09/27/2005 Organizational Meeting MINUTES OF THE 2005/1 MONROE COUNTY VALUE ADJUSTMENT BOARD Organizational Meeting Marathon Government Center Tuesday, September 27, 2005 The Organizational Meeting of the Monroe County Value Adjustment Board convened at 10:00 a.m., on the above date, at the Marathon Government Center located at 2798 Overseas Highway, Marathon. Present and answering to roll call were Commissioner Charles "Sonny" McCoy, Commissioner George Neugent, Commissioner David Rice, School Board Member Andy Griffiths, and School Board Member Debra Walker. Also present were Pamela Hancock, Deputy Clerk; Ervin A. Higgs, Property Appraiser; Bob Shillinger, Assistant County Attorney; and Attorney John Dent, representing the Property Appraiser. Motion was made by Commissioner Rice and seconded by School Board Member Debra Walker to nominate Commissioner Neugent to serve as Chairman of the 2005 Value Adjustment Board. Motion carried unanimously. Motion was made by Commissioner McCoy and seconded by School Board Member Walker to nominate Commissioner Rice to serve as Vice-Chairman of the 2005 Value Adjustment Board. Motion carried unanimously. Pamela Hancock, Deputy Clerk reported on petitions filed as follows: 1. Homestead Petitions 151 Petitions filed - 80 Petitions resolved 78 Lower Keys/Key West 14 Middle Keys 59 Upper Keys 2. Real Property Petitions 196 Petitions filed 96 Lower Keys/Key West 65 Middle Keys 35 Upper Keys 3. Tangible Personal Property Petitions 6 Petitions filed 3 Lower Keys/Key West 2 Middle Keys 1 Upper Keys 09/27/2005 2005/2 4. Late Filed Petitions. After discussion, motion was made by Commissioner McCoy and seconded by Commissioner Rice to allow all late filed petitions to be heard by the selected Special Magistrate. Motion carried unanimously. 5. Revised TRIM Notices, as follows: 96 Revised Deadline of September 27, 2005; 8 Revised Deadline of October 3, 2005; 1 Revised Deadline of October 7, 2005; 57 Revised Deadline of October 10, 2005; 4 Revised Deadline of October 11, 2005. Motion was made by Commissioner Rice and seconded by School Board Member Walker to adopt the following Resolution implementing the authorization provided for in Section 194.013, Florida Statutes, to require a filing fee for certain petitions filed with the Board. Motion carried unanimously. RESOLUTION NO. VAB 001-2005 Said Resolution is incorporated herein by reference. Ervin Higgs, Property Appraiser addressed the Board concerning the Revised Proposed Tax Notices. Bob Shillinger, Assistant County Attorney addressed the Board concerning the Monroe County Value Adjustment Board document, dated September 27, 2005. Mr. Shillinger advised the Board of four (4) changes to the Administrative Rules: 2005, as follows (bolded): Page 5, line 19 - ...the Property Appraiser not later than 15 days before the scheduled hearing on the taxpayer's petition... Page 6, line 27 - ...shall be sent not less than twenty-five (25) days prior to the scheduled hearing. Page 8, line 19 - ...at least 15 days prior to the scheduled hearing... Page 8, line 24 - ...at least 7 days prior to the scheduled hearing... Motion was made by Commissioner McCoy and seconded by School Board Member Griffiths to adopt the above changes. Motion carried unanimously. Mr. Shillinger advised the Board that the Auditor General's County Value Adjustment Boards Performance Audit, dated July 2005 was included at the back of the binder for discussion at a later date. Commissioner Neugent discussed Finding No. 5: County Attorneys Representing the Value Adjustment Boards. Mr. Higgs addressed that Board. After discussion, motion was made by Commissioner Rice and seconded by School Board Member Walker to proceed with the process, and discuss the Auditor General's Audit at the Final Board Meeting tentatively scheduled for January 12, 2006. Motion carried unanimously. 09/27/2005 2005/3 Board discussed the review and selection of Applicants for Special Magistrate Positions, and authorized execution of Contracts with the selected Special Magistrates. After discussion, motion was made by School Board Member Walker and seconded by School Board Member Griffiths to appoint Attorney Lee R. Rohe to serve as Special Magistrate for the 2005 Value Adjustment Board to hear issues of Exemptions and Classifications. Motion carried unanimously. Motion was made by Commissioner Rice and seconded by Commissioner McCoy to appoint James Elam to hear petitions located in the Middle and Upper Keys, and to appoint Regina Corcoran to hear petitions located in the Lower Keys and the reschedules, serving as Special Magistrates for the 2005 Value Adjustment Board to hear issues of Valuation of Real Estate. Motion carried unanimously. Motion was made by Commissioner Rice and seconded by School Board Member Walker to appoint Jeffrey Robinson to serve as Special Magistrate for the 2005 Value Adjustment Board to hear issues of Tangible Personal Property. Motion carried unanimously. Mrs. Hancock advised the Board of the previous year Special Magistrate Fees as follows: the 2004 Value Adjustment Board approved Special Magistrate fees at $150.00 per hour, with a guaranteed four hours, and no travel reimbursements. Motion was made by Commissioner McCoy and seconded by Commissioner Rice to approve the Special Magistrate fees at last years rate. Motion carried unanimously. Motion was made by Commissioner McCoy and seconded by School Board Member Griffiths to approve the Special Master's schedule. Motion carried unanimously. Said list is attached hereto. Motion was made by School Board Member Walker and seconded by Commissioner Rice approving the tentative Final Meeting date of Thursday, January 12, 2006 - 10:00 a.m., at the Marathon Government Center.
