A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA REQUESTING THE SUPERVISOR OF
ELECTIONS TO PLACE ON THE NOVEMBER 8, 2016 GENERAL ELECTION
BALLOT TO THE ELECTORS OF THE DUCK KEY SUBDIVISION THE
REFERENDUM QUESTIONS DETERMINING WHETHER A
BEAUTIFICATION AND IMPROVEMENT DISTRICT SHOULD BE CREATED
THAT SHALL REPLACE THE SECURITY DISTRICT AND IF THE
BEAUTIFICATION AND IMPROVEMENT DISTRICT SHOULD NOT BE
AUTHORIZED SHOULD THE EXISTING CAP ON THE SECURITY
DISTRICT'S NON AD VALOREM SPECIAL ASSESSMENT BE REMOVED
AND SET AT A MINIMUM OF$300 PER UNIMPROVED LOT.
WHEREAS,Section 125.01(1)(q), Florida Statutes authorizes the Monroe County Board of
County Commissioners(BOCC)to establish, subsequently merge or abolish those municipal service
taxing or benefit units for any part of all of the unincorporated area of the county; and
WHEREAS,the Duck Key Security District(DKSD)was established in 1992 for security services
only pursuant to Section 125.01(1)(q), F.S. and has operated as a municipal service benefit unit
thereafter;and
WHEREAS,the Duck Key District advisory board and some residents of Duck Key have indicated
that they support expanding the services of the DKSD and support creating the Duck Key Beatification
and Improvement District(DKBID)that shall replace and expand upon the current DKSD thereby
imposing only one special assessment for services; and
WHEREAS, Ordinance 005-1992, after approval of a referendum of the electors, established the
DKSD and the initial special assessment of$200.00 per improved lot and$20.00 per unimproved lot; and
WHEREAS, Ordinance 005-1992 provides that there "shall be no need for referenda in
subsequent years unless an assessment increases more than ten percent(10%)over the previous year
or increases to more than the sum of$300.00 per improved lot or more than the sum of$30 per
unimproved lot in any given year";and
WHEREAS,while the special assessment is expected to increase this year by 10%as allowed by
ordinance, it had not been increased since 1992,and regardless of whether the DKSD is ultimately
expanded, it is expected that the special assessment should be increased beyond the ten percent(10%)
over the previous year and/or increased to more than the sum of$300.00 per improved lot or more
than the sum of$30 per unimproved lot to fund security services; and

WHEREAS, due to inflation,$200 in 1992 is worth$343.04 in 2016, and$200 in 2016 has the
same worth that$116.61 had in 1992;1
WHEREAS, in order for the BOCC to determine whether the electors of the boundaries of the
Duck Key Subdivision support creating a DKBID and, if there is not support for the DKBID, whether
there is support to increase the special assessment and remove the special assessment cap a
referendum as set forth below is desired;and
WHEREAS,this referendum is necessary2 to place the two questions below on the ballot for the
November 2016 general election;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Monroe County,
Florida that:
Section 1.The Supervisor of Elections is hereby directed to place the two referendum questions set forth
below on the November 8,2016 General Election ballot within the following described area:
Center Island, Plantation Island, Harbour Island, and Yacht Club Island of
Duck Key Subdivision according to the resubdivision thereof as recorded
in Plat Book 4, Pages 7, 8, 9, 10, 11 and 12 of the Public Records of
Monroe County, Florida, but excluding Section 1, also known as Indies
Island of that resubdivision. More particularly described as a portion of
Section 16 and 20, 21,Township 65S, R34E, Monroe County, Florida.
Section 2.The referendum questions shall be in substantially the following form:
Creation of Duck Key Beautification and Improvement District to Replace the Duck Key Security
District
Should Monroe County create the Duck Key Beautification and
Improvement District and levy an initial non-ad valorem assessment in
the amount of$300 per unimproved lot and $500 per improved lot for
services to include security, beach erosion control, recreation services
and facilities, landscaping, and canal maintenance and restoration
services, which shall then replace the current Duck Key Security District
and eliminate the current special assessment imposed for security
services only?

Section 4.Advertisement of the Ballot Questions.
The County Attorney shall cause to be advertised in a paper of general circulation at least twice, one in
the fifth week and once in the third week prior to the week in which the referendum is to be held.
Section 5. Effective Date.
This resolution shall be effective on August 17, 2016.

regular meeting of said Board held on the 17th day of August, 2016.
