Smith of Smith Hawks PL on behalf of Mobile Home 36 Holdings Coco,LLC"the Applicant,"to amend the Monroe County Comprehensive Plan to create 37 a subarea policy that would provide development restrictions on a portion of the property located 38 at 21585 Old State Road 4A on Cudjoe Key, including a limitation that the only permitted use on 39 the property would be affordable housing and accessory uses; and ; and 40 41 WHEREAS, the Applicant has also requested a corresponding Future Land Use Map 42 (FLUM) amendment for the subject property from Residential High (RH; 1.1 acres) and 43 Residential Conservation (RC; 0.6 acres) to Mixed Use/Commercial (MC; 1.7 acres) and a Land 44 Use District (Zoning) map amendment for the subject property from Urban Residential (UR; 1.1 45 acres) and Native Area (NA; 0.6 acres) to Suburban Commercial (SC; 1.7 acres); and - 46 Ordinance 001-2019 File 2018-050 Page 1 of 6 1 WHEREAS, on May 29, 2018, the Monroe County Development Review Committee 2 (DRC) reviewed the proposed map amendment; and 3 4 WHEREAS, on May 31, 2018, the applicant held a community meeting, as required by 5 LDC Sections 102-158(a) and 102-159(b), to discuss the proposed Comprehensive Plan text 6 amendment, and corresponding proposed Future Land Use Map (FLUM) and Land Use District 7 (Zoning) Map amendments, and provide for public participation; and 8 9 WHEREAS, following the DRC meeting and the community meeting, the Applicant 10 submitted revised proposed text amendment language for the proposed subarea policy based on 11 staff and public comment; and 12 13 WHEREAS, the Monroe County Planning Commission held a public hearing on the 25th 14 day of July, 2018, for review and recommendation on the proposed Comprehensive Plan text 15 amendment; and 16 17 WHEREAS, the Monroe County Planning Commission adopted Resolution No. P25-18 18 recommending to the BOCC approval with changes, as discussed during the Planning Commission 19 hearing, of the proposed amendment; and 20 21 WHEREAS, the proposed text amendment qualifies as a small-scale comprehensive plan 22 amendment pursuant to Section 163.3187, Florida Statutes, for which the BOCC holds one public 23 hearing to consider the adoption of the proposed comprehensive plan amendment, and considers 24 the staff report, staff recommendation, and the testimony given at the public hearing; and 25 26 WHEREAS, at a regular meeting held on the 20th day of February, 2019, the Monroe 27 County Board of County Commissioners held a public hearing to consider adoption of the 28 proposed text amendment,considered the staff report and provided for public comment and public 29 participation in accordance with the requirements of state law and the procedures adopted for 30 public participation in the planning process; 31 32 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY 33 COMMISSIONERS OF MONROE COUNTY, FLORIDA: 34 35 Section 1. 36 37 Policy 107.1.7 Coco Palms Affordable Housing Subarea 38 39 The purpose of Coco Palms Affordable Housing Subarea is to implement applicable goals, 40 objectives, and policies of the Comprehensive Plan to promote and facilitate development of 41 affordable housing to meet the needs of Monroe County. 42 Ordinance 001-2019 File 2018-050 Page 2 of 6 1 1) Boundary. The Coco Palms Affordable Housing Subarea shall be subject to 8 all regulations applicable to the Mixed Use / Commercial (MC) Future Land Use Map 9 designation and the Suburban Commercial (SC) Land Use District (Zoning) category, as well 10 as the additional restrictions set forth in this Policy. Where conflicts may arise, the specific 11 restriction in this Sub Area Policy shall supersede the general criteria applicable to the 12 underlying Future Land Use designation and Land Use District (Zoning) Category. Hildebrandt, Island Surveying, Inc., 11 dated 12/5/17. 12 13 4) Only the land uses listed below shall be permitted within the Coco Palms Affordable 14 Housing Subarea 15 a) Permitted as of right. 16 i. Deed restricted attached or detached affordable dwelling units involving 17 less than six units, designated as employee housing as provided for in LDC 18 Section 139-1; 19 ii. Accessory Uses; 20 iii. Replacement of deed restricted affordable dwelling units (mobile homes) 21 which are as of the effective date of this Policy subject to Chapter 723, 22 Florida'Statutes, in the event of substantial damage or destruction, for so 23 long as such deed restricted affordable dwelling units (mobile homes) are 24 subject to Ch. 723, Florida Statutes; and Ordinance 001-2019 File 2018-050 Page 4 of 6 1 iv. Non-conforming mobile homes existing as of the date of this policy may 2 remain so long as they are not substantially damaged or destroyed. All 3 current occupants may remain under their current leases. Upon expiration 4 of any mobile home lease, in order to obtain a new lease, the tenant(s)must 5 meet the qualifications for affordable employee housing. 6 b) Permitted as a minor conditional use subject to the standards and procedures set 7 forth in the Monroe County Land Development Code Chapter 110, Article III. 8 i. Attached or detached dwellings involving six to 18 units, designated as 9 employee housing as provided for in LDC Section 139-1. 10 11 c) Permitted as a major conditional use subject to the standards and procedures set 12 forth in Monroe County Land Development Code Chapter 110, Article III: 13 i. Attached or detached dwellings involving more than 18 units, designated as 14 employee housing as provided for in LDC Section 139-1. 15 16 d) Permitted and Conditional use limitations. 17 i. All residential units constructed within the subarea shall be deed restricted 18 affordable in accordance with Policy 601.1.4; 19 ii. No market rate housing shall be allocated, assigned, transferred to the Coco 20 Palms Affordable Housing Subarea, or otherwise developed within the 21 Coco Palms Affordable Housing Subarea; 22 iii. Properties within the Coco Palms Affordable Housing Subarea shall not be 23 eligible sender sites for affordable housing ROGO exemptions or TREs; 24 iv. No other residential or nonresidential uses shall be permitted within the 25 subarea; and 26 v. All new residential units developed within the subarea shall be subject to 27 the ROGO permit allocation system and after development of the sixteen 28 new units the resulting thirty-three (33) units shall consist of nineteen (19) 29 moderate income, seven (7) median income and seven (7) low income 30 affordable allocations. Once the sixteen (16) new employee housing units 31 are developed, the affordable housing income restrictions may be 32 reconfigured within the property so as to insure occupant(s) can meet the 33 income requirements for the unit occupied. 34 35 Section 2. Severability. If any section, subsection, sentence, clause, item, change, or 36 provision of this ordinance is held invalid, the remainder of this ordinance shall not 37 be affected by such validity. 38 39 Section 3. Repeal of Inconsistent Provisions. All ordinances or parts of ordinances in 40 conflict with this ordinance are hereby repealed to the extent of said conflict. 41 42 Section 4. Filing and Effective Date. This ordinance shall be filed in the Office of the 43 Secretary of the State of Florida and shall become effective as provided by law. 44 Ordinance 001-2019 File 2018-050 Page 5 of 6 1 Section 5. Inclusion in the Comprehensive Plan. The text amendment shall be incorporated 2 in the Monroe County Comprehensive Plan.
