C2 Task Order Amendment No. 2 with T.Y. Lin International/HJ. Ross for an
additional $124,118.00 for planning and architectural services required to place the proposed
chiller building on Jackson Square within the City of Key West Historic District and suspending all
further services associated with the relocation of the Communication Tower. This task order is
funded du-ough the one -cent infrastructure sales tax. Enclosed is a duplicate original.
C3 2 Amendment to the Construction Manager at Risk (CMAR) Agreement with
Biltmore Construction Co. Inc., to incorporate the Guarantee Maximum Price of $32,818,441.14
for the Plantation Key Judicial Courthouse and Detention Facility into the CMAR Agreement.
The project will be co- funded by the 2014 Revenue Bond and the One Cent Infrastructure Sales
Tax. Enclosed are two duplicate originals.
C22 Task Order with Bender & Associates Architects, P.A. for $174,688.00 for
planning and architectural services required to construct a communication tower within the City of
Key West Historic District which replaces the communications tower atJackson Square on the
Jefferson Browne Building. Attached is an electronic copy.
C25 2"d Amendment to the Consultant Agreement for Professional Engineering and
Surveying Services with Perez Engineering and Development, Inc., to include a link for applicable
grant information as required by the federal contract provisions. Attached is an electronic copy.

PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES
BETWEEN MONROE COUNTY AND BENDER & ASSOCIATES ARCHITECTS, P.A.
FOR JEFFERSON BROWNE COMMUNICATION TOWER RELOCATION
KEY WEST, FLORIDA
In accordance with the Consultant Agreement for Professional Architectural and Engineering
Services, made and entered into on the 21' day of January, 2015, and as first amended on the 18
day of January, 2017, and as second amended on the 19 day of April, 2018, between MONROE
COUNTY, hereinafter referred to as the "County," and BENDER & ASSOCIATES
ARCHITECTS, P.A., hereinafter referred to as "Consultant," where professional services are
allowed if construction costs do not exceed Two Million and 00 /100 ($2,000,000.00) Dollars, or
for study activity if the fee for professional services for each individual study under the contract
does not exceed Two Hundred Thousand and 00 /100 ($200,000.00) Dollars, (hereinafter referred
to as the "Agreement ").
All terms and conditions of the referenced Agreement apply to this Task Order, unless this Task
Order amends, adds, or modifies a provision or an Article of the Agreement of which will be
specifically referenced in this Task Order and the amendment, addition, or modification shall be
precisely described. These additions apply only to the project referenced in this Task Order.
This Task Order is effective on the 1"1 h of ()thaw , 2018.
The County desires the Consultant to provide architectural services for a new 200 foot high
_ communications tower in Key West, Florida. The communications tower will be located on a lot
adjacent to the existing City Parking Garage at 300 Grinnell Street. This property is currently
owned by The Utility Board of the City of Key West and is occupied by a parking deck structure.
The new tower is not expected to conflict with the existing use and the legal approvals for use of
the land will be coordinated by Monroe County. In addition to the tower, an air - conditioned
equipment room will be required, as well as a back -up generator and UPS battery system for power
outages. The back -up generator will be diesel powered, and will have a run time of 3 -5 days.
Due to space constraints and setbacks, the equipment room and generator will likely have to be
located on the top floor of the existing parking garage adjacent to the site. Consultant will evaluate
the structural adequacy of supporting the new equipment shelter and diesel generator. The fuel
tank for the generator will likely have to buried on the site, to allow for fuel truck access.
Consultant will assist in both the design of the tower and in obtaining local planning approvals
including, but not limited to, the following: HARC approval, DRC approval, Planning approval,
and City Commission approval (if applicable). At the completion of the planning approval process,

Consultant will prepare the Construction Drawings and Specifications for permitting & bidding,
with subconsultants assisting as required. Consultant will retain a telecommunications consultant
to design an antenna system for the new tower. Due to the location of the proposed Tower in Old
Town Key West, the use of a local Planning Company is essential, and will play an important part
in the project. As such, a subconsultant specializing in planning services will be retained. During
construction, Consultant will also provide Construction Administration services as required.
1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Professional
Architectural and Engineering Services Agreement, the Consultant will perform services
as described below:
a. Phase 1 - Schematic Design, Design Development, and Planning Approvals:
The first phase of the project will consist of Schematic Design, Design
Development, and required Planning Approvals. Consultant will develop a tower
design that meets all of the program requirements. At the completion of the Design
Development process, Consultant, with assistance from subconsultants, will work
with the City of Key West to determine what approvals will be necessary to move
the project forward (DRC review, Planning Board Approval, HARC, etc.). The
project will require DRC review, at least one (1) variance, and approval by the
Planning Board, and the City Commission. Consultant will take the lead on
obtaining the required design approvals. Also included in Phase I are the following:
i. Determine and evaluate existing underground piping and utilities to avoid
conflict with new tower foundation.
ii. Investigate location and provide a new communication equipment room for
the new tower. Provide the necessary HVAC for the equipment room.
iii. Establish plan for demolition of existing communication tower and
associated appurtenances. Design and construction of the new tower
installation and existing tower demolishing shall be coordinated and
performed so that no interruption of current functions, services,
communications, or City life /safety operations is incurred.
iv. Ascertain and ensure conformity and compliance with applicable laws,
permits, FCC, and FAA requirements.
v. Evaluate availability of back -up power source and if necessary include
provisions for a new back -up power source (emergency generator) within
the grounds, and a new equipment room adjacent to the tower.
vi. Coordinate with Monroe County Sheriff's office on all phases of
communication tower concept, design, and development.
vii. Design the new antenna and line system, ensuring that there is no
interruption of current County Emergency functions.

b. Phase 2 - Construction Documents and Bidding:
The second phase of the project will involve the production of construction
documents (drawings and specifications). Consultant, with assistance from
subconsultants, will prepare all Drawings and Specifications that are required to
permit the Work. The tower manufacturer will prepare construction drawings and
structural design for the tower. Consultant will provide local support as required.
All of Consultant's work will be coordinated with other consultant's drawings and
specifications. Consultant will also provide bidding support as required. This will
include attendance at Pre -bid meetings, responses to bidder questions, and
assistance with, or issuance of, addenda.
c. Phase 3 - Construction Administration:
The third phase of the project will consist of Construction Administration.
Consultant will conduct Construction phase contract administration, including
attendance at OAC meetings and site visits to inspect work at regular intervals.
Subconsultants will provide Construction Administration services as required for
questions and /or issues regarding their areas of expertise.
2. In accordance with Article VII, paragraph 7.1.1 of the Agreement, the County shall pay the
Consultant a lump sum fee of One Hundred Seventy -Four Thousand Six Hundred Eighty -
Eight and 00 /100 ($174,688.00) Dollars paid on a percent complete basis for the following
phases:
a. Phase 1 — consisting of a Schematic Design, Design Development, and Planning
Approvals — $42,900.00 upon planning approval from the City of Key West.
b. Phase 2 — consisting of Construction Documents and Bidding — $114,088.00 upon
document review and approval by the Director of Project Management.
c. Phase 3 — consisting of Construction Administration - $17,700.00 upon project
completion.
All other Terms and Conditions of the Task Order shall remain in accordance with the Agreement
dated January 21, 2015, and as amended on January 18, 2017, and on April 19, 2018.
IN WITNESS WHEREOF, each party caused this Task Order to be executed by its duly authorized
representative.
