5 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY
6 COMMISSIONERS APPROVING THE EXTENSION O F T H E
7 RESERVATION OF ONE HUNDRED AND FOUR (104) AFFORDABLE
8 HOUSING DWELLING UNIT ALLOCATIONS CONSISTING OF ONE (1)
9 VERY LOW INCOME, FIFTY -ONE (51) LOW INCOME, TWENTY (20)
10 MEDIAN INCOME AND THIRTY -TWO (32) MODERATE INCOME
11 ALLOCATIONS, FOR A PROPOSED AFFORDABLE DWELLING UNIT
12 DEVELOPMENT BY QUARRY PARTNERS, LLC, AT PROPERTY
13 LOCATED AT APPROXIMATE MILE MARKER 9, DESCRIBED AS A
14 PARCEL OF LAND IN SECTION 21, TOWNSHIP 67 SOUTH, RANGE 26
15 EAST, BIG COPPITT KEY, MONROE COUNTY, FLORIDA, HAVING
16 REAL ESTATE NUMBERS 00120940 - 000100, 00120940 - 000201, AND
17 00120940 - 000302, UNTIL JULY 1, 2019

19 WHEREAS, the State of Florida and all local governments in the Florida Keys (each subject
20 to Area of Critical State Concern mandates relating to housing affordability) recognize the need
21 for affordable housing throughout the state and particularly in the Florida Keys where developable
22 land for housing is extremely limited and expensive; and
23
24 WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys
25 is one requiring sensible and responsive use of residential unit allocations, including implementation
26 of long -term preservation mechanisms; and
27
28 WHEREAS, due consideration should be given to relevant factors such as the capacity
29 for allocation recipients to promptly transform allocation awards /reservations into finished and occupied
30 affordable housing units; and
31
32 WHEREAS, the developers have legitimate needs for some assurance that allocations are in
33 fact and will remain available and /or justified for a reasonable time so that follow- through on
34 initial commitments will in fact be justified; and
35
36 WHEREAS, in accordance with Section 138- 24(b)(2) of the Monroe County Land Development
37 Code allows the BOCC to authorize reservations for "specific affordable or employee housing projects
38 participating in a federal /state housing financial assistance or tax credit program or receiving some
39 form of direct financial assistance from the county upon written request from the project sponsor and
40 approved by resolution of the board of county commissioners," and
41
42 WHEREAS, the BOCC, on February 10, 2016, adopted Ordinance 003 -2016 amending the

1 Monroe County Future Land Use Map from Industrial (I) to Commercial (COMM) for property located
2 at approximate mile marker 9, described as four parcels of land in Section 21, Township 67 South, Range
3 26 East, Rockland Key, Monroe County, Florida, having Real Estate Numbers 00122080.000000,
4 00122081.000200, 00122010.000000 and 00121990.000000; and from Mixed Use /Commercial Fishing
5 (MCF) and Industrial (I) to Mixed Use /Commercial (MC); creating Policy 107.1.6 Big Coppitt
6 Mixed Use Area 1, to provide limitations on development and specific restrictions, for property
7 located at approximate mile marker 9, described as a parcel of land in Section 21, Township 67 South,
8 Range 26 East, Big Coppitt Key, Monroe County, Florida, having Real Estate Number 00120940.000100;
9 as proposed by Rockland Operations, LLC and Rockland Commercial Center, Inc.; and
10
11 WHEREAS, the BOCC, on February 10, 2016, adopted Ordinance 004 -2016 amending
12 the Monroe County Land Use District (Zoning) Map from Industrial (I) and Commercial Fishing Area
13 (CFA) to Mixed Use (MU) for property located at approximate mile marker 9, described as a parcel
14 of land in Section 21, Township 67 South, Range 26 East, Big Coppitt Key, Monroe County, Florida,
15 having Real Estate Number 00120940.000100, and from Industrial (I) to Commercial 2 (C2) for
16 property located at approximate mile marker 9, described as four parcels of land in Section 21, Township
17 67 South, Range 26 East, Rockland Key, Monroe County Florida, having Real Estate Numbers
18 00122080.000000, 00122081.000200, 00122010.000000 and 00121990.000000; as proposed by
19 Rockland Operations, LLC and Rockland Commercial Center, Inc.; and
20
21 WHEREAS, Rockland Operations noticed Monroe County of its intent to apply to the Florida
22 Housing Finance Corporation ( "FHFC ") for Low Income Housing Tax Credit ( "LIHTC ") financial
23 assistance to offset the costs of 96 of its proposed 208 unit development ( "Project "); and
24
25 WHEREAS, as part of the LIHTC application, FHFC requires the applicant to have obtained
26 the necessary ROGOs and for Monroe County to execute a verification that verifies that the applicant
27 has obtained the necessary ROGOs; and
28
29 WHEREAS, Rockland Operations requested Monroe County reserve for a period of one (1)
30 year Ninety -Six (96) ROGO allocations consisting of Forty -Four (44) Low, Twenty (20) Medium and
31 Thirty- Two (32) Moderate Income affordable ROGO allocations for development of the units proposed
32 as part of the LIHTC application and as part of its Two Hundred Eight (208) dwelling unit proposed
33 development; and.
34
35 WHEREAS, on December 14, 2016, the BOCC adopted Resolution 323 -2016 reserving ninety -
36 six (96) affordable housing ROGO allocations consisting of Forty -Four (44) Low income (60 %), Twenty
37 (20) Medium income (100 %) and Thirty -Two (32) Moderate Income ( 120 %) affordable ROGO
38 allocations for a parcel of land in Section 21, Township 67 South, Range 26 East, Big Coppitt
39 Key, Monroe County, Florida, Having Real Estate Number 00120940- 000100 until December 15, 2017;
40 and
41
42 WHEREAS, Resolution 323 -2016 included a provision that the affordable housing
43 units developed with the Forty -Four (44) Low income ROGO allocations reserved by the resolution
44 shall have rent rates limited to 60% median income; and
45

1 WHEREAS, the project obtained Low Income Tax Credit Housing (LIHTC) assistance for the
2 development of the 96 units; and
3
4 WHEREAS, the ownership of the parcels has changed to the Quarry Partners, LLC; and
5
6 WHEREAS, the property has the real estate numbers 00120940.000100, 00120940.000201,
7 and 00120940.000302; and
8
9 WHEREAS, Quarry Partners, LLC, August 30, 2017 submitted a revised ROGO reservation request,
10 adding eight (8) additional allocations to the previously reserved 96 allocations and a request to extend the
11 timeframe to July 1, 2018; and
12
13 WHEREAS, the August 30, 2017 letter requested that Monroe County reserve 104 ROGO
14 allocations consisting of One (1) Very Low, Fifty -One (51) Low, Twenty (20) Medium and Thirty -Two (32)
15 Moderate Income affordable ROGO allocations [1 +51 +20 +32 =104] for the development of units proposed
16 as part of an additional LIHTC application and State Apartment Incentive Loan program (SAIL) financing
17 as part of its Two Hundred Eight (208) dwelling unit proposed development; and
18
19 WHEREAS, Resolution 212 -2017 reserved 104 ROGO allocations consisting of One (1) Very Low,
20 Fifty -One (51) Low, Twenty (20) Medium and Thirty -Two (32) Moderate Income affordable ROGO
21 allocations [1 +51 +20 +32 =104] for a parcel of land in Section 21, Township 67 South, Range 26 East, Big
22 Coppitt Key, Monroe County, Florida, Having Real Estate Numbers 00120940 - 000100, 00120940- 000201,
23 and 00120940- 000302 until July 1, 2018.

25 WHEREAS, on July 13, 2018, Quarry Partners, LLC, submitted a request for the extension
26 of the 104 affordable housing allocation awards; and
27
28 WHEREAS, Monroe County Code Sec.138 -24(b) allows reservation of affordable ROGO
29 allocations by the Board for specific housing programs, which includes FHFC LIHTC and SAIL; and
30
31 WHEREAS, the reservation of affordable housing allocations for the anticipated Project does
32 not exempt the project from applicable requirements in the Monroe County Comprehensive Plan
33 (including the requirement for a development agreement), Land Development Code, Building Code,
34 and other regulatory requirements;
35
36 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
37 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

39 Section 1: 104 total ROGO allocations consisting of One (1) Very Low, Fifty -One (51) Low,
40 Twenty (20) Medium and Thirty -Two (32) Moderate Income [1 +51 +20 +32 =104] affordable ROGO
41 allocations are reserved for parcels of land in Section 21, Township 67 South, Range 26 East, Big
42 Coppitt Key, Monroe County, Florida, Having Real Estate Numbers 00120940.000100,
43 00120940.000201, and 00120940.000302 until July 1, 2019 for building permit issuance.

2 Section 2:, The affordable housing units developed with the Fifty -one (51) Low income ROGO
3 allocations reserved by this resolution shall have rent rates limited to 60% median income.

5 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a
6 regular meeting of said Board held on the 18` day of July, 2018.
