Mv_tnik Countv Attorney_ Finance File KEY WEST MARATHON PLANTATION KEY PK/ROTH BUILDING 500 Whitehead Street 3117 Overseas Highway 88820 Overseas Highway 50 High Point Road Key West,Florida 33040 Marathon,Florida 33050 Plantation Key,Florida 33070 Plantation Key,Florida 33070 305-294-4641 305-289-6027 305-852-7145 305-852-7145 SIXTH AMENDMENT TO THE AGREEMENT FOR PROFESSIONAL SERVICES FOR THE PLANTATION KEY JUDICIAL COURTHOUSE AND DETENTION FACILITY This SIXTH AMENDMENT ("Sixth Amendment") to the AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN OWNER AND CONSULTANT dated February 18,2015,(the"Agreement") is made and entered into February 20, 2019,between MONROE COUNTY("County") and CURRIE SOWARDS AGUILA ARCHITECTS,INC.("Consultant"),in order to amend the Agreement,as First Amended on May 20,2015,Second Amended on October 21,2015,Third Amended on May 17,2017, Fourth Amended on January 17,2018, and as Fifth Amended on May 16,2018, as follows: WITNESSETH WHEREAS,on February 18,2015,the parties entered into an Agreement for professional services to design and permit the Plantation Key Judicial Courthouse and Detention Facility("Project"); and WHEREAS, on May 20, 2015, the parties agreed to a First Amendment to the Agreement increasing Consultant's scope of work to undergo a site plan review and approval process,which is a requirement for the Village of Islamorada; and WHEREAS, on October 21, 2015, the parties agreed to a Second Amendment to the Agreement to provide a schedule of values for compensation that includes the Schematic Design, Design Development, Construction Documents, Bidding and Permitting, and Construction Administration phases; and WHEREAS,on May 17,2017,the parties agreed to a Third Amendment to the Agreement to provide sub-consultant services for Civil Engineering, Landscape and Irrigation design, Voice/Data/AV and Security, Acoustics, Sustainable Design and Cost Estimating and to include public records provision revisions in compliance with section 119.071 Florida Statues; and WHEREAS, on January 17, 2018, the parties agreed to a Fourth Amendment to the Agreement to provide sub-consultant services for the Interior Design and Building Commissioning and Training Services as identified in Attachment C of the Agreement dated February 18,2015,and with the Florida Department of Management Services Design Professional Guidelines; and WHEREAS,on May 16, 2018, the parties agreed to a Fifth Amendment to the Agreement to provide the Services of an Architectural Historian to verify the historic significance of the existing Spottswood building's eligibility to be registered as a Historic place; and -1 's. v Sixth Amendment to Agreement between CSA and Monroe County for P.K.Judicial Courthouse WHEREAS, the Consultant requires expansion to the scopes of service added with the Third Amendment in order to successfully coordinate the existing site utilities including electrical, data, water service, storm sewer and sanitary sewer with the associated service providers. WHEREAS,the Consultant had not received prior direction for this coordination with utility providers or to include a comprehensive layout of the existing utilities in previous preparation of their construction documents. These services are considered necessary for the Scope of Services for the completion of the design through construction of the Project; and NOW THEREFORE IN CONSIDERATION of the mutual promises obtained herein, the parties hereby agree that the original Agreement shall be amended as follows: 1. In accordance with Article III, Exhibit C, of the Agreement, Consultant shall engage the services of sub-consultants to provide all necessary actions, coordination and deliverables in order to coordinate and design the project. A. Discovery i. Consultant shall be solely responsible for identifying the locations of existing utilities,meters and conduits that will be impacted by construction. ii. Consultant shall identify entities that have power,water,data,electrical equipment on site and verify the site conditions. iii. Consultant shall perform as needed site walks to discover the location of utilities. iv. Consultant shall absolutely verify all power and data conveyance on the site in regard to the Sheriff's emergency communications, back-up generators and the array towers located on site. B. Coordination i. Consultant will identify existing utilities on the project site through research of available documents,site visits,and include coordination with Monroe County,the Village of Islamorada, the Florida Keys Aqueduct Authority, The Florida Keys Electrical Co-Op, AT&T, Comcast, and any other agencies that may have knowledge of existing services on the site. ii. Consultant shall highlight any work that will require an outside agency to have work completed as a result of work being done on the site. C. Design i. Consultant shall design a proposed layout of new pole locations and required conduits to be approved by Owner and utility providers. ii. Consultant shall supply approved design with utility providers and implement any changes required. System design to include cabling, wiring, distribution, boxes, and other specifics to their system will be prepared by the individual utility company. iii. Consultant shall merge final approved design into the final "As-Constructed" drawings. D. Deliverables i. Consultant shall provide a schematic drawing showing the relationships of all utilities that will be impacted by demolition of existing buildings, and removal of existing power poles. Pursuant to section 7.3 of the Agreement, the County shall pay the Consultant monthly in current funds for a percent complete of the sub-consultants performance of the additional services stated herein for the total lump sum of Thirty-Nine Thousand Eight Hundred Dollars and 00/100($39,800.00). The remaining terms of the Agreement and as Amended,not inconsistent herewith,shall remain in full force and effect. - IN WITNESS WHEREOF,the parties hereto have executed this Sixth Amendment on the date stated above.Execution by the Consultant must be by a person with authority to bind the Consultant.
