AGENDA ITEM WORDING: Approval of sole source acquisition and purchase of a fitness
circuit training court for Bernstein Park. The unique fitness court manufactured by the National
Fitness Campaign will cost $78,450. Funding will be from Ad Valorem.
ITEM BACKGROUND: Bernstein Park did not have enough space to install a fitness trail due to
safety setbacks adjacent to the sports fields. An area in Bernstein Park has been identified where a
fitness circuit training court could be installed west of the basketball court. Several conceptual plans
for a fitness court were considered. The fitness court recommended by staff is available through the
National Fitness Campaign (NFC). The circuit equipment have minimal moving parts by utilizing
body weight for resistance and can accommodate up to twenty -eight users. The unique product and
equipment, low maintenance of equipment, broad range of uses, and ease of installation were
considerations when making the recommendation. The fitness court also is suited for Bernstein Park
as a mutigenerational park. The cost of the equipment is $90,000, plus $3,450 for shipping and
freight, less a $10,000 grant from NFC and a $5,000 credit from Sport Floor materials, for a total
cost of $78,450. There is no other overall proposal package and product similar to that offered by
NFC. Monroe County Purchasing Policy Ch. 7 A. provides for this purchase from a sole source may
be exempted from formal competition or price quote requirements due to the nature of the goods and
the equipment capability. There is no comparable overall package in the market. Staff recommends
approval to sole source this product manufacturer direct and benefit from the grant and credit.
