Resolution 028-2019 • • g97P(.1 slV�r 7=1' 4 � 5 6 MONROE COUNTY, FLORIDA 7 MONROE COUNTY BOARD OF COUNTY COMMISSIONERS 8 RESOLUTION NO. 028 -2019 9 10 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY 11 COMMISSIONERS WAIVING APPROXIMATELY $85,200 IN 12 BUILDING PERMIT FEES FOR A TOTAL OF 12 DEED-RESTRICTED 13 HOUSING UNITS OF SERVING THE 100% OF MEDIAN INCOME 14 LEVEL (4 UNITS OF MEDIAN INCOME) AND 120% OF MEDIAN 15 INCOME (8 UNITS OF MODERATE INCOME) CATEGORIES, TO BE 16 CONSTRUCTED ON PARCELS LOCATED ON BAILEY ROAD AND 17 MERCEDES ROAD ON BIG PINE KEY, AT APPROXIMATE MILE 18 MARKER 31, CURRENTLY HAVING REAL ESTATE NUMBERS 19 00300180-000500, 00300180-000600, 00300180-000700, 00300180-000800, 20 00300180-000900, 00300590-000300, 00300590-000400, 00300590-000500, 21 00300590-000600, 00300590-000700, 00300590-000800, AND 00300670- 22 000000. 23 24 WHEREAS, on November 18, 2009 the Monroe County Board of County 25 Commissioners ("Board") passed and adopted Ordinance 036-2009, allowing not-for-profit 26 organizations with 501(c)(3) status from the Internal Revenue Service and constructing 27 affordable or low income housing as defined by state statutes, and allowing any entity 28 constructing affordable low or very low income housing as defined by state statutes, to apply for 29 waivers from building permit fees; and 30 31 WHEREAS, on February 17, 2010, the Board passed and adopted Ordinance 004-2010, 32 allowing waivers from building permit fees for construction of affordable housing intended for 33 occupancy for those households with income up to 120% of median annual adjusted gross 34 income in Monroe County, and allowing persons or entities building affordable housing which 35 uses a higher percentage median income than 120%to apply for such permit fee waivers only if 36 the specific development project is being subsidized with or is leveraging state or federal 37 funding; and 38 39 WHEREAS, Longstock II LLC submitted the Application for Building Permit Fee 40 Waiver on December 20th, 2018. Subsequent to December 20th, Longstock II LLC conveyed the 41 subject parcels to Conch Republic Housing Alliance LLC. The legislative intent of this Page 1 of 3 1 Resolution is that the instant fee waiver shall apply to the building permit applicant of record; 2 and 3 4 WHEREAS, Section 6-108(e), Monroe County Code, allows for Board approval of 5 waivers from building permit fees for affordable housing which have a Development Order in 6 effect. Recitals and Legislative Intent. The foregoing recitals and statements of 27 legislative intent are true and correct and are hereby incorporated as if 28 fully stated herein; and 29 30 Section 2. Building permit fees are waived pursuant to Section 6-108(e), Monroe 31 County Code, for each of the 12 parcels with permit applications described 32 herein, on the condition that for each and every parcel with permit 33 application evidence of an Affordable Housing Deed Restriction accepted 34 and/or approved by both the Senior Director of Planning & Environmental 35 Services and the Office of the County Attorney and recorded in the Page 2 of 3 1 Official Records of Monroe County, Florida, shall be provided to the 2 Building Department. 3 4 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, 5 Florida, at a regular meeting held on the 23rd day of January , 2019. 6 7 Mayor Sylvia J.
