Due to the departure of former County employees, increased workload and an analysis of FTE's vs. contractual services (attached) the annual maximum contract compensation needs to be adjusted to $950,000 from $500,000 maximurn. Exhibit B is being amended to distinguish different rates for Biologists based upon whether they are employed directly or subcontracted for employment through M.T. Causley, Inc. We have been utilizing their set -vices since that time. Without their service we would not have been able to have an electric plans examiner at both main geographic locations (Marathon and Key Largo) given the fact that we advertised and actively recruited for that position and not one qualified applicant (license required by DBPR). These types of recruitment issues are prevalent Countywide; however, under the law, we cannot allow an unlicensed individual to conduct a review for a discipline they are not licensed to do, which means we could at times be unable to do permitting. In permitting, there is a set core staff needed for each location, which is key to maintaining institutional knowledge, consistent application of codes and interpretations, and being able to provide services to pen-nittees. We also have a permit intake/issuance office in Stock Island with 2 CSRs staffing that office and the Commission added an Ocean Reef Office for FY15, opening March 3, 2015 which will have a fulltime CSR and will rotate Structural, Mechanical, Plumbing, Electric, Planning, Environmental, and Fire to conduct plan review of those permits. We added 10.5 total Full Time Equivalents (FTEs) to the Growth Management (Building [Fund 180], Planning [Fund 148], and Growth Management Admin [Fund 148]) budgets (Attachment 3), 8 of which directly impact permitting services. As part of the discussion, the Board requested I evaluate whether using MT Causley (private, on,. call inspectors Plans Examiners, Customer Service Representatives LCSRs)/Pennit Technicians,, Planners, and/or Biologists) would be better than adding fulitime.,positions. As demonstrated in the tables above it is best to have at least one falltime person with the licensing in the first column at each full service location. I provided a Summer Studies Memorandum, dated August 27, 2014 (Attachment 1) that demonstrated the cost difference in certain positions between bringing a full-time employee and utilizing an MT Causley person to fulfill needed positions,. Keep in mind the memorandum only demonstrates salary. There are other cost savings for NIT Causley folks because we do not buy vehicles or pay for fuel for the NIT Causley inspectors, Based on BOCC direction in the summer, working with senior staff of the Division we have been flexing MT Causley staff to fill the needs of CSRs (3), Building Structural Plans Examining (1), and Electrical Plans Examining and Inspecting (1). We also are using an MT Causley person to fulfill the position of Building Official. Without MT Causley we would not have been able to function in the area of Electrical Plans Examining, over the past 2 years, as we only have I licensed electric plans exam iner/inspector. We have made an offer to an individual that can fill the Electric Plans Examining/inspecting function permanently. This individual has every license for plans examining and will eventually be a lead plans examiner for Marathon (existing plans examiner likely to retirement in FY15). We have yet to find a Mechanical/Plumbing candidate. Because of licensing requirements we are unable to determine exactly what our needs are and must be ready to shift duties based on licensing when a multi -licensed individual resigns. Having NIT Causley staff is imperative to maintaining a seamless permit review process. For maximum flexibility purposes in service provision, we are seeking to move salary funds to the MT Causley contract and bring the total maximum per FY to $950,000. That is $450,000 more than the $500,000 maximum annual amount in the contract today. Attachment 4 is a general tracking of expenditures during FY14 and expenditures to date. The personnel services (salaries/benefits) portion of the Building ($2.5 Million), Planning and Environmental ($1 ,5 Million) budget is approximately $4 Million. There are 38 Full Time Equivalents in Building and 23 Full time Equivalents in Planning/Environmental. This increase indicates that approximately 23.5% of the total personnel expenditures could be MT Causley fees ($950,000 of $4,M). Consultant shall provide all information necessary for the County to facilitate payment. V. RENEWAL The Consultant shall secure, maintaii�n and pay for any licenses: necessary to perform dut ies, and services under this contract. It is the Consultant's responsibility to maintain all professional, licenses that may be required as well as any licenses or other certifications for any staff provided to the County under this contract by the Consultant. By signature hereon, the Consultant warrants thiat it is authorized by law to engage in the performance of the activities herein, described, subject to the terms and conditions set forth in these contract documents. Proof of such licenses and approvals shall be submitted to the County upon request. The Consultant has, and shall maintain throughout the term of this contract, appropriate licenses and activities in a reputable and professional manner. At all times and for all purposes, the Consultant, its agents and employees are strictly considered to be independent Contractors in the:ir performance of the work contemplated hereunder. During the term of this agreement, and for a period of one year after termination of thiis, agreement, the: County shall not negotiate with or hire anyindividual who is employed with the Consultant at the termination of this agreement without the Consultant's prior authorization. The County may hire the Consultant's employee provided the Consultant is compensated the employee's annual saim. Temporary support personnel must be neat and clean experienced workers and drug free., I Temporary support personnel shall be mentally, emotionally, and physically competent to perform the services required. The Consultant must assume the employer/employee relationship. National Crime Information Center backgrounds and police checks may be done on temporary support personnel by the County at any time during the contract period. 6. Persons employed by the Consultant in the performance of services pursuant to thiis contract shall not be considered; employees of the County, shiall be independent thereof and shall have no claim against the County as to: pension, worker's compensation, unemployment compensation, insurance, salary, wages or other employee rights or privileges granted by operation of law or by the County to its officers and employees. 7. The Consultant agrees, to reimburse the County for any improper charges, which can b.- documented as a result of the Consultant's employee(s) making unauthorized long distanc,.- telephone calls or other inappropriate use of County property while working at or on behalf of the i County. 8. Professional behavior and conduct w�ill be demonstrated by Consultant's employees at all times while performing work assignments under this contract. All employees provided by Consultant shall be eqed to dress in professional, conservative business -like attire, suitable for public exposure. No jeans, T-shirt�s, or athletic shoes will be allowed, unless approved by the County Department to which the temporary personnel are assignedi. Consultant must provide its employees with suitable safety attire including puncture proof footwear for work assignments conducted in the field.
