: Sugarloaf Fire Station Property
Recommendation:
Enter an agreement with the Sugarloaf Volunteer Fire Dept., Inc.
(Volunteers), for transfer of ownership of the building and property to the County and proceed
with plans for a new fire station on the existing property. If the property is leased to the County,
such lease should provide the County with exclusive rights to use of the property.
Basis for Recommendation:
1. The existing site is preferred by the Monroe County Fire Rescue.
2. No available alternative sites for the fire station on Lower Sugarloaf Key have been
found to date.
3. Control of developments on the site is essential because space is very limited and
expansion of the site is not possible.
Background:
Staff believes that the County’s and community’s interests are best served by replacement of
the fire station on the existing property. To move forward with such a plan, the County should
have exclusive, full control of the property on which such new station is built. The Volunteers
have proposed that the property be leased to the County on a long term (99 year) basis. Their
proposal includes a provision (#4) that the County honor, respect, and incorporate any previous
agreement made by the SLVD into the future use of the property. The proposal does not
specify what those agreements are. This appears to be an allusion to an agreement they have
said exists with Keys WiFi, Inc. to install a cellphone tower on the site. Keys WiFi, Inc. has
submitted an application for planning approval for such a tower within the last week. We
requested a copy of the agreement between Keys WiFi, Inc. and the Volunteers but were told it
includes proprietary information and our request was declined.
The site plan we were furnished by Keys WiFi, Inc. shows a tower and support building installed

on the southwest side of the existing building. It includes a fenced “leased area” of 950 ft and
an access easement along the southwest edge of the property of 12 feet. Collectively this

encumbers approximately 18% of the useable land on the site. The entire site is 22,000 ftof

which only 11,000 ft useable because the remainder is classified as “environmentally
sensitive”.
Attached are documents as background for agenda item I-1 “Discussion & direction for the
Sugarloaf Fire Station”. Included are e-mails exchanged with the Sugarloaf Volunteer Fire Dept.,
Inc.; request by the Sugarloaf Shores Property Owners’ Assoc.; copies of the deeds and
property records for the existing fire station property; Articles of Incorporation and Bylaws of the
Volunteer Corporation; and the site plan furnished by Keys WiFi, Inc., which shows the
proposed location of the cell tower and support structures.
