AGENDA ITEM WORDING: Approval of materials to be submitted with our resolution to
the Florida Department of Transportation (as per resolution request "9")
ITEM BACKGROUND: Monroe County's own Rich Jones, Marine Resources, has been
working for YEARS now to get FDOT approval for some "No Wake" signs required to
pursue the idle speed ordinance passed by the Board of Monroe County
Commissioners, He has been stymied at every attempt and now the effort needs our
support. I am proposing the inclusion of the following materials with our resolution on this
item just to remind FDOT of the history on the issue,
PREVIOUS RELEVANT BOCC ACTION: The BOCC passed a resolution on the FDOT
Five Year Work Plan that included: "9" that the Department approve the placement of
"No Wake Zones" as requested by Monroe County Marine Resources and the Board of
County Commissioners." These materials will help in that effort.

made residen'tial canals in the County as "Idle Speed t-.Jo Wake" zones. At this time Monroe
County is requesting that FOOT install five (51 signs along U.S.l ; one (1) near the Monroe
County border, and four (4) at locations determined by FOOT. Verbiage should read

About two years ago the Monroe County Department of Marine Resources had an ordinance
approved by the BOCC to make all man-made canal systems in the Keys 'Idle Speed/No Wake'.
One of the requirements of the ordinance was to provide sufficient information to boaters about
the regulation- specifically five signs located along USl in the Keys (see the attached ordinance).
Our engineering department sent a letter to Bob Rulison, at the local DOT office last year (see
attachment dated August 4, 1998) requesting that the signs be installed. That letter was
forwarded to your office, and the request was denied (see attachment dated August 28, 1998).
I am pursuing this further, as the ordinance must be made enforceable to minimize the problems
created by unknowledgeable boaters, I spoke to Gary Ogle about it on the phone today, and
mentioned that in his letter of denial it stated that we may be able to install the signs outside of
State Right-of-Way, We would certainly do this ifit is doable. Mr. Ogle asked that I fax the
ordinance and my request to you to see what your ideas are on the subject. I am aware that we
have far too many signs on the road way down here. But, this ordinance is quite important and
we need to post these signs somehow, Please let me know what we can do to work with you on
this, I'm sure our Public Works Department can take care of the work if it just means posting the
signs on some of the existing County sign posts,

I have a situation that I believe you may be able to rectify. The County passed an ordinance
about two years ago to make all man-made canal systems 'Idle Speed/No Wake', which is
obviously an important ordinance. One of the legal requirements is that we post signage at
public boat ramps and at five locations along USl (to make everyone aware of the regulation).
The boat ramp locations is not a problem. However, DOT (Miami headquarters) denied our
request (from engineering) to install five signs along US 1, basically because there are too many
signs already. The project was basically dropped until I found out about it and started pursuing
it. I spoke to the local DOT personnel who basically told me that any requests like this will be
denied unless they come from the BOCC, In other words, we need somebody with power and
authority to write a letter telling them they must do this,
I know that you are becoming increasingly involved with marine projects and I thought your
office would be a good place to start to get this pushed through. Could you please call me, tell
me your thoughts, and I can explain the project further. I don't like seeing ordinances get
created, then forgotten about.

Please find attached the information regarding our request to have signage erected along US I by
DOT, After the letter of denial was received by Engineering and they notified our department,
the task was put on the back burner as other options were being considered, Since many of the
complaints from waterfront property owners come to me I looked into it and learned about the
ordinance being non-enforceable due to the signs not going up, I talked to the local guys at DOT
(I don't have their names- Bob Rulison was out that day) and they are very aware of the
situation. Basically; I) there are too many signs along USI already, 2) we can erect them out of
the state right-of-way but that will be so far off the road it will not be effective, 3) the only way
to have signs properly erected when there are already too many signs is by request of a BOCC
member to tell them they must do it and that is extremely important.
Our engineering department can take care of the signs that need to be erected at County
ramps (there are 9 of them). DOT must put up the signs at the state ramps (there are 7 of them).
So, maybe that request should go along with your letter for the US I signage.
I've attached a draft letter with the contents that I think is pertinent.

It has recently come to my attention that your office denied a request by Monroe County to
install signage along US 1 referencing a new ordinance for boating regulations along man-made
canals (see attached letter dated 9/26/98). This is a very important regulation which restricts
vessels to 'Idle SpeedINo Wake' within the venetian canal systems throughout the Keys. One of
the requirements of this ordinance is that signage is posted along US 1 near the County border
and at four other locations along US 1 from the upper Keys to the lower Keys. We cannot
enforce this regulation without having this requirement completed,
I completely understand the problem of visual pollution along US 1 in the Keys and I assume that
the plethora of signs is the reason for the denial of our request. However, the signage that we
request is not just some small project. It is critical that our new boating regulation is
implemented and I believe a total of five signs along US 1 will not place an unreasonable burden
on the sign situation for DOT, In addition, we are requesting that DOT also erect the same
signage at each of the state owned public boat ramps in the Keys. The County will be erecting
these signs at our County owned public boat ramps.
The signage should read:
"ATTENTION: ALL MAN-MADE CANALS IN MONROE COUNTY ARE
'IDLE SPEEDINO WAKE' AREAS PER MONROE COUNTY ORDINANCE 035-1997'

New canal idle speed ordinance
I have been working on pursuing permitting (through Tara Alford's office) and meeting
requirements for the County ordinance for idle speed/no wake in all man-made canals. I have
received approval from the Division of Law Enforcement for the language to go on the signage
(see attached). What I would like to do is have a bulk number (maybe 50 or so) signs made up
that we can use to post at all the public boat ramps in the Keys, the four locations along US 1 (as
required in the ordinance), and at 'hot spot' areas throughout the Keys. Ifwe have grant money
available this may be a good project for such moneys, We will have Public Works post the signs
immediately at the boat ramps, and DOT will post the ones on US 1. I have already started a list
of 'hot spots' that we will get approval for and install as time goes by and the most important
areas are identified, Regulatory signs should be 4' x 3' and appear as below.
