TEM BACKGROUND: The Florida Department ofTransportation Section 5310 Grant is generally
applied for on an annual basis by the Monroe County Social Services Transit Department. This grant is
intended to enhance mobility for seniors and persons with disabilities by providing funding for
programs to serve the special needs of transit dependent populations beyond traditional public
transportation and in accordance with the Americans with Disabilities Act (ADA),
PREVIOUS RELEVANT BOCC ACTION: Approval granted by the BOCC on 1/16/14 to hold
public input meeting to purchase one transportation bus and acceptance of any subsequent grant
awards.

Introduction
This application manual pertains to appl icat ions for Federal assistance under U.S.C. Section 5310,
Forrnula Grants for the Enhanced Mobility of Seniors and IndividWIlS with Disabilities Program, as
administered by the Florida Department of Transportatioil (FDOT.) It contains program, information,
application forms, exhibits, certjficaations & assurances, and instructions.
Program Administration. The Federal government allocates funds, to tile State of Florida each ye",11- for
the Section 5310 Program. FDOT has been designated by the Governor to administer the program for
small urban and rural areas. Most large urbanized areas (population over 200,000) have also selected tile
Department to administer the prograni for their urbanized area, FDOT is responsible for the following
services but, at its discretion, rnay contract with as service provider to perform these services,
I ) announcement of funding availability�
2) selection of prqjects R)r funding according to, aipproved selection criteria;
3) development and processing of agreements;
4) oversight of recipient proctirenient actions;
5) oversight of recipient conipliance with State and Federal requirements;
6) processing of recipient invoices for r iniburset-nent, and
7) provision of technical assistance retarding tile Section 5310 Program,
Authorizing legislation for the program is shown in the Glossary of this mantial under "authorizing
Federal and State Legislation."
'The Federal goal of the Section 531 O.Program is to provide assistance in meeting the needs of seniors and
individuals with disabilities where public transit services are unavailal-fle, insull"icient or inappropriate.
Application Deadlines. Application deadlines vary from District to Distdct but LISU,111y fall between
December and February each year. FDOT District Offices evaluate grant applications within their
respective districts and, thereafter, submit Programs of Projects (POPs) to the FDOT Central Office. The
Central Office compiles POPs from the various Districts and submits a statewide grant application for
Federal funds to the Federal Transit Administration j-,FA) by April I of each year. FDOT anticipates
FTA's approval of the statewide grant application (including district POP"s) by,ftfly 1. The appropriation
for State funds to rnatch Federal funds is approved by tile State Legislature for implementation oil July I
elf each year. Once Federal and State funds are available, Districts may make grant awards. (See "Grant
Award Process"), At least 55,% of the available funding will be awarded to capital projects. The
Department reserves the right to 'increase that percentage up to 100% of project selections as capital, as
deemed best suited to meet the mobility needs of seniors and individuals with disabilities where public
transit services are unavailable, insufficient or inappropriate,
Grant Application Evaluation Criteria. Applications shall be evaluated and ranked oil the basis of
trierit and need. Unless there is sufficient funding in as District to cover all eligible requests, District
Offices Will use, the 1`011OWing Criteria to evaluate applications. District Offices has the discretion to alter
the grading scale in their District by assigning higher point value to prQjects rneeting the specific priority

needs in their District.
A. Service efficiency and effectiveness: This is demonstrated by the LISUal daily hours of eligible service
and vehicle occupancy, The emphasis is on the normal hours that agency vehicles are In service, not the
hours the applicant is open for business. Applicants providing transl'.)ortat ion service for more hours and
with fuller vehicles will be ranked higher. The applicant's use ofeurrent vehicles (including rnileage and

maintenance practices) will be considered in the review and ranking,
B. Extent to which the community at large is served by the applicant: Applicants serving the highest
C0111111LIllity needs through social set -vice a�., !encies and providing the most trips to seniors and individuals

C. Extent to which seniors and individuals with disaWlities are served: Applicants that MaXiMiZe
transportation benefits to seniors and individuals with disabilities in their cornmunity wil I be evaluated Oil
the percentage of total riders/passengers served that are seniors and/or individuals with disabilities. Those
serving the highest percentage will be ranked higher.
D,. Need: Applicants that can demonstrate they serve, or propose to serve, the largest number of eligible
passengers, and have the most urgent financial needs will be ranked higher. FDOT has a goal to preserve
transportation illftaStftlCture; therefore, maintaining current levels of service may be deemed as higher
priority/need than expanding into new services or expanding service area. coverage. A detailed

E. Fiscal and managerial capability: Applicants with well -documented budgets Zlild good fiscal
capability denionstrated by the correctness and corripleteness of' their application, by prior audits, proper
maintenance of vehicles, as demonstrated by mile,,,, at replacement, and previous timeliness and accuracy
of required reports, will be ranked higher,
F. Prior Performance: Applicants who have a history 01' meeting contractual obligations and
maintenance requirements for Section 5310 vehicles will be ranked higher, COMpliance with non Section
5310 COMI-aCtILMI obligations and maintenance requirements will be considered. Corriphance with Annual
Operating Report (AOR) to area CTCs unay also be considered. Now applicants will not be penalized for
having little or no history with FDOr, heat previous applicants will be penalized for poor past
performance.
Threshold Criteria
,rhreshold criteria are the minimum legal eligibility requiren'ients. Applications niu,","t be for eligible
,services, eligible service areas, eligible recipients, eligible expenses, and provide evidence of local

Eligible Recipients. [,or the Section 531 Cl Prograin, funds may be awarded U) PUblic agency Corinnunity
Transportation Coordinators (CTCs)�, private non-profit CTCs, and to private non-profit organizations
providing transportation to seniors and/or persons with disabilities under a coordination agreerrient with a
CTC. When the CT'C is as private for -profit agency, the designated official planning agency responsible
for designating the CTC may apply for Section 53 10 funds, then sub -contract with the CTC for provisioll
of service. Recipients must be either a CTC or providing service under the terrns of a written agreement
with a CTC. Agencies inust keep their CTC Agreements Current and in force at all times when receivillo,
arl award under the Section 53 10 Program, Agencies must also keel) their CTC Agreements current and in
force every year until the vehicle(s) reaches its useful life reqUil'enient.
Private taxi companies that provide shared -fide taxi service to the general public on as regular basis are
operators Of PUbfic transportafit)n, and therefore eligible subreciplents. "Shared -ride" nleans two or more

passengers in the same vehicle who are otherwise not traveling, together, Similar to general public and
ADA demand response service, every trip does not have to be shared -ride in order for a taxi Company to
be considered at shared -ride operator, but the general nature of the service niust include shared rides.
'Faxi companies that provide only exclusive -ride service are not eligible subrecipiei its; however, they may
participate in the Section 5310 program as contractors. Exclusive ride taxi companies rnay receive

Section 53 10 funds to purchase accessible taxis Under contract with a state, designated recipient, or
eligible subrecipient such as a local governinent or nonprofit organization.
Legal Authority and Fiscal & Managerial Capability. Section 5310 applicants must have the legal
a',tuthorily and fiscallmanagerial capability to apply for Federal assistance. Applicants are reqUired to have
Sufficient local funds for 1-natch requirements (see below) and for preventative maintenance and operation
of vehicles/equipment. Failure to properly manage, maintain, and operate vehicles/equipment could
'jeopardize existing and future grants and may result in the removal of vehicles/equipment.
Eligible Expenses. Section 5310 funds may be used for the capital andlor operating expense of transit
services to seniors andlor individuals with disabilities. Eligible expenses are limited' to bases, WITIS Or
other paratransit vehicles (including sedans and station wagons), radios and corrinninicalions equipment,
wheelchair lifts and restraints, vehicle rehabilitation, vehicle overhatil, data. processing hardware/software,
other durable goods such its spare cornponents, with a useful life of more than one ( I) year and as per unit
cost over S300, initial installation costs, vehicle procurernent/tesOng, vehicle inspection and vehicle
preventative maintenance, passenger facilities related to Section 5310-funded vehicles, support ficicififies
and equipment for Section 5310-funded vehicles, operating costs associated with providing transit
service, costs associated with transit service that exceeds the reqUireirnents of the Arnericans with
Disabilities Act of 1990, proJects that improve access to fixed route service and decrease reliance by
individuals with disabilities on complementary paratransit, and alternative to public transportation that
assist seniors and individuals with disabilities with transportation. An applicant applying for preventative
maintenance costs rVILIst have a District approved preventative maintenance plan and a cost alk,)cation if
activities are performed in house. The Federal53 10 share for eligible capital expenses may not exceed
eighty percent (80%).
Ineligible Expenses. Ineligible expenses include expenses associated with preparation of grant
applications. protect planning, administration, and extended warranties; expenses incurred prior to Federal
and State approval of a grant applic,,itjon; expenses incurred prk')r to the execution of a grant award-, and
expenses incurred prior to the Department's approval of plans, specifications, and third party contracts for
vehicles/equipment to be purchased with Section 5310 funds.
Matching funds for Section 5310 Capital Assistance. Applicants may not borrow funds t<a use as
match nor may they place liens on Section 5310-funded vehicles or equipment. The breakdown of
funding for the Section 5310 Grant prograiii is 80% Federal/101,/c FD0'T-State/l0,X: Local for capital
projects, meaning the Federal share of"efigiHe capital costs may not exceed 80cIr of the total award. State
funds nary support Lip to 10'k of eligible capital costs with the remaining 10ht being supported by at local
match. At the time an order is placed for vehicles/equipment, the applicant is required to provide a
purchase order for its 101"Xc local match to be paid to the vendor. The required 101'/r local match must be
paid at the time of delivery,
Matching funds, for Section 53 10 Operating Assistance. The Section 53 10 federal share of eligible
operating expenses rilay not exceed 50%. Sonic combination of state, local, or private funding sources
must be identified and committed to provide the required non-federal share. "The non-federal share may
be cash, or in kind. FUnds may be local, private, state, or tip to one half) unrestricted Federal funds.
Funds mazy not include any borrowed against the value of capital equipment funded in whole or in part by
State andlor Federal sources,
The Section 5310 Prograrn permits Lip to one half the required match to be derived from other unrestricted

Federal funds. Federal funds are unrestricted when as Federal qgrency permits its funds, to match Section
5310. Essentially, all Federal Social Set -vice Programs using transit services are unrestricted, such as
Medicaid, employment training, vocational rehabilitation services and Temporary Assistance for Needy
Faiiiihes; other U.S. DOT Programs are not considered unrestricted Federal funds.
Contract revenue from the provision of transportation services to social service agencies may also be used
as local match. The costs associated with providing the contract revenue service must be included in the
project budget ifusing contract reVerILIC as nlatCfi.
Non -cash, in -kind contributions such as donations of gorods or services and volunteered services are
eligible to be counted towards the local match only 'if the value Of Such is formally docurnented, supported
and pre -approved, by the District Office. Any funds connnitted ,,is match to another Federal progL_ram may
not be used to match Section 5310 funds. Operating assistance funds will be awarded through as joint
participation agreement with the Departmont.

Americans with Disabilities Act (A A). Applicants shall comply with the Americans with Disabilities
Act, (ADA) of '1990, as amended; Section 504 of the [Zehabilluition Act of 1973, as amended; US. DOT
re(YUlTransportation,TransportationServices for Individuals with Disabilities (AD A)" at 49 CFR Parts 27, 37; :IS,r 39, and FI'A regulations, Transportation for Elderly and Handicapped Pet -sons, 49 CFR Part 609.
Civil Rights Submissions. Civil rights submissions that will be required include a Title VI Program,
Equal Ernploynient OPPOI-Wnit}/ (EEO ) Program, Disadvantaged Business Enterprise (DBE) Prograrn and
annual goal, and ADA Paratransit Plan. All applicants must submit a copy of their Title VI Plan with
the grant application. At the applicant's request,, the FDOT District Office will provide technical
assistance to the applicant in the developnient of then- Title VI Plam
Davis -Bacon Act In the event that a protect involves construction, applicants shall comply with the
David Bacon Act 49 U.S.C, Section 5331 3(a) prevailing wage reqUirenlents.
Environmental Determination. The it ipact that as proposed FrA assisted project will have on the
environment shall be evaluated and docurnented in accordance with the National Environmental Policy
Act (NEPA) of 1969 (42 U.S.C. 4321 et seq.), before grant application,
Administrative requirements (ONLY IF THE GIZANT IS FOR FACILITIES). Applicants shall
supply the appropriate Regional Planning Council (RPC)/Iocal clearinghouse agency (see Appendix) as
copy of' its application foi Federal Assistance, Each applicant shall request the RK/Clearinghouse
provide an approval letter for the application to, the appropriate FDOT District Office. Copies of
correspondence to the RMClearinghouse agency should be contained in the grant application.

Transportation Plan) prepared and approved by the metropolitan planning organization (MPO), the

Although applications for projects may be accepted by tile FDOT District Office prior to their listing in as
TIP/STEP, as grant award will not be final for such: projects until all administrative requirements are
completed, including being listed in the appropriate TlP/STIP-
Planning requirements. To remain eligible for Section 5,3110 awards, recurring applicants, MUSt SUbmit
the TDSP or TDP for their service area to FDOT in a timely manner. The entire 'rDS11 oj-TDP does not
need to be subrnitted with the application.
Audit requirements for Section 531.0 Recipients.
Part I Fede ally Funqled: If the Agency is a state, local govejjjjljcjlt, or rion-profit or, as
defined in OM,13 Circular A-133 and a recipient of federal funds, the following annual audit
criteria will apply:
1. In the event that the recipient expends $750,000 or snore in Federal awards in its fiscal
year, the recipient must have as single or prograrn-specific audit conducted in accordance
with the provisions of OMB Circular A-133, as revised. FAIijbit "[)" to this agreement
indicates Federal 1'eSOUrces awarded throuch tile Department by this agreement. In
deteranning the Federal awards expended in its fiscal year, the recipient shall consider all
sources of Federal awards, includinIg Federal resources reeek(ed from the Department.
The deterniination: ofamounts of Federal awards expended ShOWd be in accordance with
(lie guidelines established by OMB Circular A-133, as revised. An audit of the recipient
conducted by tile Auditor General in accordance with the provisions ()MB Circular A-
133, as revised, will meet the requirenients of this part.
2. In connection with the audit requirements addressed in Part I, Paragraph 1, the
recipient shall fulfill the requirements relative to auditee responsibilities as provided in
Subpart C ofOMB Circular .-1 m" 3,

Florida StatUtes, and as recipient of state funds, the following annual audit cdteriawill apply:
1. In the event that the recipient expends a total arnount of state financial assistance equal
to or in excess of $750,000 in any fiscal year, the recipient MUS1 have a State single or
pro.ject-specific audit for such fiscal year in accordance with Section 215,97, Florida
Statutes; applicable rules of the Department Of Financial Services and the CFO;; and
Chapters 10,550 (local governmental entities) or 10.650 (nonprofit and for -profit
organizations), Rules of the Auditor General. Exhibit "D" to this agreement indicates
state financial assistance awarded through the Department by this agreement. In
determining the state financial assistance expended in its fiscal year, the recipient shall
consider all sources or state financial assistance, including state financial assistance
received from the Department, other state agencies, and other non -state entities. State
financial assistance does not include Federal direct or pass -through awards and resources
received by as non -state entity for F'edcral pro rain matching requirenlents.
2. In coinnection with the audit recltdrements addressed in Part 11, Paragraph 1, the

recipient shall ensure that the audit complies with the requirements of Section 215,.97(8),
Florida Statutes. This includes submission of financial reporting package as defined by

3. If the recipient expends less than the amount in Part 11, Paragraph 1, such audit is not

Part,111 Other Audit Reauirements
1. The Agency shall follow-up and take corrective action on audit findings. Preparation of as

2. Records related to UDIVS(flved audit findings, appeals, or litigation shall lbe retained until tile

section does not lirnit the authority of the Department to conduct or arrange for the conduct of
additional audits or evaluations of state financial assistance or finlit, the authority of any other
state official,

Use of Section 5310-funded vehicles or equipment. Section 5310-fUnded vehicles/equipment MUst be
used in the transportation management areas/large Urbanized areas, small urbanized areas, or rural areas
for which was awarded to transport seniors and individual,, with disabilities. They iriay [)e used to
provide transit to eniployinent, medical care, education, shopping, socialization, etc. Incidental use of
vehicles as cargo carriers (i,e, meals on wheels), and work vehicles (i.e. carrying crews and equipment
from site to site and/or standing idle between work sites) is permitted as long as it does not interfere with
the Pril"TUIF-Y use, of the 'vehicle(s). '111 such cases, the nUrnber of vehicles requested in an application must
be justified by the number of people transported -- not meal delivery or tool handling requirements. The
need and planned use of the requested vehicles must be detailed in the Proposed Project Description
(Exhibit B).

Lease of vehicles. Vehicles purchased with Section 53 10 funds may be leased to local public bodies or
agencies, non-profit agencies, or private -for -profit operators only for the services identified in the grant
application. The lease between the applicant and the lessee shall contain the terms and conditions that
must be inet in providing transportation service to seniors and individuals with disabilities, and n1ust be
approved by the appropriate FDOT 'District Office, yan agey other tantheonenarnedas applicant inthe grantapplication, control and responsibility for the operation of the
vehicles remains with the applicant.
Transportation Management Areas/Large Urbanized Areas, Small Urbanized Areas, and Rural
Areas. Transportation rnanagernent areas/lai-e urbanized areas, JIMAs) are those with a population of

200,,000 or more. Small Urbanized areas are, those with populations between 50,000 and 199,999. To be
considered rural, an area will have population under 50,000.
Awards will be niade by the respective FDOT District Office to agencies submitting applications
approved by FDOT for an award, either by 1) issuing a Joint Participation Agreenient (JPA) to the
recipient,- or 2) arranging for vehicle/equipt-rent purchases through as contractor.

Grant Award Process for Section 5310 Clapital Assistance. To notify an applicant (subrecipient)
approved by FDOT for an award, FDOT will send as "Notice of Grant Award" to the subrecipiem with
instructions to sign and return it to the Departinent (See s,nrnple notice in the Appendix,). Thereafter, the
agency will contact the FDOT Contractor to arrange for purchase of vehicles/equipment. A signod Notice
of Grant Award is a legally binding agreement. By signing a Notice of Grant Award grant subrecipients
agree to comply with all applicable requirernents, as contained in U,S.C, 49 Section 5310 of the Federal
Transit Act of 1991, as arnerided.This is accornplished by ensuring adherence with all federally required
certifications and assurances made in Exhibits E, F, I and H. Grant ,,ippficants/subrecipients 111LUSt alSO
make certain aSSUrances and certifications to FDOT, as provided in Exhibit G, Additionally, grant
SUbrecipients will be required to report to FDOT and F-l"A certain performance measures as deteri-nined

to show operating and administrative expenses fthe service operated/contracted by the applicant. Form

Consortiurn's Model Uniform Accounting System for RUnal and Specialized Transportation Providers

the TAC nianual and in fTA National Transit Data Reports (NTD). Definitions for expense and revenue
line items are included in the Appendix of this manual,

Applicants Should complete both the "Total Revenue" and "Revenue Used as FTA Match" columns of
Form B-2, In completing Forms B-2, CTCs may use revenue information from the budget in their most
current TDSP. The "Total Revenue", column should show all revenues used to pay for the expenses
shown in Form 13-1, as noted previously. The definitions for each line itern code that is provided in the
Appendix of this manual apply, The "Revenue Used as VFA Match" column separates total revenues
from revenues accepted by FTA as match. This includes revenues in object codes 410, 411, 412, and 430.
It also includes revenues in object code 413 EXCEPT for any FTA or other USDOT funds. In other
words, FTA or other USDOT revenues should be deducted from the al'110L[ut shown in object code 413 in
the "Total Revenue"' column, and the balance should be shown in the "Revenue Used LIS FTA Match"
column.
Next, both colurnins should be totaled and the total of(b) "Total Rural Passenger Fares" (401) and (e)
"Grand Total Revenues- transferred to the grant request section of Form B.- I -

Most transit projects funded under Section 53 10 will be classified by FTA as categorical exclusions. Examples of
categorical exclusions include operating assistance, purchase of transit vehicles, and purchase of office equipment,
if tile proposed protect is for construction of facilities further evaluation may be required before, a determination can
be made that the prc�ject is a categorical eXCILISion. The MOT District Office in the applicant's service area (see
Appendix) should be contacted to determine if additional evaluation is needed. If it is needed, information such as
an Environmental Assessnient or Environinental Inipact Statement (as determined by FDOT) should be included
with an application for Section 53 10 Assistance. This Information may be separately bound and identified as
Exhibit 1.

Standard Transportation Operating Procedure (STOP)

Most FDOT grant recipients fall under the reqUirefflenk Of Florida Administrative Code Rule 14.90, A small
nUrnber of recipients, only receive grant awards through the Federal Transit Administration's Section 5310,
Enhanced Mobility for Seniors and Individuals With Disabilities, Prograrn. These Section 5310 only recipients
niust provide the District Office a Standard Transportation Operating Procedure (STOP) that covers, the following
items. Agencies will be required to undergo as triennial review and inspection by FDOT'to asectlain conipliance
with the baseline requirements. Agencies have one (1) year to conic into compliance with the STOP requirements
outlined in this docurnent. Agencies not yet in-cornpliance niust send a progress report to thL local FDO:T District

verifying that the employee has a valicl driver license, an CDL if necessary for the size vehicle being
operated by the agency, and if as background check is recl'utred. It will also include how the agency ensures
that all drivers have valid licenses while operating vehicles.

according to Section 112.0455, F.S. Additionally, as driver holding a Comrriercial Drivers License is
sub ect to the federal requirenients related to drug, testing. The STOP must document how an agency rneets
these requirements.
The STOP rnust d0CLMICnt how the agency will ensure, drivers not be permitted to drive more than 12 hours
in a 24 hour period; and drivers not be permitted to lie on duty more than 72 h0III-S in any period of 7
consecutive days.
Safety
• The STOP must state how the agency ensures that no driver- operates as vehicle when his or her ability is
impaired, or likely to be impaired, by fatigue, illness, or other CaLUSOS'.
• The STOP must dOCUrnent how the agency ensures that the vehicles are operated in compliance with
applicable traffic regulations, ordinances, and the laws of the j LH-isdiction in which they are being operated.
• The STOP must include the agency's policy for the use of'wireless communication devices while
occupying the vehicle.
• Agencies will be required to investigate events involving vehicles and reSUlting in fiatality, injury or
property darnage. The development of necessary 1,eports, corrective action plans and other dOCUrnentation
and must be submitted to FDOT.

requirements and to consider approval of Grant Award FTA Section 5310 —YEAR 39 (FFY 2014-
2015) Capital Assistance Grant for the purpose of purchasing a para-transit vehicle (bus) to serve the
transportation needs of the elderly and personswith disabilities in Monroe County,
ITN B ROUND: The Florida Department of Transportation Section 5310 Grant is generally
applied for on an annual basis by the Monroe County Social Services Transit department, This grant is
intended to enhance mobility and accessibility for seniors and persons with disabilities by providing
funding for programs such as Monroe County Social Services Transportation (MCT) to purchase
vehicles. These vehicles are equipped to serve the special needs of transit dependent populations
beyond traditional public transportation and in accordance with the Americans with Disabilities Act
(ADA).
Although the BOCC, on 12/11/13, authorize4 the advertisement of and holding this public hearing for
its 1/16/2014 meeting, this item was inadvertently omitted from the January 2014 agenda. The hearing
has been advertised in The Key We, Citizen on 12/20/13, the Keynoter on 12/21/13, and The Reporter
on 12/20/13 for 1/16/14 at 3 pro. Due to application and advertisement deadlines in the grant
requirements, this hearing must be held on 1/16/2014.
PREVIOUS RELEVANT BOCC ACTION: Prior approval granted by the BOCC on 12/11/13 (Item
C5) to hold public hearing on 1/16/2014 to solicit input on the purchase of one transportation bus and
acceptance of any subsequent grant awards.

ALL INTERESTED PARTIES, WITHIN MONROE COUNTY, FLORIDA are hereby
advised that the Board of County Commissioners of Monroe County, Florida, is considering
applying to the Florida Department of Transportation for a capital grant under Section 5310 of the
Federal Transit Act of 19�91, as amended, for the purchase of one (1) 21' Glaval Para -transit bus,
made by Getaway Bus, Inc., approximate cost $75,000.00, to be used for the provision of public
transit services within Monroe County, Florida.
A public hearing has been scheduled for January 16, 2,014, at 3:0�0 P.M. at the Harvey
Government Center, 1200'Truman Avenue, Key West, Monroe County, Florida, to advise all
interested parties of service being contemplated if a grant is awarded, and to ensure that
contemplated services would not represent a duplication of current or proposed services provided
by existing transit or Para -transit operators in the area.
Any person requesting a hearing must notify the applicant, Sheryl Graham, Social Services
Director, Monroe County Social Services, 11.00 Simonton Street, 2-257, Key West, FL 33040 of
the request, in writing, and send a copy of the request for a hearing to Dionne Richardson,
Manager, FDOT District Office, 1000 N. W. I I Vh Avenue, Room 6111, Miami, Fl, 33172. The
request for a hearing must be received no later than two (2) days prior to the scheduled public
hearing.
Pursuant to Section 286.0105, Florida Statutes,, notice is given that if a person decides to appeal
any decision made by the Board with respect to any matter considered at such hearings or
meetings, he will need a record of the proceedings, and that, for such purpose, he may need to
ensure that a verbatim record of the proceedings is made, which record includes the testimony and
evidence upon which the appeal is to be based.
Florida Law and Title VI of the Civil Rights Act of 1964 prohibits Discrimination in Public
Accommodation on the basis of race, color, religion, sex, national origin, handicap, or of marital

ITEM BACKGROUND: The Florida Department of Transportation Section 5310 Grant is generally
applied for on an annual basis by the Monroe County Social Services Transit department. This grant is
intended to, enhance mobility and accessibility for seniors and persons with disabilities by providing
funding for programs such as Monroe County Social Services Transportation (MCT) to purchase
vehicles. These vehicles are equipped to serve the special needs of transit dependent populations
beyond traditional public transportation and in accordance with the Americans with Disabilities Act
(ADA).
PREVIOUS RELEVANT HOCC ACTION: Approval granted by the WCC on 1/16/13 of a public
hearing to satisfy public input grant application requirements, for the purposes of purchasing one
transportation bus and acceptance of any subsequent grant awards.

Public Hearing
An opportunity for a public hearing is required ONLY for Public Agencies requesting Capital grants under
SecdouS310- An application for Section 5310 submitted by public agency should contain a copy of the notice of
public hearing (identified as Exhibit Q and an affidavit of publication. If Exhibit C is not applicable, this should
be stated In the application.
A sample public notice is, located in the Appendix of this manual. A public notice should contain all pertinent
information relating to the project (such as number and types of vehicles as well as the estimated cost of the vehicles) and
should be published at least one tune in a newspaper of general circulation in the applicant's service area, no less thane 15
or more than 30 days prior to the submission of an application. The notice should state that persons requesting a hearing
must notify the applicant of the request, in writing, and send a copy of the request for a hearing to, the FDOT District
office.
The deadline for hearing requests must be prior to the date applications are due at the District Office. If a hearing is
requested.

If the applicant is a Community Transportation Coordinator (CTC), this informatioti should be shown in Exhibit D of the
application. Attached to Exhibit D should be a copy of the CTCs, certification.
If the applicant is not a CTC, a copy of the written coordination agreement between the applicant and the CTC` in the
appropriate service area should be identified as Exhibit Ti and included in the application. The agreement must be
specific as to how the services to be provided will complimentary to the services the CTC provides, and how duplication
and fragmentation of services will be avoided. If the, applicant's service extends into areas covered by more than one
CTC, copies ofaU applicable coordination agreements should be included in the application. An executed Commission
for the Transportation Disadvantaged Coordination Contractor similar document may serve as the written coordination
agreement Applications submitted without the appropriate coordination agreement may be rejected by FD,OT. Grant
awards will not be made without an appropriate coordination agreement.
