MONROE COUNTY
VALUE ADJUSTMENT BOARD
Final Hearing
Harvey Government Center
at Historic Truman School
Monday,December 7, 1998
The Final Hearing of the Monroe County Value Adjustment Board convened at
10:00 a.m.,on the above date, at the Harvey Government Center located at Historic
Truman School, 1200 Truman Avenue,Key West. Present and answering to roll call
were County Commissioner Shirley Freeman and Chairman Mary Kay Reich; Monroe
County School Board members Andy Griffiths and Pat Labrada. Mayor Wilhelmina
Harvey was absent. Also present were Danny L. Kolhage, Clerk of the Court; Ruth Ann
Jantzen, Deputy Clerk; Ervin Higgs, Property Appraiser;James T.Hendrick, County
Attorney;John Dent, Attorney,representing the Property;staff and the public.
Motion was made by Mr. Griffiths and seconded by Mr. LaBrada to approve the
Minutes of the October 14, 1998 Organizational Meeting as presented. Motion carried
unanimously.
A Public Hearing was held to hear Homestead Petitioners who wished to address
the Board. There were no Homestead Petitioners present. Motion was made by
Commissioner Freeman and seconded by Mr. LaBrada to approve the Special Master's
recommendations for the 1998 Homestead Petitions. Motion carried unanimously.
A Public Hearing was held to hear Real Property Petitioners who wished to
address the Board. The following Petitioners addressed the Board:
Petition 146-1998 - Florida Rock and Sand Company,represented by Steve
Torcise, Jr.,President. Motion made by Mr. LaBrada and seconded by
Mr. Griffiths to uphold the recommendation of the Special Master. Motion
carried unanimously.
Petition 017-1998 - John & Chiang Battillo, represented by Mrs. Battillo and
Mr. Hotalin. Board directed County Attorney to follow through with Code
Enforcement to seek a solution to the existing problem. Motion made by Mr.
LaBrada and seconded by Mr. Griffiths to uphold the recommendation of the
Special Master. Motion carried unanimously.
Petition 006-1998 - Banner Tire, represented by Arcadio Rodriguez, owner.
Motion made by Commissioner Freeman and seconded by Mr. LaBrada to change
the assessment to $300,000.00. After further discussion, Conunissioner Freeman
changed her motion to remand this petition back to the Property Appraiser's
Office to provide an appropriate compensation. Motion seconded by Mr.
Labrada. Motion carried unanimously.

Petition 078-1998 - Mr. & Mrs. James P. Russell. Motion made by Mr. LaBrada
and seconded by Mr. Griffiths to uphold the recommendation of the Special
Master. Motion carried unanimously.
Ruth Ann Jantzen introduced to the Board correspondence by Mrs. Simko to be
entered as evidence into the record concerning Petition 001-1998. Motion made
by Commissioner Freeman and seconded by Mr. LaBrada to uphold the
recommendation of the Special Master. Motion carried unanimously.
Motion made by Commissioner Freeman and seconded by Mr. Griffiths to
approve the recommendations of the Special Master for all 1998 Real Property Petitions
with the exception of Petition 006-1998. Motion carried unanimously.
Motion made by Mr. Griffiths and seconded by Mr. LaBrada to approve the
Refund List submitted by the Clerk of the Court. Motion carried unanimously.
Said list is attached and made a part of the record.
Motion made by Commissioner Freeman and seconded by Mr. Griffiths to
approve the Special Master Fees of Thomas D. Wright,Esq.,and traveling expenses, as
well as other bills associated with the Value Adjustment Board. Motion carried
unanimously.
Motion made by Commissioner Freeman and seconded by Mr. Labrada to
continue the Final Hearing to Thursday,January 14, 1999, 8:00 a.m.,at the Harvey
Government Center at Historic Truman School, 1200 Truman Avenue,Key West to
resolve Petition 006-1998, approve the Certification of the Tax Roll and any other
business that may properly come before it. Motion carried unanimously.
There being no further business to come before the Board this date, Motion by
Commissioner Freeman and seconded by Mr. LaBrada to adjourn. Motion carried
unanimously.
