one flatbed and one pick-up successfully moved the Fine Arts
Council from MM 95 to Islamorada. The move was completed in one
day.
A representative from the Council signed out on all items from
Key Largo and resigned when delivered in Islamorada.

office furniture and files to a new location during the last
week of December, 1994. You indicated to me that the move is
necessary because the Fine Arts Council lease on its presdnt
office expires at the end of December and you must find a new
location.
Subsequently, you indicated to me that you have located cin
office in Islamorada to which you wish to be moved. The Fine
Arts Council has made a month to month arrangement with the
property owner and wishes to keep its records and furnishings
in the Upper Keys area.
Please be advised that the Division of Public works will
provide you assistance with this move. A member of that staff
will be in contact with you, or may have already been in
contact witli you, for the purpose of making arrangements.
Please be advised that this assistance is granted with the
following understandings:
1. The County is not in any way. condoning or
supporting any relationship under your new lease
arrangement.
2. The County will not be responsible for the
packaging of records.

We have reviewed County Ordinance 6-1980 which indicates that
the Monroe County Fine Arts Council (MCFAC) was authorized by
Chapter 265, F.S. and was created by the Monroe County Board of
County Commissioners on May 1, 1980. The Monroe County Board of
County Commissioners appointed the Council's initial Board and
any subsequent vacancies on the Council. Section 1 of the
Ordinance clearly states that the MCFAC is a part of Monroe
County's government.
Since the MCFAC is a part of the Monroe County Board of County
Commissioners, all employees filling regularly established full
and part-time positions should have been enrolled and reported
for retirement purposes pursuant to Section 60S-1.004(4)(b),
F.A.C., copy enclosed.
The Board of County Commissioners should provide the Division
with a listing of all employees, including social security
numbers, since the MCFAC's date of creation, May 1, 1980. In
addition, current employees should complete a Personal History
Record, form FRS-M10, which can be obtained from the Monroe
County Board of County Commissioner's Personnel Department.
For employees that have terminated, in addition to their name
and social security number, we will need their date of birth
and date of termination.
Retroactive retirement contributions should be reported by
month for the affected employees on your agency's next payroll.

(a) A regularly established position in a state
agency is a Position which is authorized pursuant to
Section 216.262(1)(a) and (b), F.S., and is
compensated from either a salaries appropriation
as provided for in Section 216.011(1)(x) I . and 2.,

3A-10.031, F.A.C.
(b) A regularly established Position in a local
agency (district school board, county agency,
community college; city and special district) is an
employment position which will be in existence

position for retirement purposes and the employer
shall enroll the current employee filling the position
into the retirement system and shall begin the first
day of the seventh calendar month to make the
necessary contributions.
(d) The following types of positions in a local
agency are considered temporary positions for
retirement purposes. Documents to support such
temporary positions listed below must be
maintained in the agency's records (see
60S-5.007(2)).
1. Student Employees (persons who are bona
tide students in an accredited educational or
vocational program who perform services for a
public employer in a temporary position set aside
strictly for students).
2. Work -Study Employees (students
participating in the Federal work-study program).
3. Temporary Instructional Personnel (persons
appointed to positions which are established with
no expectation of continuation beyond one semester
or one trimester at a time, to teach in a community
college, public school, or vocational institution;
effective July 1, 1991, such positions may include
paper graders, tutors, notetakers, and lab tutors at
community colleges).
4. Substitute Teachers (persons not on contract
called to work intermittently to substitute).
5. Persons on Call (employees who are called to
work unexpectedly for brief periods and whose
employment ceases when the purpose for being
called is satisfied).
6. CETA and JTPA participants.
7. Non -salaried Elected Officials (persons
elected or appointed to a position in which they
receive no compensation, but receive expenses, e.g.,
per diem, stipend, or an honorarium).
8. Temporary Non -instructional Community
College Employees (effective July 1, 1991,
non -instructional employees paid from an
other -personal -services budget for not more than
2080 hours of total service within a single
community college. Such person who is employed
beyond 2080 total aggregate hours within a
community college shall thereafter be an employee
filling a regularly established position and a
compulsory member of the Florida Retirement
System regardless of the budget from which he is
paid.)
9. Individuals employed on a temporary basis as
a result of a state of emergency as declared by the
Governor because of a disaster caused by
destructive storms, winds, floods, fires,
earthquakes, freezes, and other similar
emergencies.
(6) A member who terminates employment

(7) The effective date of membership in each
class enumerated in subsection (1) and defined in
22B-6.001 shall be as follows:
(a) Regular Class members:
1. A regular member shall have membership in
the Regular Class effective on his first day of
employment.
2. A special risk member who becomes ineligible
for special risk membership shall have his
designation of special risk membership
discontinued and shall become a Regular Class
member on the first day of the month following the
date the member becomes ineligible for special risk
membership.
(b) Special Risk Class members shall have
membership in the Special Risk Class effective as
provided in 605-1.005.
(c) Special Risk Administrative Support Class
members shall have membership in the Special
Risk Administrative Support Class effective as
provided in 605-1.0054.
(d) Elected State and County Officers' Class
members:
1. An elected officer who becomes a compulsory
member of the Elected State and County Officers'
Class in accordance with 60S- 1.0055(1 ) shall have
membership in such class on the date such officer
assumes office; or
2. An elected officer who has withdrawn from
the Elected State and County Officers' Class and
later elects to rejoin the Elected State and County
Officers' Class in accordance with 605-1.0055(2)
shall have membership in such class on the first day
of the month during which the Division receives the
officer's request to rejoin the Elected State and
County Officers' Class.
(e) Senior Management Service Class members
shall have membership in the Senior Management
Service Class effective as provided in 60S-1.0057.

(1) Compulsory Membership — Participati

existing systems who was on a noncreditable
leave -of -absence under his existing system or the
entire period of leave -of -absence was not claimed
