ITEM BACKGROUND:
Quarry Partners, LLC, is requesting an extension to the reservation approved on September 27, 2017
by BOCC Resolution No. 213 -2017 for 104 Affordable Housing ROGO Allocation Awards pursuant
to the 380 Agreement with the state and municipalities to transfef' 104 Key West BPAS units to
Monroe County for the proposed .affordable housing project known as "the Quarry," at property
located at approximate mile marker 9, described as a. parcel of land in Section 21, Township 67
South, Range 26 East, Big Coppitt Key, Monroe County, Florida, having real estate numbers
.00120940- 000100, 00120940- 000201, and 00120940- 000302. The resolution reserved the.
allocations until July 1, 2018.
The reserved ROGO allocations are necessary for the development of 208 affordable housing
dwelling units, for which the applicant has an approved development agreement and an approved
major conditional use permit. The building permits for the proposed dwelling units have been
reviewed and approved by all plan review disciplines, and are contingent upon the extension of the
affordable ROGO allocation reservations.
PREVIOUS RELEVANT BOCC ACTION:
On September 27, 2017, the BOCC adopted Resolution 213 -2017 reserving one hundred and four
(104) dwelling unit allocations, pursuant to the 380 Agreement with the state and municipalities to
transfer 104 K_ey West BPAS units to Monroe County for the proposed affordable housing project
known as "the Quarry," by Quarry Partners, LLC, at property located at approximate mile marker 9,
described as a parcel of land in Section 21, Township 67 South, Range 26 East, Big Coppitt Key,

On January 17, 2018, the BOCC adopted Resolution 025A -2018, approving a development
agreement between Monroe County and Quarry Partners, LLC related to the proposed development

UNITS TO MONROE COUNTY FOR THE PROPOSEDAFFORDABLE
HOUSING PROJECT KNOWN AS "THE QUARRY," BY QUARRY
PARTNERS, LLC, AT PROPERTY LOCATED AT APPROXIMATE MILE
MARKE 9, DESCRIBED AS A PARCEL OF : LAND IN SECTION 21,
TOWNSHIP 67 SOUTH, RANGE 26 EAST, BIG COPPITT KEY, MONROE
COUNTY, FLORIDA, HAVING REAL ESTATE NUMBERS 00120940-
000100, 00120940- 000201, AND 00120940 - 000302, UNTIL JULY 1, 2019.
WHEREAS, the State of Florida and all local governments in the Florida Keys (each subject
to Area of Critical State Concern mandates rejating to housing affordability) recognize the need
for affordable housing throughout the state and particularly in the Florida Keys where developable
land for housing is extremely limited and expensive; and
WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys
is one requiring sensible and responsive use of residential unit allocations, including implementation
of long -term preservation mechanisms; and
WHEREAS, due consideration should be given to relevant factors such as the capacity
for allocation recipients to promptly transform allocation awards /reservations into finished and occupied
affordable housing units; and
WHEREAS, the developers have legitimate needs for some assurance that allocations are in
fact and will remain available and/or justified for a reasonable_ time so that follow - through on
initial commitments will in fact be justified; and
WHEREAS, in accordance with Section 138- 24(b)(2) of the Monroe County Land Development
Code allows the BOCC to authorize reservations for "specific affordable or employee housing projects
participating in a federal /state housing financial assistance or tax credit program or receiving some
form of direct financial assistance from the county upon written request from the project
sponsor and approved by resolution of the board of county commissioners," and
WHEREAS, the "THE QUARRY" project obtained Low Income Tax Credit Housing (L11iTC)
assistance for the development of the 96 units and the project is submitting for additional- LlliTC
assistance and State Apartment Incentive Loan program (SAII.) financing as part of its Two Hundred

3 WHEREAS, Key West has a certain number of unallocated BPAS units accumulated in years
4 one (1) through four (4) which the City desires to allocate to an Affordable Housing/Workforce Housing
5 project ( "The Quarry ") located on Big Coppitt Key, which is beyond the jurisdictional boundary
6 limits of Key West, and .

8 WHEREAS, Key West has approved a Comprehensive Land Use Plan Amendment which
9 - has been rendered to the Department of Economic Opportunity (DEO) for review and comment
10 pursuant to the State Coordinated Review Guidelines of Chapter 163, Florida. Statutes, which
11 would allow the transfer of 104 BPAS units to Monroe County for the Workforce Housing /Affordable
12 Housing Project known as "The Quarry," located on Big Coppitt Land Use 1 at approximate Mile
13 Marker 9, and

15 WHEREAS, a 380. Agreement is being entered into by and between the Department
16. of Economic : Opportunity (DEO), Monroe County, the City of Key West, Islamorada, Village of
17 Islands, the City of Layton, and the City of Marathon (the" Local Governments ") (all collectively
18 known as the "Parties ") for the purpose of Complying with Rules 28 -18, 28 -19, and 28 -20,
19: of the Florida Administrative Code, and as provided for in Section 380.032(3), Florida Statutes; and
20
21 WHEREAS, .upon effectiveness of the Comprehensive Land Use Plan of Key West and
22 the execution of the 380 Agreement by the Parties, the City of Key West shall transfer 104
23 previously unallocated BPAS units to Monroe County for "The Quarry" project on Big Coppitt
24 Key for the construction of workforce housing /affordable housing; and

26 WHEREAS, in the event building permits are not issued for "the Quarry" project on or
27 before June 30, 2019, the BPAS units awarded by Key West will remain with Monroe County as
28 affordable ROGO units to be awarded. by Monroe County. for Affordable/Workforce Housing
29 residential uses in Monroe County south of Mile Marker 26; and

On December 10, 2014, at a regularly scheduled meeting, the Board of County Commissioners
adopted Resolution 375 -2014, transmitting to the state land planning agency an ordinance amending
the FLUM for the subject property from MCF and I to COMM and MC.

On July 15, 2015, at a regularly scheduled meeting, the Board of County Commissioners approved
sending a request to the State Land Planning Agency requesting an extension of time to adopt the
Future Land Use Map amendments transmitted to the State Land Planning Agency on December 10,
2014 via Resolution 374 -2014 (two parcels on Key Largo) and Resolution 375 -2014 (for four
parcels on Rockland Key and one parcel on Big Coppitt).
On November 17, 2015; at a regularly scheduled meeting, the Board of County Commissioners
continued the public hearing for the proposed FLUM amendment from MCF and I to COMM and
MC and the corresponding subarea policy to February 10, 2016.
On February 10, 2016, at a regularly scheduled meeting, the Board of County Commissioners
adopted Ordinance 003 -2016 amending the Monroe County Future Land Use Map from Industrial
(1) to Commercial .(COMM) for property located at approximate: mile marker 9, described as four
parcels of land in Section 2.1, Township 67 South, Range 26 East, Rockland Key, Monroe County

COMMISSIONERS APPROVING THE RESERVATION OF ONE HUNDRED
AND FOUR (104) DWELLING UNIT ALLOCATIONS,. PURSUANT TO THE 380
AGREEMENT WITH THE STATE AND MUNICIPALITIES TO TRANSFER 104
.KEY WEST BPAS UNITS TO MONROE COUNTY FOR THE PROPOSED
AFFORDABLE HOUSING PROJECT KNOWN AS "THE QUARRY," BY
QUARRY PARTNERS, LLC AT PROPERTY LOCATED AT APPROXIMATE
MILE MARKER 9, DESCRIBED AS A PARCEL OF LAND IN SECTION 21,
TOWNSHIP 67 SOUTH, RANGE 26 EAST, BIG COPPITT KEY, MONROE
COUNTY, FLORIDA, HAVING REAL ESTATE NUMBERS 00120940- 000100,
00120940- 000201, AND 00120940- 000302, UNTIL JULY 1, 2018.
INMERE..AS, the State of Florida and all local governments in the Florida Keys (each subject to
Area of Critical State Concern mandates relating to housing affordability) recognize the need for
affordable housing throughout the state and particularly in the Florida Keys where developable land for
housing is extremely limited and expensive; and
WHEREAS, the challenge of providing affordable housing opportunities in the Florida Keys is
one requiring sensible and responsive use of residential unit allocations, including implementation of
long -term preservation mechanisms;
WHEREAS, due .consideration should 'be given to relevant factors such as the capacity for
allocation recipients to promptly transform allocation awards /reservations into finished and occupied
affordable housing units; and
WHEREAS, the developers have legitimate needs for some assurance that allocations are in fact
and will remain available and/or justified for a reasonable time so that follow- through on initial
commitments will in fact be justified; and
WHEREAS, in accordance with Section 138 of the Monroe County Land Development
Code allows the BOCC to ,authorize reservations for "specific affordable or employee housing projects
participating in a federal /state housing financial assistance or tax credit program 'or receiving some form
of direct financial assistance from the county upon written request from the project sponsor and
approved by resolution of the boardof county commissioners," and
WHEREAS, the "THE QUARRY" project obtained Low Income Tax Credit Housing (LIHTC).
assistance for the development of the 96 units and the project is submitting for additional LIHTC
assistance and State Apartment Incentive Loan program (SAIL) financing as part. of its, Two Hundred
Eight (208) dwelling unit proposed development; and
WHEREAS, Key West has a .certain number of unallocated BPAS units accumulated in years
one (1) through four (4) which the City desires to allocate to an Affordable Housing/Workforce Housing

project ( "The Quarry ") located on Big Coppitt Key, which is beyond the jurisdictional boundary limits
of Key West, and
WHEREAS, Key West has approved a Comprehensive Land Use Plan Amendment which has
been rendered to the Department of Economic Opportunity (DEO) for review and comment pursuant to
the State Coordinated Review Guidelines of Chapter 163 Florida Statutes, which would allow the
transfer of 104 BPAS units to Monroe County for the Workforce Housing /Affordable Housing Project
known as "The Quarry," located on Big Coppitt Land Use Area 1 at approximate Mile Marker 9; and
WHEREAS, a 380 Agreement is being entered into by and between the Department of
Economic Opportunity (DEO), Monroe County, the City of Key West, Islamorada; Village of Islands,
the City of Layton, and the City of Marathon ( the " Local Governments ") (all collectively known as the
"Parties ") for the purpose of Complying with Rules 28 -18,, 28 -19, and 28 -20, of the Florida
Administrative Code, and as provided for in Section 380.032(3), Florida Statutes; and
WHEREAS, upon effectiveness of the Comprehensive Land Use Plan of Key West and the
execution of the 380 Agreement by the Parties, the City of Key West shall transfer 104 previously
unallocated BPAS units to Monroe County for "The Quarry" project on Big Coppitt Key for the
construction of workforce housing /affordable housing; and
WHEREAS, in the event building permits are not issued for "the Quarry" project on or before
June 30, 2019, the BPAS units awarded by Key West will remain with Monroe County.as affordable
ROGO units to be awarded by Monroe County for Affordable/Workforce Housing residential. uses in
Monroe County south of Mile Marker 26; and
WHEREAS, the reservation of affordable housing allocations for the anticipated Project does
not exempt the project from applicable requirements in the Monroe County Comprehensive - Plan
(including the requirement for a development agreement), Land Development Code, Building Code, and
other regulatory requirements; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA:
Section .1: 104 total ROGO allocations are reserved for parcels of land in Section 21, Township
67 South, Range 26 East, Big Coppitt Key, Monroe County Florida, Having Real Estate Numbers
00120940.000100, 00120940.000201, and 00120940:000302 until July 1, 2018.
Section 2: The allocations shall be reserved upon the effectiveness of the Comprehensive Land
Use Plan of Key West and the execution of the Section 380.032 Agreement by the Parties.
