33 WHEREAS, the Monroe County Board of County Commissioners conducted a public
34 hearing for the purpose of considering the transmittal pursuant to the State Coordinated Review
35 Process in Sec. 163.3184(4), F.S., to the State Land Planning Agency for objections,
36 recommendations and comments, and to the other Reviewing Agencies as defined in Sec.
37 163.3184(1)(c), F.S., for review and comment on a proposed amendment to the Monroe County
38 Comprehensive Plan as described above; and
39
40 WHEREAS, the Monroe County Planning Commission and the Monroe County Board
41 of County Commissioners support the transmittal of the requested Future Land Use Map
42 amendment;

44 NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
45 COMMISSIONERS OF MONROE COUNTY,FLORIDA:

47 Section 1: The Board of County Commissioners does hereby adopt the recommendation of
48 the Planning Commission to transmit the draft ordinance, attached as Exhibit A,
49 for review of the proposed Future Land Use Map amendment.

51 Section 2. The Board of County Commissioners does hereby transmit the proposed
52 amendment to the State Land Planning Agency for review and comment in
53 accordance with the State Coordinated Review process pursuant to Section
54 163.3184(4), Florida Statutes.

56 Section 3. The Monroe County staff is given authority to prepare and submit the required
57 transmittal letter and supporting documents for the proposed amendment in
58 accordance with the requirements of Section 163.3184(4), Florida Statutes.

60 Section 4. The Clerk of the Board is hereby directed to forward a certified copy of this
61 resolution to the Director of Planning.

30 WHEREAS, on April 11, 2018, the Planning and Environmental Resources Department
31 received an application from the Ocean Reef Club Inc. (the "Applicant") to amend the Monroe
32 County Future Land Use Map (FLUM) from Mixed Use/Commercial (MC), Recreation (R) and
33 Conservation (C) for property located at 100 Anchor Drive, Key Largo; and
34
35 WHEREAS, on July 18, 2018, the Planning and Environmental Resources Department
36 received a revised application from the Applicant to amend the Monroe County Future Land Use
37 Map (FLUM) from Mixed Use / Commercial (MC), Recreation (R) and Conservation (C) to
38 Commercial (COMM) for property located at 100 Anchor Drive, Key Largo; and
39
40 WHEREAS, the Applicant has also requested a corresponding Land Use (Zoning)
41 District map amendment for the subject property from Suburban Commercial (SC), Native Area
42 (NA) and Park and Refuge (PR)to Commercial 1 (C1); and
43
44 WHEREAS, the Monroe County Development Review Committee (DRC) considered
45 the proposed amendment at a regularly scheduled meeting held on December 11, 2018; and
46

1 WHEREAS, the Monroe County Planning Commission held a public hearing on the 1 ltn
2 day of December, 2018, for review and recommendation on the proposed Future Land Use Map
3 amendment; and

5 WHEREAS, the Monroe County Planning Commission made the following findings of
6 fact and conclusions of law:
7
8 1. The proposed FLUM is not anticipated to adversely impact the community character
9 of the surrounding area;
10 2. The proposed FLUM is not anticipated to adversely impact the Comprehensive Plan
11 adopted Level of Service (LOS);
12 3. The proposed amendment is consistent with the Goals, Objectives and Policies of the
13 Monroe County Year 2030 Comprehensive Plan; and
14 4. The proposed amendment is consistent with the Principles for Guiding Development
15 for the Florida Keys Area of Critical State Concern, Sec. 380.0552(7), F.S.;
16 5. The proposed amendment is consistent with Part II of Chapter 163, Florida Statute;
17 and
18 6. The proposed amendment will not result in an adverse change in community
19 character to the sub-area which a proposed amendment affects or to any area in
20 accordance with the Key Largo Livable CommuniKeys master plan pursuant to
21 findings of the BOCC.

23 WHEREAS, the Monroe County Planning Commission adopted Resolution No. P38-18
24 recommending to the Monroe County Board of County Commissioners approval of the proposed
25 amendment; and
26
27 WHEREAS, at a regular meeting held on the 23rd day of January, 2019, the Monroe
28 County Board of County Commissioners held a public hearing to consider the transmittal of the
29 proposed amendment, considered the staff report and provided for public comment and public
30 participation in accordance with the requirements of state law and the procedures adopted for
31 public participation in the planning process; and
32
33 WHEREAS, at the January 23, 2019, public hearing, the BOCC adopted Resolution No.
34 -2019,transmitting the amendment to the State Land Planning Agency; and
35
36 WHEREAS, the State Land Planning Agency reviewed the amendment and the County
37 received its Objections, Recommendations and Comments (ORC) report on
38 and
39
40 WHEREAS,the ORC report ; and
41
42 WHEREAS, in response to the ORC report,
43 ; and

1 WHEREAS, at a regularly scheduled meeting on the day of , , the
2 BOCC held a public hearing to consider adoption of the proposed FLUM amendment;

4 NOW, THEREFORE, BE IT ORDAINED BY THE MONROE COUNTY BOARD OF
5 COUNTY COMMISSIONERS:

7 Section 1. The Future Land Use Map of the Monroe County 2030 Comprehensive Plan is
8 amended as follows:
9
10 The property located at 100 Anchor Drive, Key Largo, Ocean Reef Club, having
11 Real Estate Numbers 00572797-003600 and 00572797-003603, is changed from
12 Mixed Use / Commercial (MC), Recreation (R) and Conservation (C) to
13 Commercial (COMM) as shown on Exhibit 1, attached hereto and incorporated
14 herein.

16 Section 2. Severability. If any section, subsection, sentence, clause, item, change, or provision
17 of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such
18 validity.
19
20 Section 3. Repeal of Inconsistent Provisions. All ordinances or parts of ordinances in conflict
21 with this ordinance are hereby repealed to the extent of said conflict.
22
23 Section 4. Transmittal. This ordinance shall be transmitted by the Director of Planning to the
24 State Land Planning Agency pursuant to Chapter 163 and 380,Florida Statutes.
25
26 Section 5. Filing and Effective Date. This ordinance shall be filed in the Office of the
27 secretary of the State of Florida but shall not become effective until a notice is issued by the
28 State Land Planning Agency or Administration Commission finding the amendment in
29 compliance, and if challenged, until such challenge is resolved pursuant to Chapter 120, Florida
30 Statutes.

32 Section 6. Inclusion in the Comprehensive Plan. The foregoing amendment shall be
33 incorporated in the Monroe County Comprehensive Plan and included on the Future Land Use
34 Map.
