09/27/2002 Organizational Meeting MINUTES OF THE 2002/1 MONROE COUNTY VALUE ADJUSTMENT BOARD Organizational Meeting Marathon Library Friday, September 27, 2002 The Organizational Meeting of the Monroe County Value Adjustment Board convened at 10:00 a.m., on the above date, at the Marathon Library located at 3251 Overseas Highway, Marathon. Present and answering to roll call were County Commissioner George Neugent, Monroe County School Board Members Andy Griffiths, and Eileen Quinn, and Commissioner Dixie Spehar. Absent was Commissioner Murray Nelson. Also present were Danny L. Kolhage, Clerk; Pamela Hancock, Deputy Clerk; Ervin A. Higgs, Property Appraiser; Suzanne Hutton, Assistant County Attorney; and Attorney John Dent, representing the Property Appraiser. All stood for the Invocation and Pledge of Allegiance. Motion was made by Commissioner Spehar and seconded by Commissioner Neugent to nominate Commissioner Nelson to serve as Chairman of the 2002 Value Adjustment Board. Motion carried unanimously. Commissioner Neugent asked if Commissioner Spehar would host the meeting today, which she agreed, but said from this point on it would be Commissioner Nelson. Motion was made by Acting Chairman Spehar to nominate Commissioner Neugent to serve as Vice-Chairman of the 2002 Value Adjustment Board. After discussion, motion carried unanimously. Pamela Hancock, Deputy Clerk advised the Board on the petitions filed as follows: 1. Homestead Petitions 46 Petitions filed - 30 Petitions resolved 2. Real/Tangible Property Petitions 230 Petitions filed 123 Lower Keys/Key West 22 Middle Keys 82 Upper Keys 09/27/02 2002/2 Mrs. Hancock advised the Board that there was a revised TRIM Notice sent out to Rennardson and they were given a deadline of October 7th to file a petition with the Board. Motion was made by School Board Member Griffiths and seconded by School Board Member Quinn to adopt the following Resolution implementing the authorization provided for in Section 194.013, Florida Statutes, to require a filing fee for certain petitions filed with the Board. Commissioner Neugent addressed the Board. Motion carried unanimously. RESOLUTION NO. VAB 001-2002 Said Resolution is incorporated herein by reference. Ervin Higgs, Property Appraiser addressed the Board concerning commercial and tangible personal property petitions. Danny Kolhage, Clerk read to the Board new legislation, for the next tax year, regarding Special Master criteria. Mrs. Hancock advised the Board that James Elam had submitted his application for consideration of Special Master after the deadline. After discussion, Mr. Elam was disqualified from being considered. The Board accepted the input of the Special Master Applicants as follows: Nancy Bauknight advised the Board that Thomas Wright was in Orlando and not available; Russell Yagel, not present; Diane Covan addressed the Board; Lee Rohe addressed the Board; Mrs. Hancock advised the Board that William Webster was representing the Wakulla County Property Appraiser's Office regarding their Value Adjustment Board; Regina Corcoran addressed the Board. Mr. Elam was given the opportunity to address the Board, but was not considered for appointment. The Board discussed approval of Special Master(s) for 2002. After discussion, motion was made by Commissioner Neugent and seconded by School Board Member Griffiths to appoint Attorney Thomas Wright to serve as Special Master for the 2002 Value Adjustment Board. Motion carried unanimously. The Board discussed approval of an alternate Special Master. Mrs. Hancock advised the Board of conflicts that Mr. Wright would have regarding this years Hearings with the petition he filed on behalf of a client, Coury Investments, and Hawk's Cay. After further discussion, Suzanne Hutton, Assistant County Attorney advised the Board that Mr. Wright's filing a petition on behalf of a client would represent a conflict pursuant to Florida State Statute 194.035(1), and make him ineligible to serve as Special Master. Motion was made by Commissioner Neugent and seconded by School Board Member Griffiths to rescind the appointment of Attorney Thomas Wright to serve as Special Master for the 2002 Value Adjustment Board. Motion carried unanimously. Motion was made by School Board Member Griffiths and seconded by Commissioner Neugent to appoint Attorney Lee Rohe to serve as Special Master for the 2002 Value Adjustment Board. Motion carried unanimously. S S 09/27/02 2002/3 Motion was made by Commissioner Neugent and seconded by School Board Member Griffiths to appoint Regina Corcoran, Real Estate Analyst, Senior and Field Appraiser to serve as alternate Special Master for the 2002 Value Adjustment Board. Motion carried unanimously. Mrs. Hancock advised the Board of the previous year Special Master Fees as follows: The 2001 Value Adjustment Board approved Special Master fees at $150.00 per hour for the scheduled meeting time, as well as an additional hour each way for time spent for travel from Marathon to Key West, and Marathon to Key Largo, plus mileage at the standard statutory rate of .29 cents per mile. Motion was made by Commissioner Neugent and seconded by School Board Member Quinn to approve the fees as stated. Motion carried unanimously. Motion was made by Commissioner Neugent and seconded by School Board Member Quinn to approve the Special Master's schedule. Motion carried unanimously. Said list is attached hereto. Mrs. Hancock advised the Board that the tentative date of Tuesday, December 9, 2002, was listed on the Agenda incorrectly. The tentative date should have read Monday, December 9, 2002. Motion was made by Commissioner Neugent and seconded by School Board Member Griffiths approving the tentative Final Hearing date of Monday, December 9, 2002 - 10:00 a.m., at the Marathon Government Center.
