property located at 194 Buttonwood Ave., Key Largo Florida, to seek compliance with the County
Codes and enforce a lien arising from code compliance case number CE09120165.
ITEM BACKGROUND: This property is the subject of a Code Compliance case for the failure to
remedy the unsafe condition of a mobile home and failure to clean up the property. As a result, the
property owner was cited with violating three (3) County Ordinances on January 19, 2010. On
February 26, 2010 the Code Compliance Special Magistrate entered a Final Order approving a
Stipulation Agreement between Ms. Walters and the County, accepting it's agreed upon terms.
Compliance was not achieved by the agreed upon date. Therefore, the County's lien was recorded
on August 23, 2010.
Compliance would have been achieved by either obtaining a permit to demolish the offending unsafe
structures /structural parts, or obtaining approvals, permits and inspections to bring the unsafe
structures /structural parts current with existing codes as directed. All attempts by several staff
members and several different agencies to persuade the property owner to achieve compliance have
failed for several years.
The mobile home continued to deteriorate and was essentially uninhabitable. Eventually the electric
service was disconnected, however the family members continued to reside on the property until a
fire on February 19, 2018 fully destroyed the structure. The debris remains on the property. In an
attempt to persuade Ms. Walters to clean up the property, another hearing was scheduled for July 26,
2018, and Ms. Walters attended.
However the violations remain. The code case remains open for non - compliance and failure to pay
outstanding fines and costs. The County has exhausted all other mechanisms available to persuade
the property owner to achieve compliance. The property is no longer homesteaded and there are nc
pending foreclosure actions at this time.
As of September 24, 2018 the fines have accrued for 2985 days for a fine total of $746,250.00, and
will continue to accrue at $250.00 per day until compliance is achieved. Additionally, per F.S.
§162.07(2), if the local governing body prevails in prosecuting a case before the enforcement board,
it shall be entitled to recover all costs incurred in prosecuting the case before the board and such
costs may be included in the lien authorized under s. 162.09(3). To date these costs are $1,262.26
and continue to accrue until the case is closed.
Under the policy adopted in Resolution 057 -2014 the available legal options in regard to the
County's lien on this property are:
1. Initiate litigation against the property owner for injunction, foreclosure, money judgment and
writ of execution;
2. Allow the liens to remain against the property owner, the subject property and any other
property owned by the property owner; and /or
3. Reduce the amount of the fines.
County staff recommends initiating litigation (option 1) against the property owner for injunction,
foreclosure, money judgment and writ of execution.
PREVIOUS RELEVANT BOCC ACTION: Approval of Resolution No. 057 -2014 on March 19,
2014 adopting "ATTACHMENT A" as Procedure to be used after a Final Order has been rendered
by the Code Compliance Special Magistrate to initiate injunctive relief for non - compliant properties,
foreclosure and /or money judgment actions for collection of unpaid fines and /or costs from a
property owner.

RE: Nuisance Investigation
Property located at 194 Buttonwood Lane, Key Largo, Monroe County, Florida
Dear Ms. Windsor,
In response to your request, the Florida Department of Health in Monroe County conducted an
investigation of the conditions present at the property located at 194 Buttonwood Lane, Key Largo,
Florida on April 19, 2013. A preliminary file review indicated that the property was connected to the
central sewer system and the onsite wastewater system had been abandoned.
Dustin McCabe and I attempted to conduct an onsite inspection of the property. Upon arriving,
We spoke with a person identifying herself as Jill Walters. She was in her car and she appeared to be
leaving. We asked for permission to look around the property but were graciously denied access.
The following is the substance of the conversation that ensued on the street in front of the
property between Jill Walters, Bill Brookman and Dustin McCabe from approximately 2:00 PM to 2:20
PM on April 19, 2013:
When asked how she was feeling, Jill described her health condition In this way. °I am suffering
from deep depression....off the charts .... I take Wellbutrin. I have Bell's Palsey and allergies. I have
ADHD and so do my sons." Dustin and I saw evidence of Bell's Palsey while conversing with Jill.
We asked if there was mold in the house. She replied, "yeah, just like everyone else". She was
asked if the roof leaked, she said "yes ". This is an indication of water intrusion in the residence which
is associated with mold growth.
Jill was asked if the toilet worked. She said her sons were in the process of repairing the floor
and the toilet did not work at this time. When asked, what do you use for a toilet in the meantime, she
replied that they use the restrooms at Arby's or Publix . We asked if she had a port-a -potty in the back
yard. She said yes. We asked if she had someone pump it out. She seemed confused by the question.
We described what a port-a -potty was and she said it wasn't like that. It was a small thing with handles.
We took this to mean a bed pan. We asked, what do you do with the excrement? She said they
carefully wrap it in newspaper and double bag it in plastic. It is then put in the garbage pail for pick up.
We asked her if she had rats in the house. She replied, "yes, just like everybody else". From
our vantage point in the road in front of the property, we were able, by plain view observation, see
conditions that might harbor rodents: debris, automobiles, plant waste, etc. Also, it appears that the
trailer's building envelope is compromised.

At 2302 hours on Sunday February 18, 2018 we were dispatched to a fire in a mobile
home used as fixed residence. Four units were assigned to this incident. Three personnel
responded. We arrived on scene at 2316 hours and cleared at 0319 hours. The incident
occurred at 194 BUTTONWOOD AV 10 1.5, KEY LARGO. The local station is 24. The
general description of this property is 1 or 2 family dwelling. The primary task(s)
performed at the scene by responding personnel was extinguishment. Mutual aid was given
on this incident.
