AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY..
FLORIDA, AMENDING SEC. 2-1.1, MONROE COUNTY CODE, IN ORDER TO PROVIDE
THAT THE BENEFICIAL USE AND VESTED RIGHTS SPECIAL MASTER MAY BE EMPLOYED AS
AN INDEPENDENT CONTRACTOR AS AN ALTERNATIVE TO BEING EMPLOYED AS A PART-
TIME MONROE COUNTY EMPLOYEE; PROVIDING FOR A $500 PER HEARING DAY FEE IF
THE HEARING OFFICER ELECTS CONTRACTOR STATUS; PROVIDING FOR SEVERABILITY;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES INCONSISTENT HEREWITH;
PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE OF
ORDINANCES; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE BOARD ~ COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA:
Section 1.

Sec. 2-1.1, Monroe County Code is hereby amended by the addition of the
(g) In lieu of the status of part-time employee. the hearing officer may elect
the status of an independent contractor hired to perform vested rights and beneficial
use hearings. As a contractor. the hearing officer is entitled to receive $500 for each day
hearings are conducted or scheduled unless the hearing(s) are canceled ten or more
business days prior to the hearing date. If the hearing officer elects contractor status. he
or she will not receive any of the benefits that accrue to part or full time County
employees. However. all other criteria pertaining to the hearing officer's conduct of his
or her duties under this section will continue to apply to a contract hearing officer.
Section 2. If any section. subsection. sentence. clause or provision of this ordinance is held
invalid. the remainder of this ordinance shall not be affected by such invalidity.
Section 3. All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and incorporated in the Code
of Ordinances of the County of Monroe. Florida. as an addition or amendment thereto, and shall be
appropriately renumbered to conform to the uniform numbering system of the Code.
Section 5. This ordinance shall take effect immediately upon receipt of official notice from
the Office of the Secretary of State of the State of Florida that this ordinance has been filed with said
Office.
