'teaOA. 7 8 MONROE COUNTY, FLORIDA 9 BOARD OF COUNTY COMMISSIONERS to RESOLUTION NO.414 - 2018 11 12 13 A RESOLUTION BY THE MONROE COUNTY BOARD OF 14 COUNTY COMMISSIONERS TRANSMITTING TO THE STATE 15 LAND PLANNING AGENCY AN ORDINANCE BY THE MONROE 16 COUNTY BOARD OF COUNTY COMMISSIONERS AMENDING 17 POLICY 101.3.7 OF THE MONROE COUNTY 2030 18 COMPREHENSIVE PLAN REGARDING TEMPORARY 19 EMERGENCY HOUSING FOR TEMPORARY OCCUPANCY BY 20 RESIDENTS DISPLACED BY A NATURAL DISASTER TO 21 ALLOW FOR THE BOARD OF COUNTY COMMISSIONERS TO 22 APPROVE BY RESOLUTION AN EXTENSION OF THE 23 DURATION OF TEMPORARY EMERGENCY HOUSING AFTER A 24 NATURAL DISASTER; AND TO ALLOW FOR THE BOARD OF 25 COUNTY COMMISSIONERS TO APPROVE BY RESOLUTION 26 PLACEMENT OF TEMPORARY EMERGENCY HOUSING AT 27 MOBILE HOME PARKS AND RV PARKS FOR TEMPORARY 28 OCCUPANCY BY RESIDENTS DISPLACED BY A NATURAL 29 DISASTER; PROVIDING FOR SEVERABILITY; PROVIDING 30 FOR REPEAL OF CONFLICTING PROVISIONS; PROVIDING 31 FOR TRANSMITTAL TO THE STATE LAND PLANNING 32 AGENCY AND THE SECRETARY OF STATE; PROVIDING FOR 33 INCLUSION IN THE MONROE COUNTY COMPREHENSIVE 34 PLAN; PROVIDING FOR AN EFFECTIVE DATE. 35 36 37 WHEREAS, the Monroe County Board of County Commissioners conducted a public 38 hearing for the purpose of considering the transmittal pursuant to the State Coordinated Review 39 Process in Sec. 163.3184(4), F.S., to the State Land Planning Agency for objections, 40 recommendations and comments, and to the other Reviewing Agencies as defined in Sec. 41 163.3184(1)(c), F.S., for review and comment on a proposed amendment to the Monroe County 42 Year 2030 Comprehensive Plan as described above; and 43 44 WHEREAS,the Monroe County Planning Commission and the Monroe County Board of 45 County Commissioners support the requested text amendment; 46 Resolution No. 414.2018 Page 1 of 2 47 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY 48 COMMISSIONERS OF MONROE COUNTY,FLORIDA: 49 50 Section 1. The Board of County Commissioners does hereby adopt the recommendation of the 51 Planning Commission to transmit the draft ordinance, attached as Exhibit A, for 52 adoption of the proposed text amendment. 53 54 Section 2. The Board of County Commissioners does hereby transmit the proposed 55 amendment to the State Land Planning Agency for review and comment in 56 accordance with the State Coordinated Review process pursuant to Section 57 163.3184(4), Florida Statutes. 58 59 Section 3. The Monroe County staff is given authority to prepare and submit the required 60 transmittal letter and supporting documents for the proposed amendment in 61 accordance with the requirements of Section 163.3184(4),Florida Statutes. 62 63 Section 4. WHEREAS, the proposed Amendments to Policy 101.3.7 would allow for temporary 40 occupancy by residents displaced by a natural disaster to allow for the board of county 41 commissioners to approve by resolution an extension of the duration of temporary emergency 42 housing after a natural disaster; and to allow for the board of county commissioners to approve by 43 resolution placement of temporary emergency housing at mobile home parks and RV parks for 44 .'temporary occupancy by residents displaced by a natural disaster; and 45 Ord -2018 Page 1 of 4 1 WHEREAS, during a regularly scheduled meeting held on April 24, 2018, the Development 2 Review Committee(DRC) considered the proposed amendments and recommended approval; and 3 4 WHEREAS, the Monroe County Planning Commission (PC) held a public hearing on 5 November 14, 2018, for review and recommendation on the proposed amendments; and 6 7 WHEREAS, based upon the information and documentation submitted, the Planning 8 Commission made the following Findings of Fact and Conclusions of Law: 9 10 1. The proposed amendments to Policy 101.3.7 are consistent with the Goal, Objectives and 11 Policies of the 2030 Comprehensive Plan; and 12 13 2. The proposed amendments to Policy 101.3.7 are consistent with the Principles for Guiding 14 Development for the Florida Keys Area of Critical Concern,Section 380.0552(7), Florida 15 Statutes; and 16 17 3. The proposed amendments to Policy 101,3.7 are consistent with`Florida Statutes. 18 19 WHEREAS, the Monroe County Planning Commission,•adopted Resolution No. P -18 20 recommending of the proposed amendment;"and 21 22 WHEREAS, at a regular meeting held'on the 20thday of November 2018,the Monroe County 23 Board of County Commissioners held a public hearing to consider the transmittal of the proposed 24 text amendment, considered the'•,staff report, and provided-,for public comment and public 25 participation in accordance with the requirements of state law and the procedures adopted for 26 public participation in the planning process; and•. 27 28 WHEREAS,-at the,November 20, 20.18, public hearing, the BOCC adopted Resolution 29 ''-20'18,transmitting'the proposed text amendment to the State Land Planning Agency; and 30 • e 31 WHEREAS, the StateLand Planning Agency reviewed the amendment and issued an 32 Objections, Recommendations--and Comments (ORC) report, received by the County on 33 ;.•and 34 35 WHEREAS,the ORC'report ; and 36 37 WHEREAS, the County has 180 days from the date of receipt of the ORC to adopt the --38 proposed amendment, adopt the amendment with changes or not adopt the amendment; and 39 40 WHEREAS, at a regularly scheduled meeting on the day of 201 ,the 41 BOCC held a public hearing to consider adoption of the proposed Comprehensive Plan text 42 amendment; 43 Ord -2018 Page 2 of 4 1 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY 2 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 3 4 Section 1. The text of the Monroe County Comprehensive Plan is hereby amended as follows 5 (Deletions are shown stricken through; additions are shown underlined): 6 7 Policy 101.3.7 8 Monroe County may permit temporary emergency housing, not subject to the Permit Allocation 9 System, for temporary occupancy by residents displaced by natural or manmade disaster damage; 10 or for relief workers involved in reconstruction activities. 11 12 Temporary emergency housing may be permitted subje t to:thefollowing: 13 14 • Temporary emergency housing means recreational vehicles (or similar approved sheltering 15 units) used for temporary occupancy in response to natural or manmade disasters, including, 16 but not limited to, hurricanes and tropical storms, where such units'are provided to residents 17 and relief workers as part of emergency relief efforts. 18 • Building permits for temporary emergency housing for displaced residents on ,inglc family 19 residential parcels shall be limited to one recreational vehicle (or similar approved sheltering 20 unit)per dwelling unit, and occupancy shall not exceed.1 80 days, unless an extension of up 21 to an additional 180 days is granted.,by the`building official. Occupancy may be further 22 extended at the discretion of the Board of County Commissioners (BOCC) by resolution. 23 • Building permits for temporary emergency housing,for displaced residents on nonresidential 24 or mixed use sites or vacant residential properties shall not exceed 180 days, unless an 25 extension of up to an additional 180 days is granted by the building official. Occupancy may 26 be further extended at the discretion of the Board of County Commissioners (BOCC) by 27 resolution. 28 • The Board-of County (BOCC)may adopt a resolution authorizing the duration 29 of:temporary emergency housing after a naturaldisaster. 30 • The'Beard of County Commissioners (BOCC) may adopt a resolution authorizing the 31 placement of temporary emergency housing at mobile home parks and RV parks for the 32 temporary occupancy by residents displaced by a natural disaster. 33 • Approval by the Board of County Commissioners (BOCC) of a resolution authorizing the 34 placement and duration of temporary emergency housing for relief workers shall be required. 35 Occupancy of temporary emergency housing for relief workers shall not exceed the duration 36 specified by the BOCC resolution, but may only be extended at the discretion of the BOCC by 37 an additional resolution. 38 39 Section 2. Severability. If any section, subsection, sentence, clause, item, change, or 40 provision of this ordinance is held invalid,the remainder of this ordinance shall not 41 be affected by such validity. 42 43 Section 3. Repeal of Inconsistent Provisions. All ordinances or parts of ordinances in 44 conflict with this ordinance are hereby repealed to the extent of said conflict. 45 Ord -2018 Page 3 of 4 I • - 1 Section 4. Transmittal.This ordinance shall be transmitted by the Director of Planning to the 2 State Land Planning Agency pursuant to Chapter 163 and 380, Florida Statutes. 3 4 Section 5. Filing and Effective Date. This ordinance shall be filed in the Office of the 5 Secretary of the State of Florida but shall not become effective until a notice is 6 issued by the State Land Planning Agency or Administration Commission finding 7 the amendment in compliance with Chapter 163, Florida Statutes and after any 8 applicable challenges have been resolved. 9 10 Section 6. Inclusion in the Comprehensive Plan.
