Resolution 197-2018 4 1/4) 1 2 3 RESOLUTION NO. 197 -2018 4 5 A RESOLUTION BY THE MONROE COUNTY BOARD OF COUNTY 6 COMMISSIONERS APPROVING THE EXTENSION OF THE 7 RESERVATION OF ONE HUNDRED AND FOUR (104) DWELLING UNIT 8 ALLOCATIONS, PURSUANT TO THE 380 AGREEMENT WITH THE 9 STATE AND MUNICIPALITIES TO TRANSFER 104 KEY WEST BPAS 10 UNITS TO MONROE COUNTY FOR THE PROPOSEDAFFORDABLE 11 HOUSING PROJECT KNOWN AS "THE QUARRY," BY QUARRY 12 PARTNERS, LLC, AT PROPERTY LOCATED AT APPROXIMATE MILE 13 MARKER 9, DESCRIBED AS A PARCEL OF LAND IN SECTION 21, 14 TOWNSHIP 67 SOUTH, RANGE 26 EAST, BIG COPPITT KEY, MONROE 15 COUNTY, FLORIDA, HAVING REAL ESTATE NUMBERS 00120940- 16 000100, 00120940 - 000201, AND 00120940 - 000302, UNTIL JULY 1, 2019. 17 18 19 WHEREAS, the State of Florida and all local governments in the Florida Keys (each subject 20 to Area of Critical State Concern mandates relating to housing affordability) recognize the need 21 for affordable housing throughout the state and particularly in the Florida Keys where developable 22 land for housing is extremely limited and expensive; and 23 24 WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys 25 is one requiring sensible and responsive use of residential unit allocations, including implementation 26 of long -term preservation mechanisms; and 27 28 WHEREAS, due consideration should be given to relevant factors such as the capacity 29 for allocation recipients to promptly transform allocation awards /reservations into finished and occupied 30 affordable housing units; and 31 32 WHEREAS, the developers have legitimate needs for some assurance that allocations are in 33 fact and will remain available and/or justified for a reasonable time so that follow- through on 34 initial commitments will in fact be justified; and 35 36 WHEREAS, in accordance with Section 138- 24(b)(2) of the Monroe County Land Development 37 Code allows the BOCC to authorize reservations for "specific affordable or employee housing projects 38 participating in a federal /state housing financial assistance or tax credit program or receiving some 39 form of direct financial assistance from the county upon written request from the project 40 sponsor and approved by resolution of the board of county commissioners," and 41 42 WHEREAS, the "THE QUARRY" project obtained Low Income Tax Credit Housing (L1liTC) 43 assistance for the development of the 96 units and the project is submitting for additional L11iTC 44 assistance and State Apartment Incentive Loan program (SAIL.) financing as part of its Two Hundred 1 • 1 Eight (208) dwelling unit proposed development; and 2 3 WHEREAS, Key West has a certain number of unallocated BPAS units accumulated in years 4 one (1) through four (4) which the City desires to allocate to an Affordable Housing /Workforce Housing 5 project ( "The Quarry ") located on Big Coppitt Key, which is beyond the jurisdictional boundary 6 limits of Key West, and 7 8 WHEREAS, Key West has approved a Comprehensive Land Use Plan Amendment which 9 has been rendered to the Department of Economic Opportunity (DEO) for review and comment 10 pursuant to the State Coordinated Review Guidelines of Chapter 163, Florida Statutes, which 11 would allow the transfer of 104 BPAS units to Monroe County for the Workforce Housing/Affordable 12 Housing Project known as "The Quarry," located on Big Coppitt Land Use Area 1 at approximate Mile 13 Marker 9; and 14 15 WHEREAS, a 380 Agreement is being entered into by and between the Department 16 of Economic Opportunity (DEO), Monroe County, the City of Key West, lslamorada, Village of 17 Islands, the City of Layton, and the City of Marathon (the" Local Governments ") (all collectively 18 known as the "Parties ") for the purpose of Complying with Rules 28 -18, 28 -19, and 28 -20, 19 of the Florida Administrative Code, and as provided for in Section 380.032(3), Florida Statutes; and 20 21 WHEREAS, upon effectiveness of the Comprehensive Land Use Plan of Key West and 22 the execution of the 380 Agreement by the Parties, the City of Key West shall transfer 104 23 previously unallocated BPAS units to Monroe County for "The Quarry" project on Big Coppitt 24 Key for the construction of workforce housing /affordable housing; and 25 26 WHEREAS, in the event building permits are not issued for "the Quarry" project on or 27 before June 30, 2019, the BPAS units awarded by Key West will remain with Monroe County as 28 affordable ROGO units to be awarded by Monroe County for Affordable /Workforce Housing 29 residential uses in Monroe County south of Mile Marker 26; and 30 31 WHEREAS, Resolution 213 -2017 reserved 104 ROGO allocations for a parcel of land in Section 32 21, Township 67 South, Range 26 East, Big Coppitt Key, Monroe County, Florida, Having Real Estate 33 Numbers 00120940.000100, 00120940.000201, and 00120940.000302 until July 1, 2018. 34 35 WHEREAS, on July 13, 2017, Quarry Partners, LLC, submitted a request for the extension 36 of the 104 affordable housing allocation awards; and 37 38 WHEREAS, the reservation of affordable housing allocations for the anticipated Project 39 does not exempt the project from applicable requirements in the Monroe County Comprehensive 40 Plan (including the requirement for a development agreement), Land Development Code, Building 41 Code, and other regulatory requirements;
