ITEM BACKGROUND: Fisherman's Community Hospital was purchased by Baptist Health South in July 2017. Fisherman's is an all- purpose, critical access hospital offering a 24/7 emergency room, inpatient and outpatient surgery, diagnostic imaging, and physical and occupational therapy. Fisherman's Hospital suffered significant damage during Hurricane Irma. The main facility has been closed since September 10, 2017. To ensure that the community (including storm first responders) had access to care in the wake of the storm, the hospital opened a temporary unit on the hospital grounds. Baptist Health South shortly intends to replace the temporary unit with a modular hospital in the same location. In February 2018, Baptist Health South Florida, the region's largest not - for -profit healthcare organization — announced plans to design and build an entirely new permanent hospital in Marathon. Construction of the new facility is expected to cost $40 million, and is slated to begin during the first half of 2019. In addition, for the past several years, Fishermen's has suffered a negative cash flow, largely attributable to rising indigent health care costs. If those costs were paid through ad valorem taxes, Baptist Health South would be able to take the funds otherwise necessary for indigent health care costs, and redirect the funds to capital construction. Baptist Health South has asked the County to consider setting up a municipal service taxing unit (MSTU) to collect ad valorem taxes of one -half of one mill (0.00050) on assessed value on properties in the MSTU. If the ordinance is approved, the proposed MSTU will include all properties in Election Precincts 18 through 22 and Precinct 23.01, 23.02, 23.03, and 23.04, approximately mile marker 40 through mile marker 66. The MSTU would collect taxes for ten years. The hospital estimates that the tax levy would raise $1.5 million per year, or $15 million total. If the ordinance is approved, the BOCC will set the budget for the MSTU during next summer's budget proceedings. Taxes would be levied and collected beginning in November 2019 (fiscal 2020). The funds to Fishermen's will be paid on a reimbursement basis, upon presentment to the County of invoices showing indigent services rendered. This proposed MSTU thus is similar to the Upper Keys Health Care Taxing District, another MSTU. The Trauma District was created by Ordinance No. 008 -1988, collected ad valorem taxes for ten years, and was used to reimburse local area hospitals for the costs of transport and health care for trauma - related injury patients that were un- assumable by the patients, until the Trauma District was dissolved by the BOCC in December 2016 by Ordinance No. 031 -2016. Notwithstanding creation of the MSTU, on a going forward basis, this transaction will also require an agreement between the County and Baptist, spelling out the terms and conditions under which the reimbursement will occur. That agreement will be presented to the BOCC for approval within the next several months. The levy of the taxes is conditional on the adoption of ordinances consenting to the inclusion of their taxpayers in the MSTU by the two municipalities (Marathon and Key Colony Beach). A letter has been sent to the municipalities asking that they adopt the ordinances. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY: Section 1. Section 22-128 within Article VI of the Code of Ordinances of Monroe County, Florida ("Code") is hereby created to read as set forth below. Sec. 22-128 Middle Keys Health Care Municipal Service Taxing Unit. (a) Taxing unit created. A municipal service taxing unit (MSTU) is hereby created pursuant to F.S. 125.01(1)(q), which encompasses the following geographic areas, lying between Mile Marker 40 at the southern end of the Seven Mile Bridge, and Mile Marker 65: The entire Citv of Marathon. Florida. includiniz Grassv Kev and an offshore islands within the municipality= The entire City of Key Colony_ Beach, including any offshore islands within the municipality; and That portion of unincorporated Monroe County lying between Mile Marker 40 and Mile Marker 65, including but not limited to Duck Key including Hawk's Cay (Indies Island), and Conch Key, excluding an offshore islands within the unincorporated County. These areas correspond to the following taxing districts designated by the Monroe County Property Appraiser's Officer existing as of 1 -1 -2018: i) 50CM — Part of Citv of Marathon GO 5 1 CM — Part of City of Marathon (iii) 50KC — City of Key Colony Beach (iv) 500D — Part of Unincorporated Duck Ka (v) 51 OD — Unincorporated Conch Key (vi) 520D — Part of Unincorporated Duck Key 2 114951208.8 (b) Name of unit. The name of the MSTU shall be the Middle Keys Health Care Municipal Service Taxing Unit (hereinafter, the taxing unit). (c) Purpose of unit. The taxing unit shall be established to ensure the availability of hospital services within the taxing unit by financiall sppporting the delivery of hospital services to patients who are unable to pay the full costs of such services. (d) Public purpose. It is hereby found, declared and determined by the Board of County Commissioners of Monroe County, Florida, that the provision of adequate health care facilities and services fosters the public health, safety and welfare of the citizens, as well as visitors, of the taxing unit, and therefore serves a paramount public purpose. It is hereby further declared and determined by the Board of County Commissioners that the services to be funded with ad valorem taxes levied and collected pursuant to this Section are municipal services as contemplated in F.S. 125.01(l)(q) and (r), and that they shall be provided within the taxing unit. The intention of the Board of County Commissioners is to levy _ a tax to fund these municipal services on the taxable valuation of all real propert within the taxing unit. (e) Governing board. The governing board of the taxing unit is the Board of County Commissioners of Monroe County, Florida. The governing board shall have all powers, authority and duties outlined in F.S. � 125.01(1)(q) and (r), including, without limitation, the power and authority to levy and collect taxes, and the power to enter into contractual obligations to accomplish the purposes set forth in this section. Levv of tax. The Board of Countv Commissioners of Monroe County shall adopt an annual budget for the Middle Keys Health Care Municipal Service Taxing Unit, commencing with county fiscal year 2019, at the same time and in the same manner as the county budget. The levy by the Board of County Commissioners shall be by annual resolution, beginning with County fiscal year 2019, for a maximum of ten (10) years. The amount to be levied shall be set each year, but shall not exceed a maximum of one-half of one mill (0.00050) on the assessed valuation of taxable real property in the taxing unit. The millage shall be set and the tax levied thereon in accordance with the provisions and in like manner as required for the setting of other County ad valorem taxes. Use of taxes. Revenues from ad valorem taxes levied within the Middle Keys Health Care Municipal Service Taxing Unit shall be used solely for payments to hospital operators for the delivery of hospital services to patients who are unable to pay the full costs of such services. The levy, collection and disbursement of taxes for this purpose is contingent ppon the occurrence of all of the following: (i) adoption by Monroe County of this Ordinance; (ii) adoption of ordinances consenting to the inclusion in the taxing unit of the municipalities of Marathon and Key Colony Beach W 114951208.8 by their respective governing bodies, as required by Section 125.01(1)(g), Florida Statutes; (iii) approval of an agreement between Monroe County and Fishermen's, or another future hospital operator, setting forth the terms and conditions by which the ad valorem taxes will be paid; and (iv) the planning, design and construction of a new hospital within the taxing unit in accordance with milestones set forth in an agreement between the County and Fishermen's. (h) Fiscal Manggement. All taxes levied within the taxing unit shall be due and payable and collected in the same manner proscribed by law for other county ad valorem taxes. The revenues collected shall be received, held, and secured in the same manner as other funds by the clerk of the circuit court and shall be used exclusively for the purposes provided in this section. Section 2. Severa bility. If any section, subsection, sentence, clause, or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 3. Repeal. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of said conflict. Section 4. Inclusion in the Code. The provisions of this Ordinance shall be included and incorporated into the Monroe County Code as an addition or amendment thereto, and shall be renumbered appropriately to conform with the uniform numbering system of the Monroe County Code. Section 5. Effective Date. The draft ordinance, if approved, would create a municipal service taxing unit (MSTU) that would run from mile marker 40 (about 15 feet into the Seven Mile Bridge) to mile marker 65 (on the Long Key Bridge). It would take in all of the municipalities of Marathon and Key Colony Beach, as well as all of the parts of unincorporated Monroe County lying between those mile markers, including Duck Key (including Hawk's Cay, Indies Island) and Conch Key. Based on today's taxable values provided by the Property Appraiser's Office, the proposed MSTU is expected to generate approximately $1.8 million in ad valorem tax revenue per year The collection of taxes will continue for a maximum of 10 years. The ordinance provides that the ad valorem taxes will be collected and held, and will be used to reimburse Fishermen's Hospital solely for the delivery of health care services to patients who are unable to pay. The payments will be made on a reimbursement basis, only. The ordinance also provides that levy, collection and disbursement of taxes is contingent upon the occurrence of all of the following four things: (a) adoption by the BOCC of this ordinance; (b) adoption of the two municipalities of ordinances consenting to the inclusion of their taxpayers in the MSTU (required by F.S. 125.01(1)(q) and scheduled for later this summer); (c) approval of an agreement between the County and Fishermen's setting forth the terms and conditions by which the taxes will be paid (to be presented to the BOCC later in the summer); and (d) planning, design, and construction of a new hospital within the taxing unit in accordance with milestones that will be laid out in the agreement between the County and Fishermen's. Two weeks after Irma destroys Fishermen's Community Hospital, Baptist Health reopens a "Field Hospital" with extremely limited (billable) services. Baptist Health starts accumulating losses over $1,000,000 per month. As of July 2018 over $10,000,000. • December 2017. Baptist Health approves up to $40 million to develop and build a new critical access hospital in Marathon, but is seeking $15 million in private, philanthropic pledges in order to continue to move forward with its plan. It is common for donations or pledges to be paid long after construction of a hospital is finished. July 2018. Baptist opens 8000 SF temporary modular hospital at a total cost of $5,000,000. To date, Baptist Health has invested through acquisition and hurricane losses over $28,100,000 dollars in Fishermen's Community Hospital. This does not include the proposed funding of $25,000,000 by Baptist Health to build the new hospital. The Municipal Services Tax Unit (MSTU) and how much will it cost me? • The members of the Capital Campaign Committee and the Foundation Board proposed the idea of the MSTU to Baptist Health to help Baptist Health recoup some of their losses and to affirm community support for a new hospital. Baptist responded by saying if approved Baptist would start the process of building the new hospital now and not wait for the community to raise $15,000,000. • The special taxing district is capped at a maximum of % of 1 mil or 0.0005 of the assessed value of your property. • The taxing district is from mile marker 40 to 65. • This tax has to be voted on each year by the BOCC for a maximum of 10 years and would raise approximately $1,500,000 per year. • If the full millage rate is levied, the tax on a property with an assessed taxable value of $200,000 would be $100 for the year. Can the BOCC approve a tax without a vote from the people? •, Yes. We, the voters, elect our BOCC to manage the finances of our county, which includes adopting ordinances such as this to provide quality life- saving services. • This taxing district is exactly the sort of taxation With Representation that voters have elected our BOCC to undertake for public welfare. Individuals do not vote on every tax levied by the county, state, or federal government. Why would the BOCC opt for no referendum from the people? • With the expedited approval of the MSTU, Baptist Health is assured of the support from this community and has agreed to start the building process of the new hospital now and not wait for the community to raise 15 million. • Unanimous approval from: • The City of Marathon City Council via resolution. • The City of Key Colony Beach City Council via resolution. • The Rotary Club of Marathon. • The Marathon Chamber of Commerce. • American Legion Post 154. • Stirrup Key Homeowners Association. • Duck Key Homeowners Association. • Allows our County Commissioners to review the MSTU annually for a maximum of 10 years. • Allows them to consider public comments in open hearings each year during the budgetary process. • Factors such as pending hurricane insurance payouts and FEMA assistance still due can be incorporated into the annual analysis of actual tax revenue to be levied under this taxing district. Did Baptist Health have insurance? Yes, Baptist Health has insurance. To date, Baptist Health has not received any funds for storm - related claims. • If Baptist receives any insurance settlement claims from FEMA, the BOCC will have the opportunity to take that information into consideration during their annual review. What is the significance of today? • If the BOCC enacts the ordinance for the MSTU, Baptist Health has agreed to start the building of the new hospital now. If the BOCC does not enact the ordinance of the MSTU the building of the new hospital will start when the Capital Campaign Committee and the Foundation Board raise the $15,000,000. BOCC Meeting July 2018 Good Afternoon. My name is Alice Anderson. My husband, Larry 8t I are full - time residents of Marathon. I am here today to ask the Board of County Commissioners to NOT APPROVE the Taxing District Ordinance without a binding referendum vote. Everyone realizes the important of good health care in the Middle Keys. Residents and business owners of Marathon, Key Colony Beach and Duck Key have expressed their concerns as to why they are not being given the opportunity to vote on this issue. First, we were told these funds would be used to rebuild the hospital. Now, we are being told these funds must be used for Indigent Charity Care and to cover Baptist Health's operating losses. There are many unanswered questions! For example: Who is NOT paying this tax? Who has been given tax incentives? What is this money really being used for? Baptist Health has Tax Exempt Status. To maintain tax - exempt status, they are required by the State of Florida to provide Indigent Charity Care. They are being reimbursed by our Federal dollars through Medicaid and by many donations specified for this care. Are we paying for executive salaries, new equipment, real estate purchases and anything else Baptist Health decides to use it for? Are we expected to pay this tax to a tax - exempt organization that had a net income of $244 Million after expenses in 2017 and have net reserves of over 3 Billion? There is no transparency. People feel disillusioned. Why is this issue being put through when many residents are away for the summer months? Why are meetings being held at times of the day when residents who have jobs, cannot attend? This issue is TOO important to everyone and deserves to be voted on. The "NO REFERENDUM NECESSARY" Taxing District Ordinance option supported by Baptist Health and the BOCC is NOT acceptable. Since Baptist Health will not be receiving any funds until 2020, there must be other options available to the BOCC that could be considered. Some ideas that have been suggested are........ ** Monroe County could offer Baptist Health a loan at reasonable rates. Tax free bonds could be issued by Baptist Health at favorable rates. ** A' /4 to Y2 cent city sales tax could be added to all purchases made in the MM40 - MM65 area so everyone helps to pay this tax. Please reconsider your decision and give the voters the right to express their wishes by putting this to a binding referendum vote. I ask that this letter and all the signed forms of many concerned residents be included in the minutes and records of this meeting.
