ITEM BACKGROUND:
Daniel McKearan, of Ducky Johnson Home Elevations, LLC, has requested approval of a resolution
by the Monroe County Board of County Commissioners authorizing the placement of temporary
emergency housing for emergency relief workers, for a period of 3 years, on property located at
31095 Avenue A, 31096 Avenue B, and vacant land on Avenue B, Big Pine Key pursuant to Monroe
County Land Development Code Section 103 -1(e). The temporary emergency relief worker housing
is to be occupied by up to 25 relief workers employed by Ducky Johnson Home Elevations, LLC
doing construction work on Hurricane Irma recovery projects. The applicant plans to have up to 10
emergency housing units, of no more than 600 square feet each, on the site.
Pursuant to Monroe County Land Development Code Section 103 -1(e), temporary emergency
housing may be provided for temporary occupancy by emergency relief workers involved in
reconstruction activities subject to certain conditions and approval of a resolution of the BOCC
authorizing the placement and duration of the temporary housing for relief workers.

3 WHEREAS, Monroe County experienced a natural disaster, Hurricane Irma, which
4 caused significant damage to residences, businesses and infrastructure throughout the County; and
6 WHEREAS, pursuant to Section 103 -1(b) of the Monroe County Land Development
7 Code, it is the purpose of this section to provide regulations that allow for the relaxation of the
8 use prohibitions in Chapter 130, Land Use Districts, and Chapter 138, Rate of Growth Restrictions
9 (ROGO/NROGO), to: (1) Provide regulatory authority to allow temporary emergency housing,
10 notsubject to the ROGO permit allocation system, for temporary occupancy by residents displaced
11 by natural or manmade disaster damage or by relief workers involved in reconstruction activities
12 following a natural or manmade disaster; and
13
14 WHEREAS, pursuant to Section 103 -1(a), temporary emergency housing means
15 recreational vehicles (or similar approved sheltering units) used for temporary occupancy in
16 response to natural or manmade disasters, including, but not limited to, hurricanes and tropical
17 storms, where such RVs (or other approved sheltering units) are provided to residents or relief
18 workers as part of emergency relief efforts; and recreational vehicle (R V) means the same as that
19 term is defined in F.S. § 320.01; and
20
21 WHEREAS, pursuant to Section 103 -1(e), temporary emergency housing may be
22 provided for temporary occupancy by emergency relief workers involved in reconstruction
23 activities subject to certain conditions; and
24
25 WHEREAS, the County has experienced significant damage to numerous homes, and
26 must utilize available locations to provide secure temporary housing for the disaster recovery of
27 the community; and

29 WHEREAS, Danny McKearan of Ducky Johnson Home Elevations, LLC, has requested
30 approval from the Board of County Commissioners to place temporary emergency housing for
31 emergency relief workers on the subject property;

33 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
34 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

36 Section 1. Placement. The property located at 31095 Avenue A, 31096 Avenue B, and
37 Vacant Land on Avenue B, Big Pine Key, Monroe County, Florida, Having Parcel ID Numbers
38 00301580- 000100, 00301590- 000000, and 00301590- 000100 is hereby approved forplacement
39 of temporary emergency housing for emergency relief workers pursuant to Section 103 -1(e) of the
40 Land Development Code.

Section 2. Duration. The temporary emergency housing may remain on the subject
Property for three (3) years from the date of this resolution. The duration may only be extended at
the discretion of the BOCC by an additional resolution.
Section 3. Conditions. The temporary emergency housing for emergency relief workers
placed on the subject Property shall comply with all conditions within Section 103 -1(e) of the Land
Development Code.

Let me start by saying the folks we've come across in Monroe County have been extremely helpful and kind
throughout our involvement during the last few months, and we appreciate the consideration for the opportunity
to have temporary relief worker housing in Monroe County as a result of Hurricane Irma.
As you are probably aware, we recently completed a home lift project in Key West (see article in the Citizen
attached). Prior to and especially after this lift we have had a large number of request for estimates to be given
to perform more of this type of work and ancillary services. A major hurdle in this effort is the housing of the
crews, superintendents and support staff during operations. (It is worth noting that the most recent raising
project was performed during the slower season and therefore we could get hotels within a weeks notice... But
that looks like it may not be the case during the lowering phase of this project).. Its worth noting that although
we are a national company with our main office in Harahan, Louisiana, the majority of our employee workforce
for the house lifting side comes from the panhandle of Florida in Grand Ridge, Florida which is only a 1/2 days
drive for our crews from home to Monroe County. In addition to House Raising, Ducky Johnson Recovery is a
residential disaster recovery company. We are on the tail end of a 5 year project following Hurricane Sandy in
New York / New Jersey in which we perform House Lifting Services as well as full residential turn key repairs.
We are fully committed to helping Monroe County in this recovery and are under contract to purchase land for
the purpose of have an office / yard / temporary relief worker housing. It is at 30195 Avenue A and 31096
Avene B and A &B vacant land (ive attached picture of land and dimensions, the building was heavily damaged
during Irma)... Total property is just under 1/2 acre. It is for this address that we would like to be able to bring
in RV units to house our temporary relief workers.
1. I have reviewed and am willing to comply with MCC Section 103 -1 (e)
2. Our company is familiar with the correct installation of FEMA trailer installs and tie downs in high wind
zone areas having completed over 100 most recently in Baton Rouge, Louisiana following its flood event.
3. My request would be for housing for a maximum of 25 workers at this location... all folks onsite will be
directly involved in the relief efforts.
4. I would like to make this request for 3 years.

Crews on Eagle Avenue are working to elevatethe first concrete block structure in the Florida
Keys to ensure the home sits above the required — and insurable — flood plain elevation
"Wooden structures are relatively simple to elevate," explained General Contractor Mike
Wattner, president of Perfection Commercial Roofing and Construction, pointing out giant steel
1 -beams that were fitted underneath a wooden portion of the home on Eagle Avenue near 18th
Street. "You can get the steel beams underneath the wooden beams and raise it up."
But with concrete block structures, industrial saws are used to cut through the bottom layers of
concrete blocks and then jack up the home, Wattner said, adding that he had subcontracted
with a nationwide company called Ducky Johnson Home Elevators to complete the elevation
on Eagle Avenue.

"This is the first concrete structure to be raised in the Keys, but the guys from Ducky Johnson -
have done hundreds of them throughout the country," Wattner said. "From start to finish, it took
about four days to cut it apart and raise it up."
He said the homeowner, Peter Batty, Jr., had been all set to move into the home on Eagle
Avenue, but arrived one day to find a red tag due to insufficient floodplain elevation.The home,
which now sits on a temporary foundation of steel I- beams, is currently five feet higher than it
was, but it will be lowered back down two feet.
"So the finished product will be 36 inches higher than it was," Wattner said. "This house had
one section made of wood and one made from concrete block, so this was sort of a
combination project and then we'll fill in beneath it."
Wattner estimated that the cost of elevating a home depends on a number of variables, but
typically ranges from $70,000 to $250,000.

greatly increased the demand for repairs and replacement housing. Due to this increased demand coupled
with the limited resources and labor market, there is demand for temporary housing for emergency relief

Section 103 -1(e):
(e) Placement of temporary emergency housing for emergency relief workers. Notwithstanding the provisions
of Chapter 130, Land Use Districts, and Chapter 138, Rate of Growth Restrictions (ROGO /NROGO),
temporary emergency housing may be provided for temporary occupancy by emergency relief workers
involved in reconstruction activities, subject to the following conditions:
(1) An emergency directive or resolution of the BOCC must be issued authorizing the placement and
duration of the temporary emergency housing for relief workers;
(2) Placement of temporary emergency housing for relief workers must not impede or interfere with
other emergency and recovery operations or public safety;
(3) Temporary recovery or reconstruction housing facilities shall ensure that temporary electrical and
sewage lines do not constitute an attractive nuisance to children or homeless persons in the area
(i.e., sufficient temporary fencing may be required by the Building Official);
(4) A no -fee building permit must be issued for the placement of the temporary emergency housing
unit(s). The building permit shall require approval by the Building Official and the Planning
Director of a site plan indicating the location of the temporary emergency housing unit(s) on the
parcel, consistent with the BOCC resolution, and a Department of Health permit authorizing the
connection of the unit(s) to an on -site wastewater treatment and disposal system(s) or to an existing
community wastewater treatment system;

(5) Any required demolition or building permits for the related reconstruction activities must be issued
within 90 days from the placement of the temporary emergency housing for relief workers;
(6) The temporary emergency housing unit(s) may remain on the site for a period not to exceed the
duration specified by the BOCC resolution, and may only be extended at the discretion of the
BOCC by an additional resolution. However, nothing in this section shall prevent the county or
any state or federal authority to terminate without notice the authority to keep any temporary
emergency housing unit otherwise authorized under this section should it be deemed required for
the public safety;
(7) The only persons permitted to reside for any period in temporary emergency housing for relief
workers are individuals who are gainfully employed on a fulltime basis in completing cleanup and
reconstruction efforts following a natural or manmade disaster. All residents of temporary
emergency housing for relief workers who were not permanent residents of the county prior to first
occupying such housing facilities will be required to evacuate in accordance with local evacuation
orders. Residents of any temporary emergency housing for relief workers who were permanent
residents of the county prior to first occupying such housing facilities may not remain in temporary
emergency housing for relief workers during any period when a local evacuation order is in effect.

III. ANALYSIS
Pursuant to Monroe County Land Development Code Section 103 -1(e), temporary emergency housing
may be provided for temporary occupancy by emergency relief workers involved in reconstruction
activities subject to certain conditions and approval of a resolution of the BOCC authorizing the placement
and duration of the temporary housing for relief workers.
The proposed resolution specifies the requested placement and duration of the temporary emergency
housing for emergency relief workers.
IV. STAFF RECOMMENDATION
Staff recommends approval of the proposed resolution.
