PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES
BETWEEN MONROE COUNTY AND
BENDER& ASSOCIATES FOR
FREEMAN JUSTICE CENTER ROOF REPAIR ASSESSMENT
In accordance with the Agreement for Professional Architectural and Engineering Services, made
and entered into on December 19, 2018, between MONROE COUNTY, hereinafter referred to
as the "County," and BENDER& ASSOCIATES ARCHITECTS,P.A., hereinafter referred to
as "Consultant,"where professional services are allowed if construction costs do not exceed Two
Million and 00/100 Dollars($2,000,000.00),or for study activity if the fee for professional services
for each individual study under the contract does not exceed Two Hundred Thousand and 00/100
Dollars ($200,000.00), hereinafter referred to as the"Agreement".
All terms and conditions of the Agreement apply to this Task Order, unless this Task Order
amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically
referenced in this Task Order and the amendment, addition, or modification shall be precisely
described. These additions apply only to the project referenced in this Task Order.
This Task Order is effective on the 30th of January 2019.
As a result of Hurricane Irma damages to the Freeman Justice Center in Key West, the County
desires a building assessment to do vinyl drip line flashing repairs to the roof of the building.
Consultant is qualified to assess the Freeman Justice Center and report the findings, provide
recommended fixes and estimated duration of those fixes.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below,the
parties agree as follows:
1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement the
Consultant will perform services as described below:
a. Consultant shall conduct an on-site evaluation to assess the two sides of the
building's upper section and investigate the drip line issues.
b. Consultant shall field verify the existing conditions and review the mechanical and
architectural as-built drawings and technical specifications, as available.
c. Consultant shall procure all Historic Architectural Review Commission (HARC)
approvals, produce construction documents, assist in the bidding process and
provide construction administration services during the repair.

2. In accordance with Article VII,paragraph 7.1.1 of the Agreement,the County shall pay the
Consultant a lump sum fee of Two Thousand Three Hundred Fifty and 00/100 Dollars
($2,350.00) paid upon document review and approval by the Director of Project
Management.
3. In accordance with Article IX,paragraph 9.32 of the Agreement,the Contractor is bound
by the terms and conditions of the Federally-Funded Subaward and Grant Agreement
between County and the Florida Division of Emergency Management(Division), found at
the following link on the Monroe County web page: http://fl-

All other Terms and Conditions of the Task Order shall remain in accordance with the Agreement
and as amended.

RE: Freeman Justice Center Roof Repairs
Architectural/Engineering Services Fee Proposal
Dear Cary and Rob,
Thank you for asking us for architectural services for the repair of hurricane damaged roof at the
Freeman Justice Center.
The project includes the following scope:
Design and provide all required documents, bidding, and construction administration for the hurricane
damage at the roof of the Freeman Justice Center.
This scope of work will include the required drawings for both HARC approval and Construction. The
structure is not historic, but a HARC submittal is required, as the building is in the HARC district.
In response to your request,we have procured a cost estimate from a roofer who has experience in
roofing of historic structures.The cost estimate for the roofing work is approximately$15,985, plus the
cost of permits.
We propose to provide the following services:
We will field verify the existing conditions, procure all HARC approvals, produce construction
documents,assist in the bidding process,and provide construction administration services.
We propose to provide architectural/engineering services through completion of construction for a
lump sum fee based on the State of Florida DMS Fee Guide Calculator. I have included this DMS
calculation for reference.The fee is determined as follows:
Basic services fee $1,750
Measured drawings additional services $500
Additional inspection and reimbursable expenses $100
