01/13/1998 Final Hearing r r MINUTES OF THE MONROE COUNTY VALUE ADJUSTMENT BOARD Final Hearing Value Adjustment Board Tuesday,January 13, 1998 The Final Hearing of the Monroe County Value Adjustment Board convened at 10:00 a.m.,on the above date, at the Harvey Government Center at Historic Truman School, 1200 Truman Avenue,Key West. Present and answering to roll call were Monroe County School Board members, Andy Griffiths and Pat Labrada; Mayor Jack London and Chairman Mary Kay Reich. Commissioner Wilhelmina Harvey arrived later in the meeting. Also present were Ruth Ann Jantzen, Deputy Clerk; Ervin Higgs, Property Appraiser; James Hendrick, County Attorney,and Stuart Schurr, Assistant County Attorney;John Dent, Attorney,representing the Property Appraiser; Special Masters Thomas D. Wright,Esq.,James Flenner and Raymond Bishop; and County Staff. Motion was made by Mayor London and seconded by Mr. Griffiths to approve the Minutes of the October 1, 1997 Organizational Meeting of the Value Adjustment Board. Motion carried unanimously with Commissioner Harvey absent. A Public Hearing was held for the following Real Property Petitioners present who wished to address the Board: County Attorney James T.Hendrick addressed the Board and petitioners to state for the record that the Board previously determined to delegate Special Masters the fact finding of the petitions. What will be heard today is whether or not the recommendations of the Special Masters should be affirmed, rejected or modified in some way. Petition 204-1997 - Kit R. Larsen addressed the Board. After discussion, motion was made by Mayor London and seconded by Commissioner Harvey to affirm, subject to any adjustment which would be made by the Property Appraiser based upon a certified survey being given to them by the property owner. Motion carried unanimously. Petition 206-1997 - William K. Morton addressed the Board. After discussion, motion was made by Mr. Labrada and seconded by Mr. Griffiths to approve the Special Master's recommendation. Motion carried unanimously. -2- Petition 102-1997 - Harold Bromm,Jr.,addressed the Board. After discussion, motion was made by Commissioner Harvey to reduce the assessment by $10,000.00 because of one bathroom in the house. Motion died for lack of a second. Motion was made by Mr. Labrada and seconded by Commissioner Harvey to send Petition 102-1997 back to Special Master James Flenner to present additional information. Motion carried unanimously. Commissioner Harvey and Mayor London left the meeting. Petition 074-1997 - Karl H. Hauck addressed the Board. After discussion, Motion was made by Mr. Griffiths and seconded by Mr. Labrada to approve the Special Master's recommendation. Motion carried unanimously. Petition 203-1997 - Jeff Whitehead addressed the Board. After discussion, Motion was made by Mr. Griffiths and seconded by Mr. Labrada to approve the Special Master's recommendation. Motion carried unanimously. Petition 021-1997 - Charles R. Frazier addressed the Board. After discussion, motion was made by Mr. Labrada and seconded by Mr. Griffiths to approve the Special Master's recommendation. Motion carried unanimously. Motion was made by Mr. Griffiths and seconded by Mr. Labrada to approve the recommendations of the Special Masters for the 1997 Homestead Petitions. Motion carried unanimously. Motion was made by Mr. Labrada and seconded by Mr. Griffiths to approve the recommendations of the Special Masters for the 1997 Real Property Petitions with the exception of Petition No. 102-1997. Motion carried unanimously. Motion was made by Mr. Griffiths and seconded by Mr. Labrada to approve the Refund List which includes petitioners whose values were reduced. Motion carried unanimously. Motion was made by Mr. Labrada and seconded by Mr. Griffiths to approve the expenditures of the Value Adjustment Board including the Special Master Fees and Notices of Final Hearing. Motion carried unanimously. Board directed Special Master James Flenner to re-hear Petition 102-1997 on Tuesday,January 20, 1998, 10:00 a.m.at the Harvey Government Center. -3- Board directed the continuation of the Final Hearing be held on Wednesday,January 21, 1998, 10:00 a.m.at the Harvey Government Center for the purpose of a decision on Petition 102-1997 and Certification of the Tax Roll.
