MODIFICATION #1 TO SUBGRANT AGREEMENT BETWEEN
THE DIVISION OF EMERGENCY MANAGEMENT AND
MONROE COUNTY
This Modification is made and entered into by and between the State of Florida,
Division of Emergency Management ( "the Division "), and Monroe County ("Sub -
Recipient"), to modify Contract Number Z0002, which began on September 4, 2017
( "the Agreement ").
WHEREAS, the Division and the Sub - Recipient have entered into the Agreement,
pursuant to which the Division has provided a Subgrant to Sub - Recipient under the
Public Assistance program of $2,858,535.94 in Federal funding; and,
WHEREAS, the Division and Sub- Recipient desire to modify the Agreement by
increasing the Federal funding by $524,114.82 under the Agreement,
WHEREAS, the Division and Sub - Recipient desire to modify the Agreement by
amending the period of performance for categories of work under the Agreement,
WHEREAS, the Division and the Sub - Recipient desire to modify the Scope of Work.
WHEREFORE, in consideration of the mutual promises of the parties contained
herein, the parties agree as follows:
1. The Period of Performance on page 1 of the agreement is hereby amended to
read as follows:
Subaward Period of Performance Start and End Date (Cat A -B): 9/4/17 - 3/10/18
Subaward Period of Performance Start and End Date (Cat C -G): 9/10/17- 3/10/19
2. Paragraph 8 of the Agreement is hereby amended to read as follows:
This Agreement shall begin September 4, 2017 and shall end on March
10, 2018 unless terminated earlier in accordance with the provisions of
Paragraph (17) of this Agreement. Consistent with the definition of "period
of performance" contained in 2 C.F.R. §200.77, the term "period of
agreement" refers to the time during which the Sub - Recipient "may incur
new obligations to carry out the work authorized under" this Agreement.
In accordance with 2 C.F.R. §200.309, the Sub - Recipient may receive
reimbursement under this Agreement only for "allowable costs incurred
during the period of performance." In accordance with section
215.971(1)(d), Florida Statutes, the Sub - Recipient may expend funds
authorized by this .Agreement "only for allowable costs resulting from
obligations incurred during" the period of agreement. rot
3. The Agreement is hereby amended to increase the Federal funding by
$524,114.82 for the total amount under the Agreement to be $3,382,650.76,
(three million, three hundred eighty -two thousand, six hundred and fifty dollars
and seventy -six cents).
4. The Exhibit 1 to the Agreement, is hereby modified as set forth in the 1st Revised
Exhibit 1 to this Modification, a copy of which is attached hereto and incorporated
herein by reference.
5. The Scope of Work, Attachment A to the Agreement, is hereby modified as set
forth in the 1st Revised Attachment A to this Modification, a copy of which is
attached hereto and incorporated herein by reference.
6. All provisions of the Agreement being modified and any attachments thereto
in conflict with this Modification shall be and are hereby changed to conform
with this Modification, effective as of the date of the last execution of this
Modification by both parties.
7. All provisions not in conflict with this Modification remain in full force and effect,
and are to be performed at the level specified in the Agreement.
IN WITNESS WHEREOF, the parties hereto have executed this Modification as of
the dates set out below.

that the information about Federal Programs and State Projects included on pg. 1 of this subgrant
agreement and in Exhibit 1 be provided to the Sub - Recipient.
