AGENDA ITEM WORDING: Approval of Task Order Amendment 3 with Currie, Sowards,
Aguila Architects for additional construction administration services at the PK Government Center
and Roth Building WWTP Replacement and Abandonment project. This project is funded by
infrastructure sales surtax. This amendment adds $36,960 to the Task Order bringing the total to
$111,160.
ITEM BACKGROUND: The existing wastewater treatment facilities serving the Plantation Key
Courthouse Campus and Plantation Key Roth Building must be decommissioned and connected to
the Islamorada central sewer system. On April 20, 2015, the County and Currie, Sowards, Aguila
Architects (CSA) executed a Task Order for engineering and design plans to design and develop the
documents necessary for the decommissioning and abandonment of the wastewater treatment
facilities located at the P.K. Government Center and the Roth sub - station. On December 20, 2016,
the County and CSA executed Task Order Amendment 1 that included establishing a water usage
capacity; revise and submit permit application; revise drawings depicting the new grinder station,
valve vault, control panel, and forced main piping. On June 19, 2017, the County and CSA executed
Task Order Amendment 2 that included revising the plans and permit application due to an
inaccurate survey. The County requires additional construction administration services including
shop drawing reviews, project close -out, and certification as shown in Task Order Amendment 3.

1/21/15 - BOCC approved a continuing contract with CSA.
4/19/18 - BOCC approved the Guaranteed Maximum Price from the Biltmore Construction Co. Inc.,
Construction Manager at Risk, for the construction of the Plantation Key Government Center and

THIRD AMENDMENT TO TASK ORDER FOR
CONSULTANT AGREEMENT FOR PROFESSIONAL ARCHITECTURAL AND
ENGINEERING SERVICES BETWEEN MONROE COUNTY AND CURRIE SOWARDS
AGUILA ARCHITECTS, INC. FOR PLANTATION KEY WWTP- ABANDONMENT PLAN
This Third Amendment to the Task Order for the Consultant Agreement for Professional
Architectural and Engineering Services between MONROE COUNTY (the "OWNER" or
"COUNTY"), and CURRIE SOWARDS AGUILA ARCHITECTS, INC. ( "CONSULTANT") for
Plantation Key WWTP- Abandonment, dated January 21, 2015, ( "Consultant Agreement"), is
made and entered into this day of 2018, in order to amend the Task Order dated
April 20, 2015, ("Task Order"), and as amended in the First Amendment on December 20, 2016,
and the Second Amendment on June 19, 2017, as follows.
WITNESSETH
WHEREAS, at the January 21, 2015, Board of County Commissioners' meeting the Board
granted approval and execution of a continuing contract with Currie Sowards Aguila Architects,
Inc. pursuant to Florida Statute Sec. 287.055(2)(g), to provide professional services for
miscellaneous projects in which construction costs do not exceed Two Million and 00/100
($2,000,000.00) Dollars or for study activity if the fee for professional services for each
individual study under the contract does not exceed Two Hundred Thousand and 001100
($200,000.00) Dollars; and
WHEREAS, a Task Order for professional services for the design through construction
administration to decommission and abandon the waste water treatment plants at Plantation
Key Courthouse Complex and Roth Building Complex was entered into on the 20 day of April
2015 eTask Order"); and
WHEREAS, a First Amendment to the Task Order for professional services for the design
through construction administration to decommission and abandon the waste water treatment
plants at Plantation Key Courthouse Complex ( "Plantation Key"), and Roth Building Complex
( "Roth"), was entered into on the 20th day of December 2016, increasing the scope of basic
services to include establishing a water usage capacity; revise and submit permit application;
revise drawings depicting the new grinder station, valve vault, control panel, and forced main
piping; and incorporate revised drawings into the drawings referenced in the original Task
Order; and to revise the Public Records Compliance language; and
WHEREAS, a Second Amendment to the Task Order for professional services for the design
through construction administration to decommission and abandon the waste water treatment
plants at Plantation Key Courthouse Complex ( "Plantation Key"), and Roth Building Complex
( "Rolh"), was entered into on the 19' day of June 2017, to revise the plans and Village of
Islamorada permit application package due to an inaccurate survey provided by the County; and

WHEREAS, the County requires additional Construction Administration Services to include
shop drawing reviews, contract clarification, and project close -out and certiflication; and
NOW, THEREFORE, IN CONSIDERATION of the mutual promises contained herein, the
parties hereby agree that the Task Order shall be amended as follows:
1. Scope of Basic Services shall be revised to include the following construction
administration services for Plantation Key and Roth waste water facilities:
A. Task 1 - Shop Drawing Review
CONSULTANT shall review and approve (or take other appropriate action in
respect of) Shop Drawings and samples and other data that each Contractor is
required to submit, but only for conformance with the design concept of the
Project and compliance with the information given in the Contract Documents.
Such review and approval, or Other action, shall not extend to means, methods,
sequences, techniques or procedures of construction, or safety precautions and
programs incident hereto.
B. Task 2 - Contract Clarification
CONSULTANT shall issue instructions and clarifications to the Contractor(s) on
reasonable requests for information associated with the plans and specifications
and review change order requests, if applicable. Change Orders, if necessary,
will be issued by Monroe County.
C. Task 3 - Project Close -out and Certification
CONSULTANT shall attend one (1) site visit once the Contractor indicates that
the project is substantially complete to develop a punch list. Once
documentation has been provided confirming that the punch list has been
completed in accordance with the Contract Documents and that the Contractor
has fulfilled all his obligations thereunder, CONSULTANT may recommend, in
writing, final payment to the Contractor and may give written notice to the Client
that the work is acceptable (subject to any conditions therein expressed).
CONSULTANT shall not be responsible for the acts or omissions of any
Contractor or subcontractor, any of the Contractor(s)' or subcontractor(s)' agents
or employees, or any other persons (except CONSULTANTls own employees
and agents) at the site or otherwise performing any of the Contractor(s)' work.
Based on the CONSULTANT site visit, construction documentation and photos
provided by Monroe County, and As -built Drawings/close out documentation
provided by the Contractor, CONSULTANT shall review the information for
general compliance with the bid documents and prepare the following project
certification/permit packages:

a. FDEP Place into Operation (PIO) permit for the new pump station and
forcemain.
b. Certification to FDEP that the VVWTP and injection wells are abandoned
in general compliance with the approved plans.
All backup documentation required for project certification, such as equipment
start-up reports, operation and maintenance manuals, system integrity/pressure
tests, and abandonment reports/data, will be provided by the Contactor through
the County for use by CONSULTANT in preparing the permitting/certification
packages.
2. COUNTY shall pay the CONSULTANT an additional Thirty-Six Thousand Nint
Hundred Sixty and 00/100 ($36,960.00) Dollars: for the additional construction
administration services billed monthly on a percentage complete basis.
The remaining terms of the Task Order of April 20, 2015, and as amended by the Firs)
Amendment dated December 20, 2016, and the Second Amendment dated June 19, 2017, an"t

WHEREAS, The Permit Drawings and Application will have to be modified and resubmitted to the Village
of Islamorada due to an Inaccurate survey provided by the County; and
NOW THEREFORE, IN CONSIDERATION of the mutual promises contained herein, the parties hereby
agree that the Task Order shall be amended as follows:

1. Scope of Basic Services shall be revised to include the following for Plantation Key and Roth
waste water facilities:
a) MONROE COUNTY will provide an updated and accurate stamped surrey that meets the
requirements of the Village of Islamorada and the Department of Environmental
Services in an ACAD formatted file.
b) CONSULTANT will prepare a revised permit application package for signature by the
Owner and submit the package to the permitting agency for review.
c) CONSULTANT will prepare revised drawings depicting the new grinder station, valve
vault, control panel, forced main piping and the existing collection system with the
invert pipe size and elevation requirements.
d) CONSULTANT will incorporate revised drawings into the drawings referenced in the
original decommissioning of the waste water treatment plant.
e)
2. COUNTY shall pay the CONSULTANT an additional One Thousand and 00 /100 ($1,000.00)
Dollars for the additional services and drawings billed monthly on a percentage complete
basis.
The remaining terms of the Task Order of April 20, 2015, and the First Amendment dated December 20",
2016, and the Consultant Agreement of January 21, 2015, shall remain in full force and effect.

This First Amendment to the Task Order for Consultant Agreement for Professional Architectural and

dated January 21, 2015, ( "Consultant Agreement "), is made and entered into t day of
2016, in order to amend the Task Order dated April 20, 2015, as follows.
WITNESSETH
WHEREAS, at the January 21, 2015, Board of County Commissioners' meeting the Board granted

Florida Statute Sec. 287.055(2)(8), to provide professional services for miscellaneous projects in which
construction costs do not exceed Two Million and 00/100 Dollars ($2,000,000.00) or for study activity if
the fee for professional services for each individual study under the contract does not exceed Two
Hundred Thousand and 00/100 Dollars ($200,000.00); and
WHEREAS, a Task Order for professional services for the design through construction administration to
decommission and abandonment of the waste water treatment facilities at Plantation Key Government
Center and Roth Building Complex was entered into on the 20 day of April, 2015 ( "Task Order "); and
WHEREAS, the current scope of work did not include modifications to the existing site capacities or
capacity analysis, modifications to the onsite sanitary sewer collection system, or modifications to any
emergency generator facilities for either site; and
NOW, THEREFORE, IN CONSIDERATION of the mutual promises contained herein, the parties hereby
agree that the aforementioned Task Order shall be amended as follows:
1. Scope of Basic Services shall be revised to include the following for Plantation Key
Government Center and Roth Building Complex waste water facilities:
a) CONSULTANT will review and coordinate new water usage data with Monroe County to
establish the proposed capacity.
b) CONSULTANT will prepare a revised permit application package for signature by the
Owner and submit the package to the permitting agency for review.
c) CONSULTANT will prepare revised drawings depicting the new grinder station, valve
vault, control panel. and forced main piping.

d) CONSULTANT will incorporate revised drawings into the drawings referenced in the
original Task Order decommissioning the waste water treatment facilities.
2. COUNTY shall pay the CONSULTANT an additional total lump sum fee of $7,700 for the
additional services and drawings billed monthly on a percentage complete basis.
3. Article IX, paragraphs 9.9 (Public Records) and 9.22 (Public Access) of the Professional
Architectural and Engineering Services Agreement shall be revised as follows:
Public Records Compliance. Contractor must comply with Florida public records laws, including
but not limited to Chapter 119, Florida Statutes and Section 24 of Article I of the Constitution of
Florida. The County and Contractor shall allow and permit reasonable access to, and inspection
of, all documents, records, papers, letters or other "public record" materials in its possession or
under its control subject to the provisions of Chapter 119, Florida Statutes, and made or
received by the County and Contractor in conjunction with this contract and related to contract
performance. The County shall have the right to unilaterally cancel this contract upon violation
of this provision by the Contractor. Failure of the Contractor to abide by the terms of this
provision shall be deemed a material breach of this contract and the County may enforce the
terms of this provision in the form of a court proceeding and shall, as a prevailing party, be
entitled to reimbursement of all attorney's fees and costs associated with that proceeding. This
provision shall survive any termination or expiration of the contract.
The Contractor is encouraged to consult with its advisors about Florida Public Records Law in
order to comply with this provision.
Pursuant to F.S. 119.0701 and the terms and conditions of this contract, the Contractor is
required to:
a. Keep and maintain public records that would be required by the County to perform the
service.
b. Upon receipt from the County's custodian of records, provide the County with a copy of
the requested records or allow the records to be inspected or copied within a
reasonable time at a cost that does not exceed the cost provided in this chapter or as
otherwise provided by law.
c. Ensure that public records that are exempt or confidential and exempt from public
records disclosure requirements are not disclosed except as authorized by law for the
duration of the contract term and following completion of the contract if the contractor
does not transfer the records to the County.
d. Upon completion of the contract, transfer, at no cost, to the County all public records in
possession of the Contractor or keep and maintain public records that would be
required by the County to perform the service. If the Contractor transfers all public
records to the County upon completion of the contract, the Contractor shall destroy any
duplicate public records that are exempt or confidential and exempt from public records

disclosure requirements. If the Contractor keeps and maintains public records upon
completion of the contract, the Contractor shall meet all applicable requirements for
retaining public records. All records stored electronically must be provided to the
County, upon request from the County's custodian of records, in a format that is
compatible with the information technology systems of the County.
e. A request to inspect or copy public records relating to a County contract must be made
directly to the County, but if the County does not possess the requested records, the
County shall immediately notify the Contractor of the request, and the Contractor must
provide the records to the County or allow the records to be inspected or copied within
a reasonable time.
If the Contractor does not comply with the County's request for records, the County shall
enforce the public records contract provisions in accordance with the contract, notwithstanding
the County's option and right to unilaterally cancel this contract upon violation of this provision
by the Contractor. A Contractor who fails to provide the public records to the County or
pursuant to a valid public records request within a reasonable time may be subject to penalties
under section 119.10, Florida Statutes.
The Contractor shall not transfer custody, release, alter, destroy or otherwise dispose of any
public records unless or otherwise provided in this provision or as otherwise provided by law.
The remaining terms and conditions of the Task Order of April 20, 2015, and the Consultant Agreement
of January 21, 2015, shall remain in full force and effect.

TASK ORDER
PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES
BETWEEN MONROE COUNTY AND CURRIE SOWARDS AGUILA ARCHITECTS
FOR
PLANTATION KEY WWTP — ABANDONMENT PLAN
In accordance with the Continuing Contract for Professional Architectural and
Engineering Services, made and entered on the 21 day of January, 2015 between
MONROE COUNTY, hereinafter referred to as the "County" and CURRIE
SOWARDS AGUILA ARCHITECTS, hereinafter referred to as "Consultant" where
professional services are allowed if construction costs do not exceed $2,000,000.00.
All terms and conditions of the referenced Professional Architectural and Engineering
Services Agreement apply to this Task Order, unless the Task Order modifies an Article
of the Agreement of which will be specifically referenced in this Task Order and the
modification shall be precisely described. These additions apply only to the project
referenced in this Task Order.
This Task Order is effective on the 20 of, April 2015.
1. In accordance to Article II SCOPE OF BASIC SERVICES on the Professional
Architectural and Engineering Services Agreement dated January 21, 2015, the
Consultant will provide design services as described below:
Consultant shall provide the services of Kimley -Horn and Associates, Sub - Consultant,
for the design and development of the documents necessary for the decommissioning and
abandonment of the wastewater treatment facilities located at the P.K. Government
Center and the Roth sub - station. Sub - Consultant is responsible for all terms and
conditions of the Continuing Contract Agreement with Consultant dated January 21, 2015
unless otherwise stated in this Task Order.
SCOPE OF WORK
Preparation of design through construction documents including plans and
specifications for bidding and permitting. Plans for both P.K. Government Center and
the Roth building shall be in accordance with the Florida Department of Environmental
Protection Agency, (FDEP), Rule 62- 620.610 (15). Sub - Consultant to submit plans and
coordinate abandonment with the FDEP South District.
Demolition plans and specifications shall include the removal of all equipment,
structures, leveling the existing area, and abandoning the effluent wells.
Plans and specifications for the provision of and installation of two new onsite
grinder stations with associated forcemain piping (1 for each location) shall be to connect
the grinder stations to the existing onsite sanitary sewer collection system and pump the
current onsite wastewater flows with the new force main piping to the offsite and
adjacent public sanitary sewer system for wastewater treatment.
P.K. Government Center, Roth Bldg WWTP Decommissioning
The scope of work does not include modifications to the existing onsite sanitary
sewer collection system or emergency generator facilities with associated fuel systems
for either site.
Survey data will be provided by the County.
TASK 1: P.K. Government Center — Abandonment Plan
Sub - Consultant shall prepare a written plan for the abandonment of the
wastewater facility at the PK Government Center. The plan will consist of
Inventory of operating components to be removed.
• General terms and actions to be taken by the owner and contractor to safe guard
public health and safety such as de- chlorination, disinfection of facilities, removal
of sludge, fluids, and settleables, and lime stabilization of tanks.
• Disposal plan for materials and equipment.
• Schedule for de- activation of facility and plan to address wastewater currently
being treated.
• Coordination with the FDEP Department of Underground Injection Control
*UIC) to define permitting requirements for abandoning and plugging the two
effluent wells per Rules, 62-528.625 and 62- 528.645, F.A.C.
Sub - Consultant shall prepare drawings depicting a demolition plan and site
leveling plan for bidding, decommissioning, equipment removal, leveling the site, and to
obtain permitting through the FDEP UIC and County.
Sub - Consultant shall submit the written plan and drawings to the FDEP at least 60
days prior to abandonment in accordance to FDEP Rule 62- 620.610 (15). Sub -
Consultant shall respond to FDEP South District questions and comments to the plan and
modify the plan accordingly. Sub - Consultant to attend one site visit during the project
with FDEP South District representative to answer questions.
TASK 2: P.K. Government Center — Onsite Wastewater Grinder Station
Sub - Consultant shall review existing performance data for the onsite wastewater
grinder station and assume new operating conditions with increased operating pressures
associated with pumping wastewater offsite to a nearby sanitary sewer manhole. The
intent is to propose a new duplex, submersible wastewater grinder station with 2" HDPE
force main piping from the proposed grinder station to the existing offsite manhole.
Sub - Consultant shall comply with all requirements of governmental authorities
having jurisdiction over the project to include permit approvals of the new onsite grinder
station. Sub - Consultant to prepare and submit permit application package.
Sub - Consultant to provide all drawings and specifications necessary for the new
grinder station to be incorporated in the drawings referenced for the decommissioning
plan. Drawings to include Schematic design phase requirements through Construction
documents phase requirements.
P.K. Government Center, Roth Bldg WWTP Decommissioning Z
Sub - Consultant to attend one meeting with the County's representative during the
design process to review the grinder station project approach and associated drawings.
Sub - Consultant to answer all Request for Information (RFI) questions from
prospective bidders.
ASSUMPTIONS:
• An adjacent public sanitary sewer system is available nearby the site with
adequate capacity to accept the new flows from the Plantation Key WWTP site.
• The new onsite grinder station sizing will be similar to the existing station and
that the existing electrical services is adequate for the new station.
• No fencing and landscape features are required in association with the new
grinder station.
TASK 3: Roth Building — Abandonment Plan
Sub - Consultant shall prepare a written plan for the abandonment of the current
wastewater facility at the Roth Building site. The plan will consist of:
• Inventory of operating components to be removed.
• General terms and actions to be taken by the owner and contractor to safe guard
public health and safety such as de- chlorination, disinfection of facilities, removal
of sludge, fluids, and settleables, and lime stabilization of tanks.
• Disposal plan for materials and equipment.
• Schedule for de- activation of facility and plan to address wastewater currently
being treated.
• Coordination with the FDEP Department of Underground Injection Control
*UIC) to define permitting requirements for abandoning and plugging the two
effluent wells per Rules 62- 528.625 and 62- 528.645, F.A.C.
Sub - Consultant shall prepare drawings depicting a demolition plan and site
leveling plan for bidding, decommissioning, equipment removal, leveling the site, and to
obtain permitting through the FDEP UIC and County.
Sub - Consultant shall submit the written plan and drawings to the FDEP at least 60
days prior to abandonment in accordance to FDEP Rule 62- 620.610 (15). Sub -
Consultant shall respond to FDEP South District questions and comments to the plan and
modify the plan accordingly. Sub - Consultant to attend one site visit during the project
with FDEP South District representative to answer questions.
TASK 4: Roth Building — Onsite Wastewater Grinder Station
Sub - Consultant shall review existing performance data for the onsite wastewater
grinder station and assume new operating conditions with increased operating pressures
associated with pumping wastewater offsite to a nearby sanitary sewer manhole. The
intent is to propose a new duplex, submersible wastewater grinder station with 2" HDPE
force main piping from the proposed grinder station to the existing offsite manhole.

Sub - Consultant shall comply with all requirements of governmental authorities
having jurisdiction over the project to include permit approvals of the new onsite grinder
station. Sub - Consultant to prepare and submit permit application package.
Sub - Consultant to provide all drawings and specifications necessary for the new
grinder station to be incorporated in the drawings referenced for the decommissioning
plan. Drawings to include Schematic design phase requirements through Construction
documents phase requirements.
Sub - Consultant to attend one meeting with the County's representative during the
design process to review the grinder station project approach and associated drawings.
Sub - Consultant to answer all Request for Information (RFI) questions from
prospective bidders.
ASSUMPTIONS:
• Details for the wastewater facility for the Roth Building are assumed to be similar
to the P.K. Government Center facility.
• An adjacent public sanitary sewer system is available nearby the site with
adequate capacity to accept the new flows from the Plantation Key WWTP site.
• The new onsite grinder station sizing will be similar to the existing station and
that the existing electrical services is adequate for the new station.
• No fencing and landscape features are required in association with the new
grinder station.
ADDITIONAL SERVICES:
Any additional service deemed necessary during the project shall be billed at
hourly rates described in Attachment A.
COMPENSATION:
In accordance to Article VII of the Continuing Contract dated January 21, 2015, the
County shall pay the Consultant in current funds a lump sum fee of Sixty -Five Thousand
Five Hundred Dollars and 00 /100 ($65,500.00) billed monthly on a percentage complete
for the Tasks as described below:

Task 2: P.K. Government Center Grinder Station
Task 3: Roth Building WWTP Abandonment Plan

REIMBURSABLE EXPENSES:
Permitting and application fees will be paid directly by the Sub - Consultant and shall be
reimbursed by the County.
All other terms and conditions of the Task Order shall be in accordance with the
Architectural and Engineering Services Agreement dated January 21, 2015.
IN WITNESS WHEREOF, each party caused Task Order to be executed by its duly
authorized representative.
