PUBLIC HEARING AGENDA ITEM WORDING: A public hearing to consider approval an ordinance to revise Monroe County Code Section 18 -27(h) to increase the fee for use of the boat ramp at Harry Harris Park to $30 per watercraft trailer by non - county residents on Federal holidays, weekends, and the two days of lobster mini - season. ITEM BACKGROUND: The boat launch fee at Harry Harris Park has been the same for a decade or more. Local fees at commercial ramps in the area now range from $20 -$30 /vessel. The County's park expenses have increased over the years and a second employee has been added to work the boat ramp during peak periods. The County's fees should mirror the local businesses' fees to avoid undercutting the local businesses. The fees will not be charged to County residents with proof of residency. Fees charged at other local ramps: Founders' Park: $30 Mangrove Marina: $30 Caribbean Club: $20 Boat Ramp at MM 107: $30 PREVIOUS RELEVANT BOCC ACTION: 9/19/18 (C -16) BOCC scheduled a public hearing on October 17, 2018, in Marathon, FL, at 3:00 P.M. or as soon thereafter as may be heard. Shall be amended as follows: (h) Admission fees (noncounty residents oily). On Federal holidays., an weekends, and the two day_annual lobster mini-season, the admission fee for Harry Harris Park is $5.00 per person plus an additional $10.00 $30.00 boat ramp fee for watercraft vessels with trailers. SECTION 2: SEVERABILITY. If any portion of this ordinance is for any reason held invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be inapplicable to any person, property or circumstances, such holding shall not affect its applicability to any other person, property or circumstances. SECTION:i_ WITH OTHER ORDINANCES. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. SECTION 4: INCLUSION IN CODE OF ORDINANCES. The provisions of this ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform numbering system of the Code. SECTIONS-, ITTAL AND EFFECTIVE DATE. This Ordinance shall be filed with the Department of State and shall be effective as provided in Section 125.66(2), Florida Statutes.
