The planned use of the property is for offices for the Public Defender. Funds will come from the Infrastructure Sales Surtax. ITEM BACKGROUND: Florida law requires that the County provide office space for the Public Defender. Art. V, § 14, Florida Constitution; and F.S. 29.008. The Public Defender currently occupies a rental property at an annual cost of approximately $390,000/year. The lease on the existing property expires at the end of March 2019. The landlord th will not agree to an extension. An interim location at 1111 12 street was leased at a cost of $154,374/year to allow time for completion of the renovation of the proposed new office. The contracted sale price is $2.02 million. Contingencies included in the contract are satisfactory environmental and structural inspections and approval by the City of Key West of the development plans for the property. The latter of these may be a major development approval and that is specifically cited in the contract contingent conditions. Staff obtained two appraisals, copies of which are attached as backup. They were $1.85 million and $2.19 million. The average of the two appraisals is $2.02 million. Because the proposed purchase price is the average of the two appraisals, this purchase can be approved by a simple majority of the Board. F.S. 125.355(1)(b).
