HomeMy WebLinkAbout1st Amendment 07/05/2018TASK ORDER AMENDMENT NO.1 PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES BETWEEN MONROE COUNTY AND CURRIE SOWARDS AGUILA ARCHITECTS, INC. FOR MAGNOLIA STREET FUELING STATION In ;accordance with the Consultant Agreement for professional Architectural and Engineering Services, made and entered on the 21" day of January, 2015, and as amended on the IS"' day of January, 2017, and on the 1 1h day of April, 2019, between MONROE COUNTY, hereinafter referred to as the "County" and CURRIE SOWARDS AGUILA ARCHITECTS, INC., hereinafter referred to as "Consultant" and "Contractor", where professional services are allowed if construction costs do not exceed $2,000,000.00 or for study activity if the fee for professional services for each individual study under the contract does not exceed $200,000.00 ("Agreement"). All terms and conditions of the referenced Agreement apply to this Task Order Amendment No. 1, unless this Task Order Amendment amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically referenced in this Task Order Amendment No. 1 and the amendment, addition, or modification shall be precisely described. These additions apply only to the project referenced in this Task Order Amendment No. 1. This Task Order Amendment No_ 1 is effective on the 5+h of 2018. WHEREAS, on the 24`h day of October 2016, the parties entered into a Task Order Agreement for professional architectural and engineering services for the Magnolia Street Fueling Station; and WHEREAS, the Task Order Agreement included Construction Administration Services from the Architect; and WHEREAS, the County also requires Construction Administration Services from the consulting Engineers responsible for the preparation of the permit set of documents including the Civil Engineer, the MEP Engineer, and the Petroleum Consultant; and NOW, THEREFORE, in consideration of the mutual promises contained herein, the County and Consultant agree to amend the Task Order dated October 24, 2016, as follows: A. The Consulting Engineers will provide additional services for the CONSTRUCTION PHASE — ADMINISTRATION OF THE CONSTRUCTION CONTRACT including responding to Request for Information (RFIs) from the General Contractor, one (1) review and if required one (1) re -review of shop drawings and submittals, and provide assistance during the construction period including no more than one (1) site visit each by the Civil Engineer, the MEP Engineer, and the Petroleum Consultant, or their designee. B. In Accordance with Article VH, COMPENSATION, of the Consultant Agreement for Professional Architectural and Engineering Services, the Consultant shall be paid a lump sum fee of Four Thousand Nine Hundred Seventy -Five Dollars and 00/100 ($4,975.00) for the additional professional services with said sum to be paid monthly on a percent complete basis. C. Task Order dated October 24, 2016, shall be revised as follows: COMPENSATION: The County shall pay the CONSULTANT monthly, in current funds for a percentage of progress completed. The total not to exceed the amount of Twenty -Eight Thousand Seven Hundred Twenty -Five Dollars and 00/100 ($28,725.00), which includes Four Thousand Nine Hundred Seventy -Five Dollars and 00/100 ($4,975.00) as described in paragraph B above. All other terms and conditions of the Task Order dated October 24, 2016, the Agreement dated January 21, 2015, and as amended, shall remain unchanged and in full force and effect.
