AGENDA ITEM WORDING: Approval of First Amendment to Lease Agreement with the
Monroe County Sheriffs Office (MCSO) increasing the size of vacant land to be leased to MCSO at
the Florida Keys Marathon International Airport from 7,200 sq. ft. to 17,860 sq. ft. for MCSO to
construct a shooting range facility for law enforcement /qualification purposes. Total rent will
increase from $21,600 /yr. to $53,580/yr.
ITEM BACKGROUND: MCSO has a need for a buildable parcel to construct a facility for law
enforcement training/qualification purposes. A suitable location for this facility is available at
Marathon Airport. Additional square footage has been requested in order to accommodate the
development.
PREVIOUS RELEVANT BOCC ACTION:
Approval of original lease with MCSO on October 18, 2017.
CONTRACT /AGREEMENT CHANGES:
Adds 10,660 square feet of additional land space which increases annual rent by $31,980.00

FIRST AMENDMENT TO LEASE AGREEMENT

THIS FIRST AMENDMENT (hereafter Amendment) is made and entered into on this
19th day of September, 2018, by and between MONROE COUNTY, a political subdivision of
the State of Florida, hereinafter referred to as "Lessor" or "County ", whose address is 1100
Simonton Street, Key West, FL 33040, and the SHERIFF of Monroe County, a constitutional
officer, hereinafter referred to as "Lessee" or "Tenant" whose address is 5525 College Rd., Key
West, Florida 33040.
WHEREAS, on the 18'' day of October 2017, the Lessor entered into a lease (hereafter
Original Lease) with the Lessee for a parcel of land for development of a shooting range and
office at the Florida Keys Marathon International Airport; and
WHEREAS, the Original Lease was for a parcel of 7,200 square feet, and
WHEREAS, the Lessee needs and is requesting additional land space in order to
accommodate Lessee's development; now, therefore
IN CONSIDERATION of the premises and of mutual covenants and promises hereinafter
contained, the parties hereto do hereby agree as follows:
SECTION 1. ARTICLE 1 — Premises of the Original Lease is amended to read as follows:
1. Premises.
The County hereby leases 17,860 sq. ft. located at the Florida Keys Marathon International
Airport as shown on Exhibit A (dated September 19, 2018) to be used by the tenant for law
enforcement training/qualification purposes. The premises are leased in an as is condition. The Tenant
may develop the premises to accommodate a shooting range and office. The Tenant shall be entitled
to use, in common with others authorized to do so, the Airport and appurtenances, together with all
facilities, equipment and parking areas.
SECTION 2. ARTICLE 4 - Rent of the Original Lease is amended to read as follows:
4. Rent.
The initial rent for the premises during design, development and construction shall be a one -time
payment of $1,800.00 due and payable 30 days after execution of this lease by the County.
Thereafter, beginning on the first day of the month following receipt of the certificate of occupancy
the rent for the premises shall be $53,580 per year (pro -rated for the initial year of occupancy) and
shall be due and payable on or before the 15th day of January. Rental rates thereafter will be
increased by a percentage equal to the percentage increase in the CPI -U for all urban consumers for
the previous calendar year. In the event of a deflationary CPI, no adjustment in the rental rates will
be made.
SECTION 3. Except as set forth in Section 1 and 2 of this First Amendment to Lease Agreement,
all other provisions of the October 18, 2017 Original Lease not inconsistent herewith, remain in
full force and effect.
