ITEM BACKGROUND:
The applicant has requested a special pen -nit to utilize the subject property for a temporary construction
staging area. The staging area would facilitate a canal restoration/water quality improvement project
being carried out by Monroe County.
If approved, the expected commencement date of the staging area is February 9, 2015 and shall expire
February 1, 2016.
PREVIOUS RELEVANT 13OCC ACTION:
At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6-3 of the Monroe
County Code, which provides the approval process for temporary construction staging areas with a
special permit granted by the BOCC.

WHEREAS, an an application was filed for a special permit allowing a temporary
construction staging area at 11 Pigeon Drive, Key Largo, approximate mile marker 106 (Florida
Bay side of the Overseas Highway); and
WHEREAS, the property is legally described as Block 11, Lot 43, Sexton Cove Estates
(Plat Book 6, Page 30), having real estate (RE) Number: 00532701.032800; and
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
grant the special permit allowing a temporary construction staging area; and
WHEREAS, the temporary construction staging area would facilitate a canal
restoration/water quality improvement project being carried out by Monroe County; and
WHEREAS, due notice has been carried out and a public hearing has been held in
accordance with Monroe County Section 6-3; and
WHEREAS, at said public hearing, the Board considered the argument of all parties
present wishing to speak on the matter; and
WHEREAS, the Board makes the following Findings of Fact and Conclusions of Law:
1. The temporary construction staging area is not inconsistent with any of the criterion
provided in Monroe County Code §6-3;

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the preceding Findings of
Fact and Conclusions of Law support its decision to approve the request for a special permit,
subject to the following conditions:
1. The temporary construction staging area shall only be used in association with the canal
restoration project for Canal 429 on Key Largo.
2. The expected commencement date of the temporary construction staging area is February
9, 2015. The termination date of the temporary construction staging area shall be no later
than February 1, 2016,
3. Other than fencing, no temporary structure associated with the temporary construction
staging area shall be located in any required setback.
4. Upon termination of the temporary construction staging area, the property shall be
restored to its prior condition.

29 The BOCC has the authority to approve temporary construction staging areas in accordance
30 with MCC §6-3. A special permit may be granted by resolution by the BOCC to allow a
31 property to be used as a construction staging area for an off -site project, The BOCC shall
32 hold a public hearing on the request for a temporary construction staging area and shall issue
33 a resolution granting, granting with conditions or denying the request. The resolution shall
34 take effect on the date of enactment by the BOCC,
35
36 Applicability. A temporary construction staging area for an off -site project is a permitted
37 activity in any land use (zoning) district, provided it is approved by a special permit and
38 meets the criteria set forth in MCC §6-3. This special permit shall approve the temporary
39 construction staging area location and use and shall not override or substitute for any other
40 provision of the Florida Building Code and Monroe County Code that require an additional
41 type of building permit, certification or approval.

43 Criteria. Approval of such a special permit shall be granted only if the following criteria are
44 met:
45
46 (1) The temporary construction staging area shall serve a project being carried out in the
47 vicinity of the construction staging area: In compliance.
48
49 The proposed staging area is adjacent to the canal (Canal 429) which is subject to the
50 canal restoration project.

(2) The temporary construction staging area shall serve a project being carried out by a
governmental agency: In compliance.
The canal restoration project is being carried out by Monroe County, Florida.
(3) The temporary construction staging area shall be not be located in a tier I designated area:
In compliance.
The proposed staging area would be located on a property that is in a tier III designated
area.
(4) The property subject to the request shall be posted and surrounding property owners
within 300 feet shall be notified in writing at least 15 days priorto the BOCC public
hearing, with the notice located so it shall be easily visible from all public streets and
public ways abutting the property: Compliance to be determined prior to public hearing,
Planning & Environmental Resources Department staff shall carry out the notification as
required.
(5) Prior to establishment of the temporary construction staging area, a special building
permit approving any associated temporary structure shall be issued in accordance with
MCC §6-112: In compliance,
The proposed staging area will not have any structure requiring a building permit.
(6) No clearing or filling shall occur to accommodate the temporary construction staging
area: In, compliance.
The proposed staging area would be located on a property that is predominately scarified.
No clearing or filling shall occur to accommodate the staging area.
(7) Other than fencing, no temporary structure associated with a temporary construction
staging area shall be located in any required setback: In compliance.
According the plans submitted with the application, other than fencing, no structure or
storage would be located in a required setback.
(8) The temporary construction staging area shall be compatible with existing uses on
surrounding properties, as determined by the BOCC. If necessary, prior to issuance of a
special permit allowing the temporary construction staging area, the board may attach
conditions to any special permit approval to a) avoid substantial harm to public health or
safety; b) avoid substantial harm to, or impairment of the normal use of, a public place;
and/or c) avoid substantial harm to the environment. Depending on the nature and
anticipated duration of the use, as a condition of approval to the special permit, the board
reserves the right to: a) Provide a deadline for termination of the construction staging

area; b) Limit the hours of operation; c) Limit the type of equipment and materials on the
site; d) Require fencing, landscaping and/or other screening to limit potential visual and
noise impacts of the use on adjacent property owners; and e) Require surface water
management improvements to the affected site: In compliance.
The BOCC reserves the right to attach such conditions to any special permit approval at
the January 21, 2015 public hearing.
(9) The property shall be restored to its prior condition: Compliance to be determined upon
termination of the staging area.

Any Proposed Surface Water Management Improvements: The Contractor will be requirts

review/approval before commencement of construction activities.
Current Vegetation: The property is currently a maintained lawn except for a fringe of mixed
mangrove, buttonwoods and invasives located along the canal water front. A Red Mangrove
Trimming Plan has been submitted with the Monroe County Building Permit Application,
USACE Dredge and Fill permit application and is part of the SFWMD Environmental Resource
Permit to allow access for a conveyor belt to move clean fill -from a land side staging area to
barges located in the canal. A copy of the Red Mangrove Trimming Plan is attached which
includes the protection measures that will be implemented during construction to protect the
mangroves.

Although perspective contractors have suggested that trimming the mangroves will not be
required to properly position the conveyor belt, it is AMECs assessment that additional space
may be required by the contractors, The following terms used in this mangrove trimming plan
are defined as follows-

to trim up to two (2) red mangroves if dd necessary by the chosen contractor. Aliteration of
mangrove trunks, or prop roots will not be necessary due to the following:
1. The dimensions of the mobile conveyor belt will fit in between the existing mangrove
trunks.
2. The conveyor belt will be positioned several feet above the prop roots as a resuilt of t
conveyor belts 30 degree incline. I

the staging area to prevent the movement of sediment into the mangrove fringe. In addition, on -
site personnel wil�l be instructed to pick up any loose fill material that falls off the conveyor belt
and into the mangrove fringe wetland, Construction personnel will be informed not to harm or
alter any mangrove speciesi. No enhancement or mitigation is being proposed as part of Option
1 .
The winning contractor deems that the existing gap is not sufficienit to properly position the
conveyor belt and determines that the adjacent red mangroves need to be trimmed to provide
adequate space for the scoped, conveyor belt. The contractor will hire! a Professional Mangrovq,
Trimmer (PMT)i to trim the upper portions of the adjacent red mangroves so that the conveyor
belt can be properly positioned. This is measured to be above 5 feet from the base of the
adjacent mangroves. The trimming will adhere to 1996 Mangrove Trimming and Preservation
Act and result in no permanent damage to existing mangroves. This action will result in! the
expansion of the existinggap or windowby selectively trimming secondary limbs. The
9,econdary limbs will be less than 1 inch in diameter. The trunks and prop roots of the red
mangroves will not be altered'. The proposed areas requiring trimming are illustrated on
Photos'l and 2. The photos are attached;,
