13 COUNTY COMMISSIONERS APPROVING THE
14 RESERVATION OF FIFTY -SEVEN (57) AFFORDABLE
15 HOUSING DWELLING UNIT ROGO ALLOCATIONS
16 CONSISTING OF TWENTY -SIX (26) LOW INCOME AND
17 THIRTY -ONE (31) MODERATE INCOME ROGO
18 ALLOCATIONS, FOR A PROPOSED DEVELOPMENT BY
19 ROCKLAND OPERATIONS, LLC AND ROCKLAND
20 RECYCLING CENTER INC., AT PROPERTY LOCATED AT

34 WHEREAS, the State of Florida and all local governments in the Florida Keys (each
35 subject to Area of Critical State Concern mandates relating to housing affordability) recognize the
36 need for affordable housing throughout the state and particularly in the Florida Keys where
37 developable land for housing is extremely limited and expensive; and

1 WHEREAS, the challenge of providing affordable housing opportunities in the Florida
2 Keys is one requiring sensible and responsive use of residential unit allocations, including
3 implementation of long -term preservation mechanisms; and
4
5 WHEREAS, due consideration should be given to relevant factors such as the capacity for
6 allocation recipients to promptly transform allocation awards /reservations into finished and
7 occupied affordable housing units; and
8
9 WHEREAS, the developers have legitimate needs for some assurance that allocations are
10 in fact and will remain available and/or justified for a reasonable time so that follow - through on
11 initial commitments will in fact be justified; and
12
13 WHEREAS, in accordance with Section 138- 24(b)(2) of the Monroe County Land
14 Development Code allows the BOCC to authorize reservations for "specific affordable or
15 employee housing projects participating in a federal/state housing financial assistance or tax credit
16 program or receiving some form of direct financial assistance from the county upon written request
17 from the project sponsor and approved by resolution of the board of county commissioners," and
18
19 WHEREAS, Rockland Operations, LLC and Rockland Recycling Center Inc. noticed
20 Monroe County of its intent to apply to the Florida Housing Finance Corporation ( "FHFC ") for
21 Low Income Housing Tax Credit ( "LIHTC ") financial assistance to offset the costs of its proposed
22 57 -unit development ( "Project "); and
23
24 WHEREAS, as part of the LIHTC application, FHFC requires the applicant to have
25 obtained the necessary ROGOs and for Monroe County to execute a verification that verifies that
26 the applicant has obtained the necessary ROGOs; and
27
28 WHEREAS, Monroe County Code Sec.138 -24(b) allows reservation of affordable ROGO
29 allocations by the Board for specific housing programs, which includes FHFC, LIHTC and SAIL;
30 and
31
32 WHEREAS, the reservation of affordable housing allocations for the anticipated Project
33 does not exempt the project from applicable requirements in the Monroe County Comprehensive
34 Plan (including the requirement for a development agreement), Land Development Code, Building
35 Code, and other regulatory requirements; and
36
37 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
38 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

40 Section 1. The foregoing recitals are true and correct, and are hereby incorporated as if
41 fully set forth herein.

43 Section 2. Fifty -seven (57) total ROGO allocations consisting of twenty -six (26) low
44 income and thirty - one (31) moderate income affordable ROGO allocations are reserved for parcels
45 of land in property located at approximately mile marker 9, on the north side of Rockland Key,
46 described as a parcel on land in Section 21, Township 67, Range 26, Rockland Key, Monroe

1 County, Florida, having Parcel ID Numbers 00122081 - 000300, 00122081 - 000400, 00122070-
2 000100, 00121980 - 000500, 00121980 - 000600, 00122070 - 000103, 00122070 - 000109, 00122040-
3 000100, 00122081 - 000500, 00122080 - 000500, and 00122040 - 000000, until September 18, 2020.

5 Section 3. The developer must obtain building permits for all fifty -seven (57) affordable
6 housing units on or before September 18, 2020.

8 Section 4. The developer shall comply with all Monroe County requirements, all applicable
9 Building Code requirements, and the requirements of any other oversight agencies.

11 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
12 Florida, at a regular meeting held on the 17th day of October , 2018.
