AGENDA ITEM WORDING: Authorization to initiate litigation against Brian and Misty
Reininger and the property located at 104 Jamaica Street, Duck Key, Florida, and any other
properties owned by them if necessary, to seek compliance with the County Code and enforce liens
arising from code compliance case numbers CE16100099 and CE18050099.
ITEM BACKGROUND:
CE16100099 - This property has been the subject of a code compliance case CE16100099 for the
failure to maintain property and remove trash, debris and discarded construction materials. A
hearing was held on January 25, 2018 and the property owner did not attend. The Special Magistrate
found the property in violation of two (2) County ordinances as cited and imposed a fine (in the
amount of $100.00 per day per count) to accrue until compliance is achieved. As of November 28,
2018 the fines have accrued for 285 days for a fine total of $57,000.00, and will continue to accrue at
$200 per day until compliance is achieved. Additionally, per F.S. §162.07(2), if the local governing
body prevails in prosecuting a case before the enforcement board, it shall be entitled to recover all
costs incurred in prosecuting the case before the board and such costs may be included in the lien
authorized under s. 162.09(3). To date these costs are $987.77 and continue to accrue until the case
is closed.
CE18050099 This property has been the subject of a code compliance case CE18050099 for the
failure to remedy the unsafe condition as a result of an expired permit and abandoned construction
site. After an investigation by Code Compliance, a referral was made to the Building Official and
the property was deemed unsafe. A hearing was held on June 28, 2018 and the property owner did
not attend. The Special Magistrate found the property in violation of three (3) County ordinances as
cited and imposed a fine (in the amount of $150.00 per day per count) to accrue until compliance is
achieved. As of November 28, 2018 the fines have accrued for 138 days for a fine total of
$62,100.00, and will continue to accrue at $450.00 per day until compliance is achieved.
Additionally, per F.S. §162.07(2), if the local governing body prevails in prosecuting a case before
the enforcement board, it shall be entitled to recover all costs incurred in prosecuting the case before
the board and such costs may be included in the lien authorized under s. 162.09(3). To date these
costs are $512.91 and continue to accrue until the case is closed.

The code cases remain open for non-compliance and failure to pay outstanding fines and costs. The
County has exhausted all other mechanisms available to persuade the property owner to achieve
compliance. The subject property, in its current condition, presents a threat to the public health,
safety and welfare.
As of November 28, 2018 Brian and Misty Reininger own no other property in Monroe County, no
other open code cases or outstanding Monroe County Code liens were found. Additionally, due to
unpaid real estate taxes, the Monroe County Tax Collector records reflect a tax deed
application.
The property is not homesteaded and there are no pending foreclosure actions at this time.
Under the policy adopted in Resolution 057-2014 the available legal options in regard to the
1. Initiate litigation against the property owner for injunction, foreclosure, money judgment and
writ of execution;
2. Allow the liens to remain against the property owner, the subject property and any other
property owned by the property owner; and/or
3. Reduce the amount of the fines.
County staff recommends initiating litigation (option 1) against the property owner for injunction,
foreclosure, money judgment and writ of execution.

Procedure to be used after a Final Order has been rendered by the Code Compliance Special
Magistrate to initiate injunctive relief for non-compliant properties, foreclosure and/or money
