Resolution 409-2018 • • RESOLUTION NO. 409 -2018 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA AMENDING RESOLUTION NO. 195-2018 BY PROVIDING THAT UP TO $600,000 OF MONROE COUNTY'S PORTION OF THE FLORIDA KEYS STEWARDSHIP FUNDS FOR FISCAL YEAR 2017-2018 AND 2018-2019 FOR MONITORING COSTS BY WOOD ENVIRONMENT & INFRASTRUCTURE SOLUTIONS, INC. IN EXCESS OF THE 7.5% CAP ON UNINCORPORATED MONROE COUNTY'S MONITORING COSTS UNITED STATES DEPARTMENT OF AGRICULTURE NATURAL RESOURCES CONSERVATION SERVICE GRANT NR184209XX0(CO27 FOR MARINE DEBRIS CLEARING IN UNINCORPORATED MONROE COUNTY; FURTHER AMENDING RESOLUTION NO. 195-2018 BY PROVIDING THAT UP TO $100,000 IN STEWARSHIP FUNDS MAY BE USED FOR DEBRIS REMOVAL ON PLUGGED CANALS; AND APPROVING THE EXECUTION OF AMENDMENT NO. 1 TO STEWARDSHIP GRANT AGREEMENT NO. LP44074 WITH THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION. WHEREAS, as part of the Florida Keys Stewardship Act, unincorporated Monroe County received a direct appropriation of$3.99 million for fiscal year 2017-2018 and a further $1.5 million for fiscal year 2018-2019, totaling $5.5 million in appropriations for unincorporated Monroe County for the two years; and WHEREAS, on July 18, 2018, Monroe County Board of County Commissioners (BOCC) accepted a $49.3 Million Grant from the U.S. Department of Agriculture, Natural Resources Conservation Service, Grant # NR184209XXXXCO27 ("NRCS Grant"), for clearing canals in the unincorporated County, Village of Islamorada and City of Marathon from hurricane debris; and WHEREAS, NRCS Grant Agreement NR184209XXXXCO27 ("NRCS Grant Agreement") provides that 75% of costs for debris removal (referred to in the Grant Agreement as "Construction Costs") are reimbursable by NRCS, leaving a 25% local match, whereas 100% of other costs including monitoring (referred to in the NRCS Grant Agreement as "Technical Costs") are reimbursable by NRCS; and WHEREAS, on July 18, 2018, the Monroe County Board of County Commissioners (BOCC) adopted Resolution No. 195-2018, approving the allocation of unincorporated Monroe County's portion of the Florida Keys Stewardship funds for FY 2017-18 and 2018-19 in the amount of$5.49 million as a partial payment of the County's 25% local share of debris removal costs for work performed under the NRCS grant; and WHEREAS, Wood's monitoring costs have been averaging approximately 10.5% of Construction Costs; and WHEREAS, the NRCS Grant Agreement provides that NRCS will reimburse the County for Technical Costs,but only up to 7.5% of Construction Costs; and Page 1of3 WHEREAS, the Florida Department of Environmental Protection (FDEP) has agreed to allow $5,490,000 in Stewardship funds for unincorporated Monroe County to be applied towards the County's local cost share for marine debris clearing as a result of Hurricane Irma; and WHEREAS, FDEP has further agreed that up to $600,000 of the Stewardship funds for FY 2017-18 and FY 2018-19 may be used for Wood invoices in excess of the 7.5% cap in the NRCS Grant Agreement; and WHEREAS, NRCS will not authorize the use of NRCS grant funds to cover debris removal work within plugged canals beyond the 2 plugged canals approved in the original list of 103 approved canals; WHEREAS, the County will issue an RFP for the clearing of the plugged canals as these will not be under the same terms as conditions as canals cleared under the NRCS grant. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA that: 1.
