ITEM BACKGROUND: The applicant has requested a special pen -nit to utilize the subject property for a temporary construction staging area. The staging area would facilitate a canal restoration/water quality improvement project being carried out by Monroe County. If approved, the expected commencement date of the staging area is February 9, 2015 and shall expire February 1, 2016. PREVIOUS RELEVANT 13OCC ACTION: At the December 10, 2014 meeting, the BOCC approved an ordinance establishing §6-3 of the Monroe County Code, which provides the approval process for temporary construction staging areas with a special permit granted by the BOCC. The temporary construction staging area is not inconsistent with any of the criterion provided in Monroe County Code §6-3; 2 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that the preceding Findings of Fact and Conclusions of Law support its decision to approve the request for a special permit, subject to the following conditions: 1. The temporary construction staging area shall only be used in association with the canal restoration project for Canal 429 on Key Largo. 2. The expected commencement date of the temporary construction staging area is February 9, 2015. The termination date of the temporary construction staging area shall be no later than February 1, 2016, 3. Other than fencing, no temporary structure associated with the temporary construction staging area shall be located in any required setback. 4. A special permit may be granted by resolution by the BOCC to allow a 31 property to be used as a construction staging area for an off -site project, The BOCC shall 32 hold a public hearing on the request for a temporary construction staging area and shall issue 33 a resolution granting, granting with conditions or denying the request. The resolution shall 34 take effect on the date of enactment by the BOCC, 35 36 Applicability. A temporary construction staging area for an off -site project is a permitted 37 activity in any land use (zoning) district, provided it is approved by a special permit and 38 meets the criteria set forth in MCC §6-3. This special permit shall approve the temporary 39 construction staging area location and use and shall not override or substitute for any other 40 provision of the Florida Building Code and Monroe County Code that require an additional 41 type of building permit, certification or approval. 42 43 Criteria. Approval of such a special permit shall be granted only if the following criteria are 44 met: 45 46 (1) The temporary construction staging area shall serve a project being carried out in the 47 vicinity of the construction staging area: In compliance. 48 49 The proposed staging area is adjacent to the canal (Canal 429) which is subject to the 50 canal restoration project. Page 2 of 4 (File #2014-132) (2) The temporary construction staging area shall serve a project being carried out by a governmental agency: In compliance. The canal restoration project is being carried out by Monroe County, Florida. (3) The temporary construction staging area shall be not be located in a tier I designated area: In compliance. The proposed staging area would be located on a property that is in a tier III designated area. (4) The property subject to the request shall be posted and surrounding property owners within 300 feet shall be notified in writing at least 15 days priorto the BOCC public hearing, with the notice located so it shall be easily visible from all public streets and public ways abutting the property: Compliance to be determined prior to public hearing, Planning & Environmental Resources Department staff shall carry out the notification as required. (5) Prior to establishment of the temporary construction staging area, a special building permit approving any associated temporary structure shall be issued in accordance with MCC §6-112: In compliance, The proposed staging area will not have any structure requiring a building permit. (6) No clearing or filling shall occur to accommodate the temporary construction staging area: In, compliance. The proposed staging area would be located on a property that is predominately scarified. No clearing or filling shall occur to accommodate the staging area. (7) Other than fencing, no temporary structure associated with a temporary construction staging area shall be located in any required setback: In compliance. According the plans submitted with the application, other than fencing, no structure or storage would be located in a required setback. (8) The temporary construction staging area shall be compatible with existing uses on surrounding properties, as determined by the BOCC. If necessary, prior to issuance of a special permit allowing the temporary construction staging area, the board may attach conditions to any special permit approval to a) avoid substantial harm to public health or safety; b) avoid substantial harm to, or impairment of the normal use of, a public place; and/or c) avoid substantial harm to the environment. The BOCC reserves the right to attach such conditions to any special permit approval at the January 21, 2015 public hearing. In addition, on - site personnel wil�l be instructed to pick up any loose fill material that falls off the conveyor belt and into the mangrove fringe wetland, Construction personnel will be informed not to harm or alter any mangrove speciesi. No enhancement or mitigation is being proposed as part of Option 1 . The winning contractor deems that the existing gap is not sufficienit to properly position the conveyor belt and determines that the adjacent red mangroves need to be trimmed to provide adequate space for the scoped, conveyor belt. The contractor will hire! a Professional Mangrovq, Trimmer (PMT)i to trim the upper portions of the adjacent red mangroves so that the conveyor belt can be properly positioned. This is measured to be above 5 feet from the base of the adjacent mangroves. The trimming will adhere to 1996 Mangrove Trimming and Preservation Act and result in no permanent damage to existing mangroves. This action will result in! the expansion of the existinggap or windowby selectively trimming secondary limbs. The 9,econdary limbs will be less than 1 inch in diameter.
