reports will follow the requirements of the FBC, describing the construction progress and all conditions that not in compliance and stating whether any measures were taken by the Contractor to correct these conditions. The reports will be generated daily and submitted weekly to all required parties and will follow the required format of the Monroe County Building Official. A list of outstanding issues will be compiled for follow-up until resolution. • The Inspector's representative will perform special inspections during construction of all structural elements, including verification of element size, spacing and placement, structural steel connections (visual only such that any testing of bolted or welded connections will have to be performed by duly licensed AWS or CWI inspectors not included in this scope), CMU installation in -progress monitoring, concrete placement in -progress monitoring, and will verify that the installation of fasteners for the window and door frames complies with the submitted product approvals. • Inspections include: special inspector 18, building 16, mechanical 5, electrical 7, plumbing 5, PE visits 8. "i �,2 Z 2 MUJ • Conducting calls and providing correspondence with CBP and Client as required to resolve additional requests. • Coordination with Contractor to ensure timely review and preparation of a Proposed Change Order for review by all parties. Conceptual Re -Design of Ground Floor • Reorganization of Customs and Greyhound to single level. Add a stair for access to Greyhound. Project Management / Construction Administration • Management and oversight of the Special Inspector and Material Testing company's administrative requirements. • Bi-weekly site visits to the project by Design Professional including site visit summary report. Includes an additional 9 visits. (3) hours / visit including travel time. Material Testing (reimbursable expense) • Refer to Attachment from Concrete Analysis & Testing Laboratories, Inc. for scope of services. Note the price will completely depend upon the schedule the Contractor maintains and the number of tests required. All fees for the testing services shall be treated as a reimbursable expense plus 10%. Therefore, the Design Professional costs for the modifications and additional construction administration of the Phase II scope of work is proposed to be as follows: • Inspection: $27,500.00 • CBP Modifications $ 3,500.00 • Concept Design $ 6,000.00 • PM / CA 8,235.00 Subtotal $45,235.00 • Material Testing reimbursable expense If the terms of this Amendment meet with your approval, please prepare the proper Amendment for execution by the BOCC and K2M.
