AGENDA ITEM WORDING: Approval to accept proposal from the Florida League of Cities
(FLC)/Florida Municipal Insurance Trust (FMIT) to provide General Liability, Vehicle Liability and
Vehicle Physical Damage, Public Officials/Employee Practices Liability and Excess Workers'
Compensation (WC) Insurance coverage and authorization for the Risk Administrator to execute any
necessary related documents.
ITEM BACKGROUND:
The County publicly advertised a request for proposals for General Liability, Vehicle Liability and
Vehicle Physical Damage, Public Officials /Employee Practices Liability and Excess WC Insurance
coverage. The County received two responses: one from FLC, which submitted a proposal from
FMIT (the County's current provider of these insurances); the other from World Risk Management
(WRM), which submitted a proposal from Public Risk Management (PRM). An Evaluation
Committee was established and met on August 27, 2018, to evaluate the proposals. After thorough
review and analysis of the two proposals, the Committee unanimously ranked FLC's proposal first.
The Committee recommends that the BOCC approve and select FLC's FMIT proposal. In summary,
the FMIT policies provide the County with the following:
➢ Premises and Operations Liability with a per occurrence limits of $5 million and a self -
insured retention of $200,000. This is consistent with the expiring policy.
➢ Public Officials and Employment Practices Liability with a per occurrence limit of $5
million and a self - insured retention of $200,000. This is consistent with the expiring
policy.
➢ Cyber Liability with per occurrence limits of $1 million and deductibles ranging from
$10,000 to $35,000. The expiring program has limits of $500,000 and the same
deductibles.
➢ Vehicle Liability with a per occurrence limit of $5 million and a self- insured retention of
$200,000. This is consistent with the expiring policy.
➢ Vehicle Physical Damage with limits equal to the Actual Cash Value (ACV) of the
vehicle and a per occurrence deductible of $1,000.
➢ Statutory WC coverage subject to a self - insured retention of $500,000.
➢ Employers Liability with limits of $ 1,000,000 /$1,000,000 /$1,000,000 with a self- insured
retention of $500,000.
The current premium for the County's Liability and Excess WC policy is $744,053. WRM's
proposal offered a premium of $587,172 for this policy. FLC's proposal offers a premium of
$471,776 for this policy. One major factor in determining WC premiums is the organization's
Experience Modification Factor (EMR). An EMR indicator is the adjustment of annual premium
based on the organization's previous loss history. WRM's and FLC's proposal were based on a
County EMR of 1.65. The factor goes up if there have been WC losses and claims paid. The County
recently received a new EMR of 1.21 that will take effect on 10 /l /18. The new EMR should result in
a lower WC premium. The exact amount of reduction cannot be determined at this time.
PREVIOUS RELEVANT BOCC ACTION: BOCC approved advertisement of the RFP on May
16, 2018, for the insurance policies described in this AIS. These insurance policy insurance
coverages' were initially procured through a bid solicitation in 2014 then the BOCC approved
renewals of these coverages in 2015, 2016, 2017.
CONTRACT /AGREEMENT CHANGES:
Florida League of Cities /FMIT has proposed to renew the 2018 -2019 program for an annual
premium of $471,776. The premium represents a reduction of $272,277 (37 %).
STAFF RECOMMENDATION: Approval to accept insurance proposal from FLC at a cost of
$471,776.00 to be paid in four quarterly installments for the period of October 1, 2018 to September
30, 2019, and approval to pay any premium increase that results from the County's EMR increase, if
any, and approval of the Risk Administrator to execute any necessary related documents.

The County's Liability and Excess Workers' Compensation insurance expires on 9/30/19. The coverages

were viewed as being significant and the level of protection being provided will be consistent with that
which is currently being purchased. One significant enhancement being offered by the FMIT is an increase

In summary and subject to the BOCC's approval, the County will renew its Liability and Workers'
Compensation coverage with the Florida Municipal Insurance Trust as being proposed by the Florida
League ofCitics for the policy period of 10/1118 to 9/30/19. This will result in maintaining the level of
[)rotection being purchased while reducing the cost of the coverage by $272,277.

program and the proposals being proposed by the Florida League of Cities and World Risk Management.
