AGENDA ITEM WORDING: Public hearing to consider adoption of an ordinance amending Section 6-42,
Monroe County Code (MCC) providing for a waiver of required building permit fees for implementation of County
housing rehabilitation projects for eligible very-low and low income participants.
ITEM BACKGROUND: In 1994, the Board of County Commissioners adopted Resolution No. 94-1994 that
authorized the granting of a waiver from building permit fees for implementation of housing rehabilitation projects
under the low County's participation in state and federal programs for eligible very-low and low income participants.
This resolution needs to be formally adopted by ordinance for inclusion in the Monroe County Code.
PREVIOUS RELEVANT BOARD ACTION: Approved Resolution No. 94-1994 on March 23, 1994 waiving
building permit fees for implementation of housing rehabilitation projects and approved advertising of proposed
Ordinance amending Section 6-42, Monroe County Code on December 9, 1999.

AN ORDINANCE AMENDING SECTION 6-42, MONROE
COUNTY CODE; PROVIDING FOR A WAIVER OF REQUIRED
BUILDING PERMIT FEES NEEDED FOR IMPLEMENTATION OF
COUNTY HOUSING REHABILITATION PROJECTS FOR
ELIGIBLE VERY-LOW AND LOW INCOME PARTICIPANTS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL
OF ALL ORDINANCES INCONSISTENT HEREWITH;
PROVIDING FOR INCORPORATION INTO THE MONROE
COUNTY CODE OF ORDINANCES; AND PROVIDING FOR AN
EFFECTIVE DATE.
Whereas, the Board of County Commissioners of Monroe County, has
received state and federal funds for housing rehabilitation programs for very-low
and low income residents of the County; and,
Whereas, the programs are designed to provide financial assistance for
participating very-low and low income residents to address existing substandard
living conditions, code violations, safety and sanitary conditions; and,
Whereas, the state and federal governments recommend direct
assistance from local governments by the waiving of local building permit fees
required for implementation of housing rehabilitation programs for very low and
low income recipients in order to maximize the required property improvements;
and,
Whereas, it is the intent of the Board of County Commissioners to assist
in the alleviation of such housing conditions; and,
Whereas, the Board of County Commissioners resolved in Resolution No.
94-1994 to support the waiver of building permit fees for housing rehabilitation
activities under County programs for very-low and low income recipients;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, THAT:
Section 1. Section 6-42 is hereby amended by inserting a new
subsection (c) that reads as follows:
(c) Building permit fees are waived for any building permits required in
the implementation of housing rehabilitation projects pursuant to
the County's participation in federal and state programs for eligible
low and very-low income participants.

Section 2. Existing Section 6-42 (c) is hereby reordered as Section 6-42
Section 3. If any section, subsection, sentence, clause or provision of
this ordinance is held invalid, the remainder of this ordinance shall not be
affected by such invalidity.
Section 4. All ordinances or parts of ordinances in conflict with this
ordinance are hereby repealed to the extent of said conflict.
Section 5. The provisions of this ordinance shall be include and
incorporated in the Code of Ordinances of the County of Monroe, Florida, as an
addition or amendment thereto, and shall be appropriately renumbered to
conform to the uniform numbering system of the Code.
Section 6. This ordinance shall take effect immediately upon receipt of
the official notice from the Office of the Secretary of State of the State of Florida
that this ordinance has been filed with said Office.
Section 7. The Clerk of the Board is hereby directed to forward a copy of
this Ordinance to Municipal Code Corporation for incorporation into the Monroe
County Code of ordinances.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe
County, Florida, at a regular meeting of said Board held on the 20th day of
January, AD, 2000.
