13 COUNTY COMMISSIONERS AUTHORIZING THE
14 PLACEMENT AND DURATION OF TEMPORARY
15 EMERGENCY HOUSING FOR RELIEF WORKERS,
16 PURSUANT TO MONROE COUNTY LAND
17 DEVELOPMENT CODE SECTION 103-1(e) FOR
18 PROPERTY LOCATED AT 31065 AVENUE F; 31371

24 WHEREAS, the Board of County Commissioners is the legislative body of Monroe
25 County, Florida; and
26
27 WHEREAS, the Monroe County Mayor declared a State of Local Emergency on
28 September 5, 2017 due to Hurricane Irma, a"threat of danger to the populace inhabiting Monroe
29 County" and that the County "may require expedient action in order to protect the health, safety
30 and welfare of the community;" and
31
32 WHEREAS, Hurricane Irma, a Category 4 hurricane, made landfall in the Florida Keys
33 on September 10, 2017, causing substantial damage to and loss of property; and
34
35 WHEREAS, the Monroe County Mayor issued other declarations a State of Local
36 Emergency on September 13, 2017, September 20, 2017, September 25, 2017, September 26,
37 2017, October 3, 2017, and October 11, 2017, due to Hurricane Irma, a "threat of danger to the
38 populace inhabiting Monroe County" and that the County "may require expedient action in order
39 to protect the health, safety and welfare of the community;" and

1 WHEREAS, Monroe County experienced a natural disaster, Hurricane Irma, which
2 caused significant damage to residences,businesses and infrastructure throughout the County; and
3
4 WHEREAS, pursuant to Section 103-1(b) of the Monroe County Land Development
5 Code, it is the purpose of this section to provide regulations that allow for the relaxation of the
6 use prohibitions in Chapter 130, Land Use Districts, and Chapter 138, Rate of Growth Restrictions
7 (ROGO/NROGO), to: (1) Provide regulatory authority to allow temporary emergency housing,
8 not subject to the ROGO permit allocation system,for temporary occupancy by residents displaced
9 by natural or manmade disaster damage or by relief workers involved in reconstruction activities
10 following a natural or manmade disaster; and
11
12 WHEREAS, pursuant to Section 103-1(a), temporary emergency housing means
13 recreational vehicles (or similar approved sheltering units) used for temporary occupancy in
14 response to natural or manmade disasters, including, but not limited to, hurricanes and tropical
15 storms, where such RVs (or other approved sheltering units) are provided to residents or relief
16 workers as part of emergency relief efforts; and recreational vehicle (RV) means the same as that
17 term is defined in F.S. § 320.01; and
18
19 WHEREAS, pursuant to Section 103-1(e), temporary emergency housing may be
20 provided for temporary occupancy by emergency relief workers involved in reconstruction
21 activities subject to certain conditions; and
22
23 WHEREAS, the County has experienced significant damage to numerous homes, and
24 must utilize available locations to provide secure temporary housing for the disaster recovery of
25 the community; and
26
27 WHEREAS, Maggie Whitcomb, of the Florida Keys Community Land Trust has
28 requested approval from the Board of County Commissioners to place temporary emergency
29 housing for emergency relief workers on the subject parcels;
30
31 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
32 COMMISSIONERS OF MONROE COUNTY, FLORIDA:

34 Section 1. Placement. The property located at 31065 Avenue F; 31371 Avenue F; 30035
35 Linda St.; 31121 Avenue G; and 31250 Avenue I; on Big Pine Key, having Parcel Numbers
36 00256500-000000, 00305350-000000, 00305850-000000, 00307000-000000, and 00306330-
37 000000,are hereby approved for placement of temporary emergency housing for emergency relief
38 workers pursuant to Section 103-1(e) of the Land Development Code.

1 Section 2. Duration. The temporary emergency housing may remain on the subject
2 property for three (3) years from the date of this resolution. The duration may only be extended at
3 the discretion of the BOCC by an additional resolution.

5 Section 3. Conditions.The temporary housing for emergency relief workers placed on the
6 subject property shall comply with all conditions within Section 103-1(e)of the Land Development
7 Code.

9 PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
10 Florida, at a regular meeting of the Board held on the 23rd day of January , 2019.
