ITEM BACKGROUND: The State Expenditure Plan took five years to develop, and was made official on October 1, 2018 with the final approvals of the Governor's Office and the Gulf Coast Ecosystem Restoration Council. This plan serves as the guiding document for the expenditure of $291M (Pot 3 RESTORE Act funds) awarded to the State of Florida to restore the Gulf's water quality and habitat. The Plan was developed by the "Gulf Consortium," which represents the 23 Florida counties on the Gulf of Mexico that were either directly or indirectly impacted by the Deepwater Horizon Oil Spill disaster in 2010, formally organized in 2012. The oil spill disaster led to the passage of the RESTORE Act that authorized the distribution of funds from Clean Water Act civil and administrative penalties paid by BP and others involved among the five Gulf States impacted by the spill. Commissioner Neugent served as Monroe's representative on the Gulf Consortium, since its inception in 2012. For almost 5 years, Commissioner Neugent has served as a member of the Consortium's Executive Committee. As a member of Executive Committee, Commissioner Neugent was integrally involved in the development of the State Expenditure Plan ( "Plan "), in ways that not only strengthened the overall quality of the Plan, but also specifically (and significantly) benefited Monroe County. Commissioner Neugent advocated strongly for an equal distribution of funds among the 23 counties, that resulted in $12.6M for Monroe, over a distribution formula that did not favor smaller, less impacted counties like Monroe, and would have resulted in a far smaller funding amount. Commissioner Neugent was also instrumental in the Consortium's bottom -up approach to project selection rather than a top -down decision - making process, enabling each County to select its own projects for inclusion in the Plan, and thus enabling Monroe's canal restoration projects to be included and funded. The RESTORE Act funds coming to the State of Florida and flowing through the State Expenditure Plan to the 23 Gulf Counties are subject to a 15 -year payout plan. Thus, Monroe's allocation of $12.6M will be distributed annually, subject to the Consortium's agreed upon project funding sequencing schedule (annual payments to Monroe range from $725,000 to $2,000,000.) We expect to be able to begin applying to drawdown these funds by approximately April 2019. PREVIOUS RELEVANT BOCC ACTION: • In November 2016, the BOCC approved the inclusion of canal restoration projects in the State Expenditure Plan and the entire allocation of Monroe's share of Gulf Consortium pot funds ($12.6m) to canal restoration projects (Resolution 276 - 2016). • From 2013 through 2018, the BOCC approved Commissioner Neugent to serve as Monroe County's representative on the Gulf Consortium, and since 2014, to serve as an elected member of the Consortium's Executive Committee. • On September 21, 2012 Monroe County joined the Gulf Consortium by approving the Inter -local Agreement to participate in a consortium of counties to develop a state -wide plan for RESTORE Act funding (Resolution 246- 2012).
